I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. And the discrimination is so blatant. This is what I understand: The Attorney General has announced he will overlook US Immigration law as the fund will compensate the surviving partners, spouses and families of illegal aliens (in this country against US law), will not deport those coming forward, and (get this), if economic information about the undocumented alien is needed, will not penalize the employers of these people . This importantly should include the partners and children of same sex unions. Monday, January 21, 2002 12:38 PM WTC Attack Compensation Mr. Zwick, After reading all of the materials regarding the compensation to families of the victims of the WTC attack, including the Air Transportation Safety and System Stabilization Act, I find the Dept. of Justice's interim final regulations highly inadequate, and showing practically nothing of the intent that Congress had laid out. My brother, , was a victim of the attack and losing him has left a hole in this family that really can't be replaced. And although he didn't leave any economic dependents, because he was single with no children, the emotional and mental anguish left us, his siblings and father, was devastating. And with these interim regulations others, especially those widows with children, are left high and dry by the DOJ because of their undervaluation of economic and non economic rewards. Others in comparable cases have received so much more. If this government can find 15 billion dollars to bail out the airlines, surely they can find enough to justly compensate the families of that horrific day. Saturday, February 16, 2002 3:04 PM Final Interim Rule Comments Dear Mr. Feinberg, I recently attended a meeting with you and families and survivors of the WTC tragedy. I commend you on the time you are taking to personally meet with families in each state to provide information and answer questions about the Victim Compensation Fund. You mentioned that in cases in which the victim died intestate, you would rely on the laws of the state in which the decedent resided for distribution of funds. In California, this would preclude heterosexual or homosexual domestic partners from collecting any funds because California does not recognize common law marriages or gay marriages. While defaulting to State law is the easiest way to administer the distribution of funds, it doesn't always reflect the reality of the way a person lived or what that person would have wanted (which can be ascertained by other documents besides a will or marriage certificate). It also doesn't take into consideration the fact that a person who has an "estate" of say $25,000 makes different decisions from someone who has an "estate" of the magnitude proposed under the Special Fund. My fiance who died on UA Flight and I lived together for 11 years and were planning to marry on July 4, 2002. At the time of his death, his "estate" was substantially less than $100,000 (therefore would not go into probate) so he didn't feel the need to do a will. He died believing that I would be provided for to the best his abilities at the time by naming me as sole beneficiary of his life insurance and pension plans. At the time of his death, this special fund did not exist, therefore he made no provision for it. I believe that the reason why so many people who died in the WTC tragedy were intestate is because they, like , did not have the substantial estates that the US Government is now granting them. If people had known the sums of money involved, most would have designated how the money should be distributed. Given the unique, unforeseeable circumstances regarding the creation of these funds, I think we should apply common sense to how the funds should be distributed. If an adult person was in a long-term committed relationship and had designated their partner as the sole beneficiary of their life insurance and pension benefits, it seems pretty obvious what that person would have wanted to do with these funds, had he known about them at the time of his death. The simple reliance on state law for a situation that the decedent could not have anticipated and which would have affected his decisions, is a cruel game of "gotcha" for those of us who either didn't make it to the altar in time or who, because of antiquated marriage laws, weren't allowed to go to the altar to begin with. A possible way to distribute the economic loss portion of Victim Compensation Funds is to do it in the same ratio that funds from other sources were distributed to the decedent's heirs. Since pain and suffering can not be measured, those funds should be distributed evenly amongst the heirs. For example, let's say the Fund calculates a total net economic loss benefit of $100,000 and a pain and suffering loss of $90,000. The family already received $10,000 as follows: $5,000 life insurance proceeds to A $2,500 remainder assets to B $2,500 remainder assets to C The fund would pay out the $100,000 as follows: $80,000 to A $55,000 to B $55,000 to C You stated that you wanted to distribute funds in a way that was fair. If that is the case, then it is only fair to consider the reality of the way in which U.S. citizens choose to live their lives. We are not a perfect people, nor are we cookie cutter images of one another. What constitutes "family" is different for each of us. All we can do is look at the way a person lived his life, recognize what was important to him, and not penalize him or his loved ones for things beyond his control. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. My father (the deceased) was widowed 12 years ago, of which I am the only child. Four years ago my father remarried. My step-mother has two children (one 23 and one 21) who are not related to my father by anything other than marriage. I am concerned that since she is the personal representive, I will not be protected in the Compensation process but her children may be. I believe in circumstance like this, the Special Master should take the following into consideration: 1) The direct (blood) relation of claimants in determining the split of funds. 2) The length of time associated with the decendent (ie 4 years of marriage as opposed to 24 years of life) 3) Amount of support the decendent gave to each benificiary. Monday, March 11, 2002 Victims' Fund for 9/11 Dear Sirs or Madams: I cannot state with enough passion how grateful I am to this country and this government for recognizing the needs and loss the families endured when they lost loved ones on 9/11. Giving up one's life on 9/11 should not know any political boundaries. If President Bush doesn't speak emphatically against denying gays and lesbians equal coverage, then he does not deserve to label as a uniting President, nor does he deserve to be reelected. Tuesday, January 15, 2002 8:35 PM Victim Comments As a widow of one of the victims of 9/11, I would like to voice some of my objections to the present format for the reparations as outlined by the Victims Compensation Fund. To begin with, I have some grave concerns over the speed by which this bill was passed. I do not believe that Congress, in their hast, ever meant to create a program that would not adequately assist families who suffered losses in the attacks. Yet, based on the statutes, many civilians, as well as policemen and firemen, stand to receive nothing. I also believe that the premise of this bill was to 1) get aid to the people that needed it quickly and 2) ease the pain that the economy would suffer had everyone affected sued the airlines and security companies. The $80 billion worth of damages chasing the $4 billion of insurance could have brought the airlines and the country to its knees. So I understand the "whys" of the program, I am just concerned about the "hows." I agree that payment for "pain and suffering" is the same, regardless of how you died or where in the building you might have been...a life is a life. The clerk's wife deserves the same amount as the executive's wife for "pain and suffering." However, $250,000 seems extremely low and arbitrary. It seems like the government is trying to stay below a budget figure that was pre-determined before the Special Master was assigned. Had this case ever gone to court, this number would have been much higher. This is not reasonable based on payments that have been decided upon by a jury in similar cases. In addition, my husband called me at 9:15 after both planes had hit. His phone bill reflects over 1.5 hours of his attempts to call 911 for help. He had a slow, miserable death. Do you think $250,000 is the appropriate amount? My husband, , was employed by as a . He worked on the floor of One WTC. He perished along with 68 other members of his firm. By the definitions set forth by the Special Master, my husband fell in the 2% category of the high wage earners in America. As we are a two income family, we found it prudent to run our financial affairs with a view towards the future. In lieu of expensive cars and vacations, we made a conscious decision to spend money on adequate life insurance for ourselves and our twin (11 year old) boys. Since I am an ovarian cancer survivor, we always felt the need to cover ourselves adequately for the well-being of our children. If the entire amount of our personal life insurance, insurance received from , Social Security, Workman's Comp. etc. is to be deducted from "future lost earnings" based on the $230,000 cap, I OWE YOU MONEY. By my figures, if you used 's actual salary and commissions, accounted for increases, stock options etc., the payment would be substantially higher. It is extremely frustrating as the survivor. The way this fund works, the only one culpable and liable for this entire situation is ME. I bail out the Airlines (poor security, profiling systems), the security companies, and the US government (who had indications something like this could happen.) My payments to the insurance companies and social security let everyone off the hook. To add insult to injury, the program advertises the ability to "come in for a hearing." The problem with this idea is that if you come in for a hearing, you waive your right to sue. What if the outcome of the hearing is unacceptable to me? I get nothing and no ability to exercise my due process? If the rules are not changed and the fund is not an option for me, is it fair that congress limited the liability of the airlines and limited my ability to sue? It seems like I have no options here. What ever happened to my constitutional right for a fair and impartial jury? As I said earlier, I am a cancer survivor and as such, medical insurance is a big concern to me. I also have a son with Asperger Syndrome, and I have no idea what his future ability to earn a living will be. Yes...I had life insurance. However, do I have enough for the rest of my life? I doubt it. My husband was a great provider and would have always ensured these issues were covered. Who is going to help me now if the "fund" gives me nothing? By the way, I am happily back to work. This is the way I can ensure a future for my family. I would like to see some changes made that include 1) only deducting "business related" insurance. My private insurance is my private business. 2) Not deducting social security. That is my money. I put it into the program. Why is it being used to pay for damages caused by others? 3) Increase the amount available for pain and suffering. 4) Take off the cap that states that 98% of the American public earns less than $230,000. Seems to me that is exactly why they hit the WTC....50% of the victims earned more than that! It hit us right in the economic gut. 5) If you are going to allow people to have a hearing, don't make "opting into the program" a prerequisite. 5) If the program is not an option, allow me to have my day in court, and allow me to get the reparation my family deserves.
