Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The American Council of Life Insurers is the principal trade association representing the Life insurance premiums and 81 percent of annuity considerations in the United States among legal reserve life insurance companies. After review of the Notice of Inquiry and Advance Notice of Rulemaking published in the Federal Register on November 5, 2001, our members would like to contribute their thoughts in connection with payments to be made from the Fund. It is our understanding that Congress intended that this Fund provide assistance to victims and families of victims and that the amounts to be awarded are based, in part , on the future economic losses sustained as a result of the injury or death. In light of this purpose, we would suggest that the Special Master making the awards be permitted to order that the amount be paid as an annuity. The use of an annuity in payment of compensation intended to replace future income or provide for future expenses is well established and is customarily utilized in a variety of similar situations, including awards and settlements under the Federal Tort Claims Act and the National Vaccine Injury Compensation Program (42 USC §300aa-15(f). In addition, annuities are often used in settlement of state personal injury claims. An annuity is an excellent means to provide for future expenses. The periodic payments replace the lost income. The payments are made in a predictable manner upon which the victims families will be able to rely. As articulated by the Claims Court in Loe v. Secretary of Dept. of Health and Human Services, 22 Cl. Ct. 430 ( 1991): An annuity insures that the beneficiary receives a steady stream of income throughout his entire life. An annuity protects the trust's corpus from mismanagement or waste by the parent or guardian. Thus, an annuity eliminates any fear that the compensation might be invested in an unprofitable manner. In Lewis v. Secretary of Health and Human Services, 90-968V, U.S. Claims Court, Office of the Special Masters (July 9, 1992), 1992 WL 178640 (C1. Ct.), the Special Master determining the form of a compensation award under a vaccine case noted that: An annuity, however, does provide a guaranteed level of benefits for the life of the beneficiary, regardless of fluctuations in rates of return in investments. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. It doesn't matter to the victim's life partners and family what their sexual preferences were. Page 1 of 1 Dear Mr. Feinberg: I lost the sole provider for my family on September 11, 2001, when my husband was killed in the Pentagon. My husband and I have two young children and I am a stay-at-home mother. I am losing sleep and can hardly eat over the anxiousness I feel about our financial future. I pray that you will listen to the comments made and will incorporate those suggestions that make sense to you and are feasible. I am not trying to become wealthy, but want to be able to provide for my children the way my husband would have if he had not been killed. My comments about the fund are as follows: ECONOMIC LOSS The baseline for earnings should not be calculated using the average of income from tax returns over 1998, 1999, and 2000. They should be based upon the current salary level at the time of death. My husband had 27 more years of work ahead of him. He had just received a promotion in the fall of 2000, which would not be reflected using the currently proposed formula. My husband was definitely going to continue to be promoted; however, the currently proposed formula would cause his earnings to DECREASE! Since the intent of this portion of the formula is to project future earnings, please use the 2001 salary level as a baseline. NON-ECONOMIC LOSS This amount should not have collateral offsets deducted from it, but should be protected and preserved. Therefore, please consider excluding it from the formula. The amounts suggested for non-economic loss are two low-especially for the dependents. The pain and suffering my children will experience for the rest of their childhoods and lives is most certainly worth much more than $50,000. My family should receive well over $100,000 more than someone without children. The trauma I am feeling is multiplied threefold by the pain of my children. While it is impossible to put a figure to the suffering felt, the amounts need to be much higher. If we decide to participate in the fund, we would be giving up our right to sue for wrongful death; therefore, the figures should be somewhere in between life insurance figures and historical litigation awards. My suggestion would be $750,000 per victim plus an additional $250,000 per dependent. I hope that you will incorporate some of our suggestions to come up with a program that is a compromise to litigating and attractive enough for us to choose. He was a of the firm and had worked for them just over thirty years. I have a 29 year old son, , who also works for . On that day, was working at located in mid-town Manhattan where his office faces the World Trade Center. He had just spoken to his Dad at about 8:15 when shortly thereafter he heard the roar of a large aircraft fly over his building. As he looked from his office he saw that this plane was about to crash. He watched in horror as the plane flew lower and faster and hit Tower One head on. My son and I spoke moments later and together lived through the next thirty minutes, culminating in the second plane hitting Tower Two where my brother, , was working for . We learned after several agonizing days that my brother had also lost his life in the attack. I have lost a husband of just under thirty two years. My son has lost a father, a mentor and companion. My mother in-law, has lost a son and her sole provider. had recently moved from North Dakota to Connecticut to live with our family. has lost a highly respected and productive colleague. We have also lost countless friends and acquaintances. As you are aware, lost 295 people and 196 in the attack. We feel that the Federal Fund in a sense is making us lose them again.We object strenuously to the structure of the Fund on the following grounds: 1) The Government is protecting the culpable parties (airlines, airports, INS, FBI, etc.) and limiting our opportunity to litigate. 2) Based upon its guidelines, the fund fails to provide any economic damages for our family. The offsets of life insurance, pension, workersÕ compensation etc. bring our settlement to zero. 3) We question the basis used to project a victimÕs loss of earnings (National vs. New York). 4) My husband was a highly successful business man, a contributor in every way. To talk of a minimum award (possibly $250,000) bears no relationship to the value of this person. We feel that the following points should be taken into account in order to make the fundÕs distribution more equitable to all parties: 1) We want the caps of yearly earnings to be eliminated so that the true earnings are reflected. 2) We want life insurance proceeds to be eliminated as an offset. Although we know this was legislated, it unfairly penalizes the families whose lost family member paid premiums to provide protection for his/her surviving family members . 3) We want recognition that highly paid executives like paid substantial federal taxes over many years so that others who were lost could be compensated. 4) We want the caps on non-economic damages to be raised or eliminated. Did my husband suffer? What about my son who was a witness? traveled throughout the world conducting business for in countries such as Iran, Iraq, Pakistan, Saudi Arabia, Indonesia, and Russia. He survived all of the trips to third world countries however, eventually lost his life sitting at his desk in lower Manhattan. The non-economi õc damages should be increased to at least balance the economic offsets that are in place. 5) As stated earlier, my husband was the sole provider for his mother, , who is 88 years old. We feel that this is an economic issue that needs to be taken into account by the fund. In summary we want to feel that the Government will recognize my husbandÕs worth, will accept its failure to protect him and thousands of others and will deliver to the victimsÕ families as they promised. Dear Special Master Feinberg The following are my objections to the Victims' Compensation Fund: . The airline bailout act gave the airlines $15 billion of taxpayers' money and capped the airlines' liability for the 9/11 crashes at the limits of their insurance coverage. It set up the Fund so the airlines' bailout would not come at the expense of the victims' families. . DOJ has ignored the fundamental mandate of the act to provide full and fair compensation to victims and their families, and instead created a formulaic federal program based on irrelevant concepts more familiar to the bureaucracy. . The DOJ's proposed awards for non-economic damages ($250,000 per victims plus $50,000 for a spouse and each dependent) are only-tenth the level pain in comparable cases. For example, a spouse was awarded $5 million in non-economic damages in a lawsuit arising out of Lockerbie. . Congress explicitly enumerated a broad range of non-economic damages for which victims and their families shall be compensated. . DOJ ignored this, and based its presumed awards on a military group life insurance program (SGLI) with a maximum policy of $250,000, and federal statute providing $250,000 to families of fallen public safety officers-on top of other amounts they may receive. . DOJ's approach assumes that Congress intended the non-economic damages to be illusory, because a $250,000 SGLI payment for a serviceman killed at the Pentagon would wipe out those damages under the col- lateral offset requirement. . DOJ's proposed awards for economic damages grossly underestimate actual losses, because DOJ relied on outdated, inapplicable work-life and life-cycle earnings data. Forensic economists have discovered other serious flaws in DOJ's methodology. . DOJ underestimates promotions and other increases in earnings for victims. It relied on federal civil service and military retirement system boards that track federal worker incomes and pension requirements, not the higher-paying private sector career paths. . DOJ's reliance on past 3 years of income (which the Special Master "may average") looks suspiciously like a federal pension approach, rather than considering the likely income-earning potential of the decedent, as is routinely done in wrongful death cases. . The regulations arbitrarily cap a victim's income at $225,000 a year, cutting some families' compensation by over 50%. As a result, many widows will have to sell their homes, deplete their children's college funds, and give up their plans of being full-time parents while their children are young. . A family's award may be increased above the "presumptive" award only by a showing of "extraordinary circumstances" - beyond those suffered by other victims or victims' families. This makes the hearing or appeal to the Special Master a mere charade. . The low levels of the presumptive awards will result in many family members receiving little or nothing from the Fund, once the collateral source deductions (which are not required in a court case) are made. . DOJ should fulfill, rather than flout, the act's intent by revising its rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the Fund was designed to replace. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
