As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." I am deeply saddened and outraged at the recent statement made by Kenneth Feinberg on Meet the Press that he will defer to state governments in terms of whether domestic partners of gay and lesbian victims of the 9/11 tragedy will receive any kind of compensation. As you know, there is no federal law protecting domestic partners although they pay the same taxes as heterosexuals, contribute to society, and even were recognized as playing an instrumental part in the 9/11 events ( , NY Fire Department ). It is an injustice, on top of such suffering, to deny compensation or benefits of any kind to domestic partners of gay and lesbian victims, who are not eligible for social security benefits, survivor's insurance and other compensations allowed to heterosexual couples. I ask you to direct Mr. Feinberg to make an exception for domestic partners in the same way the 9/11 fund made an exception for families of undocumented persons. Please do not contribute to further victimization by leaving these families more vulnerable after the tragic loss of their loved ones. I can not imagine seeing and/or remembering that image knowing that anyone from my family was in the building or close. How soon some forget! We all state without considering the concept that you can not put a price on life! Why would anyone anywhere ever use the word greed to describe family members of thousands of people who were the victims of THE WORST ATTROCITY ever to happen in these United States in most of our life times??? Lay out the whole national budget (foreign & domestic) inclusive of the many ludicrous "pork barrel" projects and then tell the child not yet born on 9.11 that his/her family was greedy and got over compensated as a result of their loved one getting murdered while doing little more than living! How could anyone thow such a "stone"? The cliches short sighted and small minded come to mind. Let us not forget the endless embarassing gov beaurocratic paperwork that necessitates that surviving families still grieving very personal and private losses provide many very personal family financial details in a somewhat public forum! Indeed tax dollars paid by people who lost their lives and from companies destroyed or decimated by the attack are also included! In addition, I feel that a separate fund with much more flexibility be set up to assist those who have lost incomes but not loved ones! Friday, December 21, 2001 6:17 PM Victim Compensation Fund I just finished reading an article in today's Seattle Times, "Victims' families to get average of $1.6 million" and after reading the article aloud in my office my fellow employees and I are in agreement that this is way overboard.    Although I have not heard one explanation for the reasoning behind why the payments have been tailored the way they are, I suspect that the primary reason is so that 3,200 families do not sue the airlines, in effect creating another need for airline industry bailout.  However, it is upsetting to me to read that this fund, or, as the paper says Kenneth Feinberg puts it, "an unprecendented expression of compassion" on the part of the American people to the victims and their families, will pay the families of single, childless victims who died in the September 11 tragedy.  What happened on that day was certainly a tragedy that touched the world.  It created emotional problems for people all over the world and especially in the United States.  Like any other death, I for one am at a loss of words to the families who lost people in the tragedy.  However, the ACTUAL "unprecedented expression of compassion on the part of the American people" was their giving, and mine, to the United Way and the Red Cross funds so that that money could go to the families of the victims.   What bothers me most is the inequity of this fund and the way it is categorizing people that were directly affected by the disaster.  Americans in every corner of the nation are violated every day or they are met with misfortune.  I know of two women that I went to highschool with who were murdered...one beaten to death with a blunt object and another found in her bathtub strangled.  These people were murdered just the same as were the people in the World Trade Center and the Pentagon.  On September 12 a friend of mine and her two sisters lost both of their parents in an airplane crash in the Yucatan in Mexico.  My own mother died when I was four years old and my sister six.  Social security paid my father about $100.00 per month for each of us until we were eighteen years old.  I have countless other examples of sad stories such as these.  Who compensates people like this for their loss, pain and suffering?  Who pays for the funeral costs?  They do.    We Americans exist in the land of opportunity.  Most of us are entirely capable of making important choices to plan for our futures and for the futures of those we love by obtaining life insurance, retirement funds, etc.  Some of us are lucky and we are able to get good educations and make good money in the careers of our choice.  Hopefully we are able to save for the future and whatever that may bring, good or bad.  But after the life insurance check comes, that's it for most people, if they even have that.  It does not make good sense to me that this fund is going to pay the survivors of a 25-year old single worker who made $25,000 annually up to $1.17 million before deductions, nor that a widower of a 40-year-old childless Pentagon worker earning $60,000 a year would receive $640,000 before deductions.  I can understand compensating a widowed spouse with children or children that are now left without parents.  I think paying someone who was disabled in the World Trade Center is the right thing to do.  I can understand helping them to get back on their feet for however long that takes.  I can understand helping all survivors who lost their jobs to make their house payments and to make ends meet.  But no amount of money will bring these people back.  And while this event was one of the most tragic things that has happened to America in its entire history, individuals and individual families are met with equal hardship every day.  What about all of the Boeing workers who have lost their jobs as a result of this tragedy?  Is the federal goverment paying them in addition to the measly amount they are paid in unemployment benefits?  Even Japanese individuals that were placed in camps so many years ago during the Japanese conflict were only paid around $20,000 in many instances.  So, this law is not equitable at all.   I am sickened by the obvious greed that is shown by statements made by people like &nbsp&nbsp&nbsp&nbsp of Long Island.  I would like to know what is so ultimately different about her situation and my father's.  Yet she has the gall to call the amount of money she will be getting from the Victim Compensation Fund a sick joke.  And &nbsp&nbsp&nbsp&nbsp of &nbsp&nbsp&nbsp&nbsp asks why he should be penalized for planning for his future in referring to the fact that his life insurance income will be deducted from the "award" he receives.  Getting any amount of money from the Victim Compensation Fund in addition to his life insurance is not a penalty, it is a blessing for him to receive it during a very difficult time in his life.  Both of these people need to take stock of their situations, be thankful that they are still alive, and move on like every other person who endures loss must do.  Perhaps they should spend all that energy on helping to change the world instead of being angry that the average figure of $1.6 million is not enough for them to pick up their lives and live on.    I hoped that if anything positive came out of the September 11 tragedy that at least Americans might finally realize that what they have is a whole lot more than what most other people in this entire world have.  I hoped that they might finally stop pointing fingers at everyone else and take responsibility for their own actions for once.  I also hoped that people would realize that bad things happen with no explanation, and while it is always painful to someone, we must move on.  I am angry about the way this fund will work.  I am angry that despite my wishes, through the Victim Compensation Fund I will be paying for a highly paid banker or stocktrader's family to live in addition to what I have already given to charitable organizations.    I understand the purpose of the fund, but I do not agree with the manner with which you Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other.
