Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Reg. 55901), I would like to make the following comments. Please note that many of these comments are directed in particular at the situation faced by non-U.S. claimants. Topic #5 Claimant Eligibility 1.Eligibility of non-U.S. citizens. Nothing in the statute prohibits non-U.S. citizens from filing a claim. Nevertheless, it would be useful to specify in the regulations that claimants will not be disqualified on the basis of nationality, citizenship or residency. 2.Proving presence at the World Trade Center. New York City has established a special procedure for obtaining death certificates relating to persons who are missing as a result of the September 11 attacks. It would simplify the September 11 Victim Compensation Fund claim procedure if the same affidavit could be accepted as evidence that the decedent was in fact present at the World Trade Center and died as a result of the attacks. New York has addressed three different situations and prescribed somewhat different procedures for each: a)Where the missing individual was employed by one of the government entities engaged in the rescue or one of the firms that was located in the World Trade Center, that agency or company will file an affidavit confirming the individual's location at the time of the disaster. b)Where the missing person was a passenger or crew member of one of the airplanes that crashed into the World Trade Center, a representative of the airline will certify the airplane manifest in an affidavit that will be filed in the New York County Supreme Court. c)Where employment records are unavailable or a missing individual was visiting in the World Trade Center, family members or others with personal knowledge of the individual's whereabouts, will be asked to file an affidavit attesting to the fact that the missing loved one was in the World Trade Center on the morning of September 11, 2001, and has not appeared since. For some cases in this third category, the personal representative filing the claim may not be the same as the "family members or others with personal knowledge of the individual's whereabouts" who signed the New York affidavit. In those situations, the personal representative could be required either to submit the same information that is required in the New York affidavit, or to attach the affidavit submitted in New York, and affirm that he or she adopts the contents of the affidavit and believes the statements in it to be true. For your reference, the New York procedures and sample affidavits are available at http://www.nyc.gov/html/em/dth_cert.html. Topic #6 Nature and Amount of Compensation 3."Collateral source" is defined in Section 402(4) to mean "all collateral sources, including life insurance, pension funds, death benefit programs, and payments by Federal, State, or local governments related to the terrorist-related aircraft crashes of September 11, 2001." The Special Master is required under Section 405(b)(6) to reduce the amount of compensation by the amount of the "collateral source compensation the claimant has received or is entitled to receive as a result of the terrorist-related aircraft crashes of September 11, 2001." The regulations should specifically address the treatment of government payments that are received as part of a general benefit, social security or other government program for support of spouses and dependents of deceased workers. This is particularly important in determining the effect of payments received from foreign governments, whose programs may provide an automatic subsidy to a widow or widower (particularly of an employed person), irrespective of the cause of death. In the language of Section 405(b)(6), the question is whether this money is received "as a result of the terrorist-related aircraft crashes." I would argue that general "social safety net" payments should not be counted as "collateral source" in this context, in particular because Section 402(4) refers only to government payments "related to the terrorist-related aircraft crashes of September 11, 2001," which is not an accurate description of governmental programs providing general support. 4.In two places in the statute, a reference to "claimant" makes it difficult to understand the manner in which compensation will be calculated with respect to a decedent. "Claimant" is defined in Section 405(c)(2) as a person who was present at and injured in the attacks or, in the case of one who died as a result, that persons personal representative. a)Section 405(b)(6) provides that compensation will be reduced by "the amount of the collateral source compensation the claimant has received or is entitled to receive..." [Emphasis added.] Since the claimant in the case of a decedent is the personal representative, the compensation awarded will be reduced by the amount of any collateral source payments made to the personal representative. It is not clear, however, whether compensation from the fund will be reduced for collateral source payments made to or for the benefit of other family members (e.g., directly to the decedents children, or through a guardian). b)Section 405(b)(1)(B)(i) provides that the Special Master is to determine "the extent of harm to the claimant, including any economic and noneconomic losses." [Emphasis added.] This raises two points: i.The regulations should clarify that "claimant" in the case of a decedent is interpreted under Section 405(c)(2) to mean both the decedent and the personal representative, so that the noneconomic losses of both can be considered (e.g., pain and suffering of a decedent who did not die instantly, as well as loss of consortium for an ex-spouse). ii.The regulations should clarify whether the noneconomic losses of any surviving family members other than the personal representative can be taken into account in calculating compensation. If the noneconomic losses of those other family members cannot be compensated from the fund, families will generally be compelled to select as the personal representative the one member (spouse, child, parent) who can prove the greatest amount of noneconomic loss. This would appear to be inconsistent with the purpose of the statute stated in Section 403 ("It is the purpose of this title to provide compensation to any individual (or relatives of a deceased individual) who was physically injured or killed..."). [Emphasis added.] It is extremely important that families know in advance whether the noneconomic losses of all family members as recognized under the applicable law can be included by the Special Master in the calculation of compensation, or only that of the decedent and the personal representative. 5.Section 405(b)(1)(B) provides a two-step process which leaves enormous discretion to the Special Master to determine an amount of compensation to be awarded that is different from the amount of harm that the claimant is determined to have suffered. After determining the "extent of the harm to the claimant," the Special Master determines the amount of compensation "based on the harm to the claimant, the facts of the claim, and the individual circumstances of the claimant." The statute specifies collateral source income which must be deducted from the amount of compensation awarded. If there are other factors which can reduce or increase the amount of compensation awarded, once the extent of the harm has been determined, they should be specified in the regulations, in order to ensure a predictable and fair procedure. Have we made the families of soldiers killed in the past instant millionaires? Money does not heal the hurt we feel when we lose loved ones. If I thought our government was directly responsible for this tragedy, then things would be different. I feel sure that families that lost family members in Viet Nam, Desert Strorm and other tragedies our country has endured loved them as well. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, January 28, 2002 11:29 PM Who are the real victims I have been reading the comments of my fellow Americans, and it turns my stomach to know that we are so inhuman. So I ask who are the real victims. The dead or the live ones that are left behind to witness the turning on each other. Why? I will try and answer. I am a retired fire fighter and when I saw what took place on September 11th, I wanted to pick up the phone and tell the fire fighters to go into a defensive mode. I couldn't, I am in Washington, DC and watching the events in New York. I know what they were thinking, lives to be saved. With our training this is our first reaction in this type of situation. "Save lives first, property second and ourselves last." God bless those who lost there lives doing what they were trained, and paid to do for the citizens of America. Now comes the compensation awards. " Money changes people." The almighty dollar rules again. The real victims are the ones who lost their lives. I am sure they are so embarrassed of the actions by their love ones, and their fellow Americans. The highest honor we can pay these people would be to put all the evil thoughts away. Why can't we put these evil actions behind us? It is because of the money. The government has done the one thing they always do, put the dollar bills out there. We in America think money is the answer to many of our problems. I am sure there are other solutions. It would be good to let a common American sit in on some of these panels that make decisions like this. It is awful strange that under a Republican president the plan was to save big business. The airlines, the insurance companies and the mortgage companies. Why couldn't they focus on education, that would build a strong future of America. Set up funds for the children left behind. Pay off the mortgages of the victims. With this compensation, who is to say it will be used in the way it was intended. We are spending more money to rebuild a country that gave aid to the same people that created this situation. Why? We don't owe them more than we do our own. Because of this money the real victims have been forgotten. They are having a better life, where ever their faith has led them. We should not let these victims fall victim to greed and deceit also. She was prior military (10 years U.S. Navy); she completed her Bachelor?s in 1998 and was contemplating starting her Masters. She had just completed a yearlong mid-level management course the week prior to Sept. 11th. She belonged to Toastmasters. She loved nature, valued friendship and was a terrific photographer. and I were together 17 years and had figured that we could celebrate our golden anniversary together. We co-bought our current house and lovingly rehabbed it to become our home. We co-owned a car, had joint bank and credit card accounts and were the beneficiaries to each other?s wills. We were in all respects, a true and committed partnership. Mr. Attorney General, it makes no difference whether one calls a relationship a marriage (traditional) or a partnership (non-traditional); the coming together of two people, to love and laugh and cry together; to provide constant support and camaraderie for each other, to share the bills and heartache and good fortune together; that is the meaning of a true relationship. That is what and I shared. mother said it best when she stated that had been married twice before (conventional) and it didn?t work; yet it worked for us. I am grateful for every minute of the years we had together. For our partnership. The group which will be advantaged the most are the lawyers, as usual, who are lining up to the trough again. Mr. Zwick, you need to ignore the baloney they offer. While it is disgusting that so many lost their loved ones, it is just not the responsibility of any other person, or the government (except perhaps the CIA) to compensate anyone for their losses. Had these people been killed in automobile accidents, their life insurance or other private insurances would be all that would be received by their survivors. Perhaps. The real kicker was the woman who was disgusted by the 1.5 million she was told she would receive, as it was a laughable amount to her. This kind of reaction sickens me. I gave a whopping amount to the American Red Cross, and am now kind of sorry that I did so, as I suspect it was as ill-used as this fund may very well wind up being. I am OUTRAGED that the partners of gay and lesbian heros who died on 9/11 may not get the same benefits as the partners of straight heroes. This is a governmental declaration that the lives of homosexuals who died due to terrorism are worth less than the lives of heterosexuals. I can't believe that this kind of discrimination is occuring in the year 2002. A united nation simply cannot be such while at the same time excluding a group of their own citizens. Fetuses and illegal aliens will be receiving benefits, and rightfully so because their loved ones were unfairly taken, many while trying to assist others. I know if someone died trying to get me out of a crumbling building, I would be beyond myself with grief and guilt, but add to that their loved ones not being compensated simply due to sexual orientation???? It is unthinkable. Our fallen heroes did the right thing. Our government needs to step up and do the same.
