I don't think that it's fair that we paid for our life insurance and planned for our future and now we're going to be penalized for it. The Special Master is mistaken to rely solely on existing state law regarding marriage. There now exists any number of means by which same-sex couples are able to prove their mutual commitment: wills, powers of attorney, joint ownership of property, civil unions, domestic partnerships, and so forth. Public and private organizations that extend domestic partnership benefits do so on the basis of a showing of shared commitment and mutual support. If organizations can make such a determination, why is it beyond the power of the Special Master? This exclusion will become known as a shameful chapter in the national response to the 9/11 attacks. It's not too late to rectify this jarring breach of the national mood of unity. In order to do this accurately, much more detailed information is required. Necessary information includes: charts including more than 2 children, a list of every collateral offset source that will be deducted, charts showing collateral offset amounts for Social Security, Worker's Comp., etc. Aside from the insultingly low non-economic compensation being offered to the families of "office workers" that became the first casualties in this war, the lack of information being provided to us leaves the impression that in the end, we will be taken advantage of by our own government. Thursday, December 20, 2001 8:59 PM Payment plan for survivors of 09/11 Indeed 09/11 was the most tragic event that has taken place in my lifetime. Lives of generations have been changed forever. I can still vividly see the news pictures. I am very concerned over these payments. I have calculated that if I had died in the WTC my wife and son would have received approximately $1.2 million from this federal fund, the $200,000 I have in life insurance, my savings, $200,000 from my accidental death policy plus whatever comes from our church and charities. In addition to these things, since I would have been at work they would be entitled to workers' compensation payments. So, you are looking at well over $1.5 million not counting specific numbers from charities. Even at current interest rates an investment of this would yield more than my annual income and my family could live off the interest easily. I guess the short end of this is that I feel these payments from the Federal government are excessive. While death is sad, when do you draw the line about making payments like this. I assure you that if my wife or son were to die as the result of a terrorist attack I expect to get the same treatment from my government. That is because this dangerous precedent is being set. I have also asked myself is my government doing this to avoid law suits against the airlines and this is another way to bail them out. I hope not. I suspect, knowing corporate America, that the airlines will do all they can to better themselves because of this tragedy. They will seek out any monies they can get. I only hope that some auditor is comparing their current status to 09/10. With regard to gay/lesbian survivors, the bottom line is that the laws of this land do not provide for payment to those that are not family, spouses or children. That is the bottom line. If you permit this now you will set another dangerous precedent. I am a married man with a child. I am the average American. Gay and lesbian folks are not. Politics aside, no other animal on this planet establishes life long sexual relationships with same sex partners. We were not designed as a species for this. Bottom line, the average American does not believe in supporting homosexuality. As soon as anyone speaks out against it we are trampled by a loud gay/lesbian alleging we are homophobic. This is absurd. In summary, please reconsider the amount of payments as you are spending our tax dollars and do not permit gay/lesbian people to claim survivorship status. Thank you. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. As bad as this attack was, I do not believe that the federal government should be making any payments to the survivors. I say this for the following reasons- â?¢ Up until this time, this type of thing has not been done before. I think that this is a dangerous precedent, one that will be a huge financial load on the American public in the future. â?¢ Americans have responded in a huge way to charitable organizations who have (or are going to) financially helped those people who have been devastated. This is as it should be. My wife and I were glad to contribute and it made me proud of my country to see the fantastic response. However, when people see the federal government pay the huge proposed payments, next time they are going to sit back and say, â??Let the government do it, my little contribution is nothingâ??. â?¢ This program will be abused in a big way. No one should profit from this tragedy, and "double dipping" by relatives of the deceased is wrong. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I find this to be a slap in the face to those who have fought for the freedom and rights of all Americans. This great country of ours in rooted in freedom; freedom of choice. And one of those freedoms is the right to choose who to love. It will be a day of shame for this country if some of our citizens are left behind based soley on who they chose to love.
