As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Tuesday, January 22, 2002 5:22 PM claims My name is and write regarding the proposed interim rules concerning the September 11 Victim Compensation Fund of 2001. I, along with the wife and sister of a victim of September 11 attended a meeting with Kenneth R. Feinberg, Special Master to discuss the proposed rules. Based on that meeting and review of the proposed rules along with concerns voiced by other families of the victims, I have the following comments: 1. There should be no cap on the amount awarded to victims? families. During the meeting with Mr. Feinberg, it was clear that "extraordinary circumstances," as defined under the rules should be interpreted to mean extraordinary economic circumstances and that a person earning in excess of the top compensation listed on the proposed charts of potential awards i.e., more than $231,000 a year would not be capped at an artificial amount of $231,000 per year. The actual amount of the award would take into account the actual amount that the victim was earning on an annual basis and extrapolate that out based on all relevant factors such as life expectancy, number of dependants and other standards typically used in determining a compensatory amount under New York law. 2. There should be no offset for individuals who sacrificed for their families and purchased life insurance. An offset for individuals who purchased life insurance would penalize victims? families who sacrificed for their families? future. This would also result in rewarding victims? families who did not sacrifice and pay premiums in order to safeguard their families? futures. 3. The $350,000 pain and suffering cap should be revised upwards or eliminated. 4. During the meeting with Mr. Feinberg, he expressed that any award would be reduced by what he termed "consumption factors". It was unclear as to what is meant by "consumption factors" and how this would constitute an offset for an award. Obviously, if someone was making more money then it usually follows that they spend more money. However, the spending of money earned should not be an offset against what a person may be entitled to. I would appreciate receiving some response as to what is meant by consumption factors and how these factors may be determined to offset any compensation paid to victims? families. 5. In the proposed rules, it is clear that state law would apply. Under New York law, neither life insurance nor consumption factors reduce compensatory awards. Accordingly, I propose that no such reduction be made in the present case. 6. Mr. Feinberg made it clear at the meeting that awards to victims? families would be made available publicly. However, it is unclear in what form these awards would be made publicly. I suggest that a website be established where awards be published on a timely basis i.e., the day or day after they are awarded. Also suggest that the awards include the facts supporting the award in order that victims? families can review the awards to ensure that all participants are being treated fairly and even handedly. 7. During the meeting, Mr. Feinberg indicated that individuals who provide an employment contract or an affidavit from an employer reflecting evidence of how long a victim would have anticipated on working would be an important element in determining the amount of any compensatory award. I suggest that the rules specifically state that the victims? history including raises and what the victim could reasonably have anticipated on making on an annual basis until retirement age i.e., 65 years old (along with expert testimony or an affidavit) should be sufficient. Many of the victims did not have employment contracts since they worked for brokerage firms which typically do not maintain such contracts. To insist on an employment contract or employer affidavit in order to determine the expected years in which a victim would have worked for his employer would in my view result in an unjust award. I 8. f an individual participates in the fund claim process, would that individual waive any rights to sue Bin Laden and Al Quada? 9. Finally, we suggest that pensions not be deducted from the compensation award. Those are my suggested comments concerning the interim rules. Zwick, Director Office of Management Programs Civil Division U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue NW Washington, DC 20530 Dear Mr. Zwick, Re: "September 11th Victims Compensation Fund of 2001" P.L. 107-42 In the immediate aftermath of the tragic attack of September 11th upon our nation, Congress enacted the above referenced legislation to compensate the relatives of the victims of that brutal attack. As elected representatives of many of those relatives, it is our firm belief that the imterim issued by the Special Master on December 20th fail to satisfy the letter or the spirit of the legislation which we enacted. The legislation authorized payment for economic and non-economic loss. Economic loss was defined as "any pecuniary loss... including the loss of earnings... to the extent recovery for such loss is allowed under applicable State law."(Sec.401(5). Non-economic loss was defined to include among other things "physical and emotional pain, suffering...mental anguish... and loss of consortium."(Sec. 402(5)). The sole offsets to the payment for economic and non-economic loss were the "collateral sources" specified in Sec 402(4). These included "life insurance, pension funds... and payments by Federal State or local government related to the attacks of September 11th. These were clearly intended to be the only offsets. In this proposed rules, however, the Special Master imposed has offsets which are in no way authorized by the statute. Specifically, he imposes arbitrary income limits and restricts pain and suffering awards to 250,000 - no matter what the extent of the pain and suffering may have been. The practical effect of these caps is to drastically reduce the award from what the statute intended. Relatives of the victims who were in the financial services sector or in the public service sector - such as police officers and firefighters - will suffer a particularly adverse effect. This is not only contrary to the legislation but also entirely unfair. The financial services victims were killed precisely because of the jobs they held. They personified American business and commerce. That is why they worked in the World Trade Center and that is why our enemies targeted them. The police and firefighters were killed carrying out the most successful rescue operation in the history of the United States. It is bad enough that these good people were victimized by bin Laden. We cannot allow their relatives to be victimized again. As Mayor Giuliani stated in his farewell address: "We have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and in every other way that we can help and assist their families...There should be no compromise about that ever..." The victims Compensation Fund was created as a part of a comprehensive legislative package which bailed out the airline industry and imposed restrictions on the right of the victims' relatives to recover from the airlines in court. The Fund was established to protect the rights of the victims' relatives. The Special Master cannot take it on himself to restrict those rights. Additionally, at the time the legislation was enacted, the amount of fatalities was expected to be between 6,000 and 10,000. The final number will be less than 3,500. This will result in a significant reduction in the expected expenditures and makes the Special Master's false economies even less defensible. We request therefore that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that each victim's case be addressed separately when computing the non-economic loss attributable to pain and suffering. Justice demands no less. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. Friday, January 18, 2002 8:01 PM Comments on Interim Regulations The interim regulations (28 CFR Part 104) relating to the Victims Compensation Fund (the Fund), in part, do not comport with the enabling statute (Public Law 107-42, Title IV). Specifically, Mr. Feinberg's matrix scheme for determining compensation to applicants of the Fund violates the letter and spirit of the purpose of the Fund, i.e. to provide fair and just compensation to the victims of the horrific events of 9/11 in proportion to their particularized loss, what ever that may prove to be, without limitation. Public Law 107-42, Section 405(b)(1)(B)(ii) of the "Air Transportation Safety and System Stabilization Act" (the Act) provides that the compensation to which a claimant is ENTITLED must be based upon the harm to the claimant, the facts of the claim and the INDIVIDUAL CIRCUMSTANCES of the claimant. The matrix formulated by Mr. Feinberg treats every claimant the same, as to non-economic damages, in a completely arbitrary manner, setting a cap of $250,000 per decedent, plus $50,000 each for certain family members. Such a scheme is a clear violation of the statute, as it ignores the actual harm to a claimant, the particular facts of the claim and utterly fails to account for the individual circumstances of the claimant. Also, the Act provides no authorization for Mr. Feinberg to set caps on these claims. The fact that the Act requires a particularized analysis for each claim and claimant strongly implies that Congress intended no caps. Had caps been intended, Congress would have set forth such caps in the statutes. As to economic damages, Mr. Feinberg's matrix scheme caps annual earnings for any given individual suffering death at approximately $230,000 as a basis for determining loss of expected lifetime earnings and earning capacity. He arbitrarily uses an earnings scale up to the top 98% (approximately $230,000 annual earnings) of the workforce. In using this scale, Mr. Feinberg ignores the individual circumstances attending the economic loss of individuals earning in the top 2% of earners in America. For example, a young 30 year old bond trader at Cantor Fitzgerald earning $2,000,000 annually will be offered a loss based upon the arbitrary assumption that her earnings are not now, nor will ever be, more than $230,000 annually. This is arbitrary, egregiously inadequate and in no way represents fair and just compensation for such a person, as the Act requires. As to the non-economic damages, $250,000 does not reflect fair and just compensation. Hedonic damages alone has been valued by the United States Department of Transportation to be $2,700,000, over 10 times what Mr. Feinberg has set for all non-economic damages, not just hedonic damages. That analysis was made in 1993 and if adjusted for present value would be even more. In conclusion, the Act requires that Mr. Feinberg abandon this cookie-cutter, arbitrary matrix scheme that arbitrarily and inadequately treats every claimant the same for non-economic damages and economic damages of those earning in the top 2% of wage earners. Each survivor rightfully deserves the opportunity to be fairly heard before a hearing officer. The survivors should have the occasion to present evidence through their own testimony and the testimony of expert witness. Each of their cases should be considered on a case-by-case basis. For , being given the right to be heard is a crucial and extremely valuable part of her healing process. We hope you understand this: RIGHT TO APPEAL AND FORM OF PAYMENT Secondly, we would like the survivors to have the right to appeal, but in addition, we believe the payment should be in one lump sum, and be paid out to the beneficiary, consistent with what investment advisors recommend as the best for their individual family circumstances. For example, the survivors should be allowed to request that any payment made to minor children should be in trust. The parent should determine the date of vesting. The trust should not automatically vest at the age of 18, unless the parent determines it is in the best interest of the child to do so. ECONOMIC LOSSES Third, and of paramount importance to the survivors, is the computation of economic losses. We are strongly against any cap being placed on this portion of recovery. Simply put, no one should be penalized because his or her spouse worked long, hard hours and earned a "good salary." We would request an approach like that used in personal injury actions. Retirement should be set at age 68. The decedent's income should be averaged over the past 3 working years. The decedent's age should be subtracted from 68. Those two numbers should be multiplied together, thereby gleaning a starting point for computation. From this base point, other factors such as inflation, wage-increases, merit, likely bonuses and advancement and any other benefits should be considered. NON-ECONOMIC LOSSES Fourth, with regard to non-economic losses, there should be absolutely no cap on this amount. Each person's circumstances must be evaluated individually. Each case should take into account the age of the decedent, marital status of the decedent, ant the amount and age of the decedent's children, the severity of the pain and suffering of each affected individual (both mental and physical), including the person injured or killed, the spouse, the children and the parents. Compensation for non-economic losses is crucial for the survival of some families like the fireman and policeman's. Those families will need a substantial amount of money to be offered in this section to entice them to enter the fund. Likewise, any family who has a considerable amount of coverage in life insurance will need some incentive to enter the fund, since life insurance proceeds will be deducted from any recovery. We certainly hope that any non-economic recovery from this fund would be generous in light of the terrible circumstances of September 11th. COLLATERAL SOURCES Finally, with regard to collateral sources, we are very concerned about their use to offset any amount recovered from the Fund. Life insurance should not be deducted from fund payments. Life insurance is not taxed by the IRS for one reason - it encourages people to plan for their heirs. To deduct any life insurance from fund payments would penalize those who were merely responsible estate planners. The decedents sacrificed and saved hard-earned money to pay for such plans; they are already victims once. Please don't make them victims twice. Morever, pension fund, IRA's and 401k plans should not be deducted from the fund's recovery amount. These plans were responsibly sacrificed for and saved for by husband. They are essentially savings accounts, and they should not be deducted from any recovery from the fund. With regard to charity, Americans across this country donated their hard-earned money as a symbol of their patriotism, and our brotherhood as a nation. To deduct this charity money from any final payment would be wrong. Donations made to family and others like hers were generously and selflessly given to them as a form of healing for both the donor and the receiver. Every single dollar donated as a whole. Please do not denigrate this beautiful symbol of our nation standing together as one. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
