Saturday, January 19, 2002 10:55 PM Comments to Sep 11 Victim Comp Fund January 19, 2002 Dear Mr. Feinberg, Following are my comments regarding the September 11th Victims Compensation Fund of 2001: 1.) Compensation fund deductions should not include life insurance, pensions, Social Security or other death benefit payments. Life insurance, Social Security and workmans compensation were already paid for by the victims and are not part of the general fund. If changes are made to the regulations to remove these deductions, government programs that provide benefits (e.g. Social Security) should be guaranteed to continue. Individuals should not have to fight with their comp carriers or Social Security as to whether they should continue to receive benefits after awards are made. 2.) Compensation levels should be based on 2001 salaries, and not an average of 1998, 1999 and 2000. The 2001 salary level is the basis for future earnings potential. Any averaging over the years prior to 2001 only brings the salary level down and is not an indicator of true earnings potential of the victims. 3.) In cases where there is only one spouse and the victim left no will, the award should be paid to the spouse rather than to the estate of the victim, to be subjected to intestate laws. Although tax free, funds paid to the estate of the victim can be subject to heavy taxation levels if the laws governing the estate require dividing funds between spouse and children, posing an unnecessary tax burden on the victims family. 4.) Formulas used to calculate awards based on salary levels are far too conservative. Total amounts of awards are not adequate to cover what would have been earned during the career of the victim. Even when taking into consideration the presumption of shorter careers in the financial industry, formulas do not take into account later career changes that would have resulted in continued income for a longer period than is covered by the tables . 5.) There should be no maximum compensation level set to $231,000. All awards should be based on higher salaries as appropriate, with no cap on salary. 6.) Non-economic damages should be much higher and should not be subjected to any deductions. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We can ignore one law for illegal, non-tax paying aliens and follow the letter of the law when it comes to legal, tax paying gay and lesbian citizens? Does equal protection under the law mean anything in this country? Gay people died trying to save others and in the end our whole community is spat on by our own Government. Saturday, December 22, 2001 11:02 AM Advance Payment Criteria I was at work in the . My injury was a stroke that occurred the next day as a result of the attack. I was not hospitalized for 24 hours or a week, however, I have not had a paycheck since the 26th of October 2001 due to the poor system that the DOD and Department of Labor has in processing worker's compensation. That is almost two months and they do have the appropriate paperwork. I am out of money. This attack was not my doing and I thought I was in a secure work place. Now I do not know if and when I will ever return to work. My expenses exceed $8,000. per month and I support my husband who is 70 years old and has been disabled under social security for many years. What am I to do if I am not eligible for Advance Payment. I have already received foreclosure notices and FEMA does not know when they can process my claim and if they feel I can be awarded anything. A supported and documented diagnosis was made without the required hospitalization, therefore, for that to be a criteria I feel is inappropriate. My injury is severe, permanent and disabling. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, March 17, 2002 10:58 PM "treat Americans equally" It has come to my attention that the September 11 Victim Compensation Fund, which is to compensate the loved ones of the 9/11 tragedy, is considering compounding the error by neglecting to compensate loved ones of some categories. Or, perhaps it is just one category. Families of illegal aliens will not be deported -- this is positive, even though in violation of the law. Yet families of non-heterosexual heroes and passengers who died, however, are not (under the current plan) to be compensated even while families of presumed heterosexuals will be compensated. Discrimination is un-American. This would be a clear case of discrimination. Do not bow to the forces of homophobia, do not extend discrimination to families of lesbians and gays.
