If the Dept. of Justice can include persons in the distribution of Federal Funds, that are breaking the law and not include persons that are legal citizens but not recognized as "married", I don't live in the country that I have always believed was the most fair and just country in the world. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Dear Mr. Attorney General: I join with my congressional colleagues in applauding the approach you are taking in soliciting wide public comment in fulfilling your legislative mandate to promulgate regulations governing the distribution of funds voted by Congress and approved by the President for victims of the terrorist attacks of September 11. I am writing to urge that in creating the category of those who qualify as "survivors of someone lost in the crashes", (Topic 5, Notice of Inquiry), you consider compensating all of those who suffered both grievous emotional loss from these murders, and significant financial loss as well. That is, I believe that the federal government should provide such compensation as is appropriate to all of those who had a close relationship with the murdered victim and whose own financial position will be seriously adversely affected by the death. Relevant indicia of such a relationship include a shared residence, shared bank accounts for other financial instruments, joint membership in a health plan, a significant sharing of living expenses, etc. Obviously, a wide range of different personal relationships will be covered by this, and I believe that this coverage is wholly appropriate in this instance. Tuesday, December 25, 2001 2:05 PM Compensation for Domestic Partners of 9/11 Victims I am writing to express my support for equal and appropriate compensation to gay and lesbian domestic partners of victims of the September 11th attack. I searched the Department of Justice web site for any indication that such compensation is currently offered, but I could not find any such statements. It must be understood that each and every gay domestic partner who has lost his or her beloved in the despicable attack has suffered exactly the same emotional, financial, and psychological devastation as every legally married spouse in the same circumstances. Since US law prevents these individuals from being legally married, it is both crucial and appropriate for the US government to provide the necessary assistance these individuals so desperately need. Otherwise, the US government is making a dangerous and destructive statement that gay individuals are somehow less worthy of government support in their time of need; that is to say, less American and indeed less human. I would like to affirm that these individuals are every bit as American - and as human - as the other victims of the recent tragedies, and they are every bit as entitled to assistance in their hour of need. But we are not deemed good enough to share in the family Victim and Compensation Fund resulting from 9/11. We are worthy enough to work with firemen and provide last rites, but we are ignored as a community member except in our own community as a deserving hero of that gruesome day. We are co-pilot of one of those planes that was forced by terrorists into a building, killing us and our passengers. And yet we still are ignored. We are heroic enough, and called so by United States Senators and Representatives, when we help thwart terrorist activities on one of the planes, and yet our loved ones and families are ignored when benefits are discussed. We are compassionate enough to raise AIDS and crack babies, and yet not considered able to adopt them when they already are a part of our family. We are human enough to want to live our lives the same as everyone else, wanting to express our love for each other in the right to marry. If we were married, you say, we would receive benefit from the Fund. But then you tell us we can't marry! Indeed, we are loving enough to establish our own families, despite the threats we receive and failure to get the same benefits as everyone else outside of our community. The pain my family has experienced in this tragedy is difficult to communicate. The loss of my husband is devastating. I would exchange all compensation to bring &nbsp&nbsp&nbsp&nbsp back. The interim final rule increases the already intense pain to an even higher level. I ask you to help bring some fairness and balance to our lives. Please give me a reason to participate in the Fund. Please adjust the interim final rule to provide economic and noneconomic amounts at fair, balanced and acceptable levels. Please establish a fair appeal process. Please preserve worker's compensation payments for surviving victims. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. The Interim Final Rule provides little incentive to participate in the Fund because it seriously understates our losses and undervalues the compensation for those losses. Consequently, the Interim Final Rule will defeat the intent of Public Law 107-42. When Congress passed the Air Transportation Safety And System Stabilization Act on September 22, 2001, it severely restricted our right to sue the airlines, which bear responsibility for our loved one's deaths because of lax security procedures. In exchange for denying Family Members this right, they provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit. This includes economic losses, such as lost income, and non-economic losses. Non economic losses described in the law are very broad and inclusive. They are described as losses for: physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium, hedonic damages, injury to reputation, and all other nonpecuniary losses of any kind or nature. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule issued by the Department of Justice (DOJ) falls far short of these stated goals and does not comply with the statute passed by Congress.: a) Under the Interim Final Rule, my family would receive only one-tenth the amount of non-economic losses recovered in other air crash and terrorism cases, which commonly result in awards of between $2 million and $5 million. The Interim Final Rule understates economic losses in two ways: It caps the salaries of high-income victims and underestimates the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the interim final rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. Because the initial award amounts are so low, many families will receive little compensation from the Fund after the collateral payment deductions have been subtracted. There will be little reason to participate. To compound the unfairness, my family would have little real opportunity to appeal the determination of the Fund Master. A family's award may be increased above the "presumptive" award only by showing "extraordinary circumstances" beyond those suffered by other victims or victims' families. This makes the hearing or appeal to the Special Master extremely arbitrary, unclear and unfair. In addition the proposed compensation to the spouses, children and other innocent victims of the attacks is out of balance when compared to the generous compensation to the airlines. Not only did the law cap the airlines' liability at the limits of their insurance (which saves the airlines billions of dollars), but it also provides for direct cash payments and loan guarantees to the airlines totaling $15 billion. The underpayments to the spouses, children and other loved ones suffering from this attack will shift the cost of these airline subsidies and liability limits to the innocent victims of the attacks. Please correct the inequity. Please give me a reason to participate in the Fund. Please adjust the interim final rule to provide economic and noneconomic amounts at fair, balanced and acceptable levels. Please establish a fair appeal process. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. We are still grieving over her loss. It has been more than three months, and I am still living in the horror of the days of September 11th. The vision of her dismembered and partial remains lives on in my nightmares, my tears will not stop. No one can restore her to us, the promise of her life, our future as a family has been destroyed. We will not share her future, see her smile, or laughter, or enjoy the grandchildren that might have been. Her partial remains were found on September 17th, the date of what was suppose to have been her first wedding anniversary. COMMENTS: The formula as I have seen it explained on Television and in reviewing the posted documents on the WWW do not compensate adequately for the pain and suffering and loss sustained by her husband, and the other family members. The goal was to provide a mechanism to seek compensation in a time frame which would be considerably less than the normal litigation route, but should not penalize the next of kin for choosing the shorter route. Or placing the burden on the families to prove what the master had stated himself, that it is impossible to play Solomon. To force the family members to go before a board and request a review of these intangibles, would only defeat the purpose and goal of expediting these claims.. I voice this opinion as a father who is not the next of kin, but has a concern for the well being of my son-in-law, and in having to deal with the eternal loss of our daughter, and his wife, and as a family member who is still quick to tears. And who wishes to state his opinion. ACTION: I respectfully submit that the formula should be changed to allow a more just compensation award. Even illegal aliens are likely to fare better. This is patently wrong.
