Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. January 17, 2001 Dear Mr. Feinberg, My Husband, &nbsp&nbsp&nbsp&nbsp was murdered along with his &nbsp&nbsp&nbsp&nbsp co-workers on the September 11, 2001 terrorist attacks on the World Trade Center. The interim final regulations written by the Dept. of Justice have not followed the intent of the Congress when they passed and the President signed the "September 11 Victim Compensation Fund of 2001" into law as Title IV of Public Law 107-42 ("Air Transportation Safety and System Stabilization Act"). Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims's families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families' total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the regulation, some families would receive nothing from the fund under the interim final regulations. DOJ's formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range on non-economic damages than could be recovered in any single jurisdiction. DOJ's formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent, In a wide variety of air crash and terrorism cases, judges, juries and mediators commonly have provided non-economic damage awards well into the seven-figure range. My children have to go through the rest of their life without the man that was helping to shape them into productive, honest citizens of this country. He's no longer here to laugh and play with them, swim and vacation with them, be their soccer and softball coach. Is their pain only worth $50,000? The method that DOJ used to calculate economic damages has serious flaws also. Using outdated and inapplicable work life and life-cycle earnings data and data that tracks federal worker incomes and doesn't take into consideration the higher paying private sector career paths followed by the vast majority of the victims is just plain wrong. These employees were of above average intelligence and productivity and the calculations should reflect this. These points have been brought to your attention on several occasions by economists, attorneys and &nbsp&nbsp&nbsp&nbsp . These employees are part of the reason why America has enjoyed the Prosperity we do and these calculations should reflect this. I implore you to rewrite these regulations in accordance with the original intent of Congress and the President. Please don't victimize us again. My children and I have suffered so much more than you can ever imagine at the hands of terrorists and a government that didn't full require preventative safety and security measures of our airlines. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Feinberg, Special Master Having sustained long term injuries in the terrorist attack on the U.S. embassy in Beirut on April 18, 1983, I am concerned about the potentially negative impact of certain elements of the September 11th Compensation on some of the victims. I ask that the following changes be considered. 1. Definition of seriously injured: At present a person is required to be in a hospital for ten-day before qualifying as seriously injured. One can be seriously injured and be in the hospital for less than ten days. Loss of the use of any part of the body is serious. A hairline fracture of the spine is serious. Severe depression is serious. A more realistic definition is needed. 2. Classification of emotional stress: Posttraumatic stress is not covered as a medical expense (but as pain & suffering). A great deal of literature now exists on the biological components of PTSD and if not addressed directly as a medical issue, victims may suffer needlessly at the time of the attack and in years to come. The reality of PTSD needs to be named and accepted as a medical condition. 3. Two-year time period: At present claims with the Fund must be filed within two-years after the initial regulations are promulgated. For anyone dealing with severe mental and psychological cal injuries, more time is needed to make such a serious decision. 4. Illegal Aliens: Address the issue of how illegal aliens will benefit from the Fund and assurances that they will not be deported. I commend the legislation and Fund desire to address the question of economic loss based on a prediction of a claimant¹s future earnings. I expect that a realistic amount will be allocated. Clearly everybody suffered incredible loss, but the people at the low end of the economic scale, have lost their ability to move up from poverty to a standard level of living. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. To take the stand "to refer to state law" is a down right cop out and blatant bigotry on the part of those in power over the funds. Had I known that Gay men and Lesbian partners of those who died in the attacks would be excluded (once again) I would have thought twice about giving the donations I have given and would have encouraged an organization like HRC (Human Rights Campaign) to start a Gay partner fund. Friday, February 08, 2002 12:38 PM Disbelief To whom it may concern: After listening to comments about the compensation program, I am saddened to hear and read about victims who are upset by the outcome of the program. If, as happens everyday, a spouse or parent had been lost under many other very dreadful and horrific situations (fire, murder, DWI wreck, earthquake, etc.), the family may or may not receive any compensation. Are these "everyday" victims less important, are the ramifications to their families less devastating, are their needs less? I would venture to guess the vast majority of families who lose their caregiver would not receive $1.6 million. If families were well prepared, good for them for being farsighted to provide for their loved ones in case of an "everyday" death. I applaud the government for reaching out to these families, however, I feel it should be viewed as a privilege, not a right, to receive such compensation. Since no such distinction is being made with illegal aliens whose residential legitimacy goes against the law of their home states, it can only be concluded that this decision is a case of selective discrimination directed against gays.
