Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Nevertheless, under the laws of the State of New York, will not have a right to receive any portion of her fianc's estate, and, under the interim regulations of the Victim Compensation Fund, because distributions must be made "in a manner consistent with the law of the decedent's domicile", she will not have a right to any portion of the benefits from the program. I respectfully submit that this result is neither equitable nor morally correct. As you are no doubt aware, the plight of the nearly wed was movingly exposed in an article printed on the front page of today's The New York Times. While the Special Master has the authority to "appropriately compensate the victim's spouse, children or other relatives" regardless of state law, a fiancee of a victim, who is not related by law, has no such discretionary right. In addition, there is no procedure under the regulations to ensure that the fianc or fiancee's claim will be heard. It seems inconsistent with the intent of Congress that the person who was perhaps the closest to the victim should be denied all right to compensation. Accordingly, I respectfully request, on behalf of , that you revise the regulations to provide that, (i) upon proof of an impending marriage, a fianc or fiancee of a victim will have a right, discretionary or otherwise, to receive a portion of the benefits awarded from the Victim Compensation Fund as a result of the victim's death, and (ii) a procedure be established to allow a person who would not otherwise take under state law, but who has a colorable right, such as a fianc or fiancee, to present a claim for a share of such benefits. I am ashamed that my government would see fit to so openly discriminate against Gays and Lesbians, people who were equally devastated by the events of September 11. I rejoice over the new found freedoms of the women of Afghanistan, but wonder how we can call other governments discriminatory when we won't even acknowledge such a large, politically active, community-oriented group in our own country. Is there something that tells you that gays and lesbians grieve less, sacrifice less, or in any way are less affected than other U.S. Citizens by these events? How can you in good conscience say that you will forgive immigration violations to compensate illegal immigrants, yet ignore and marginalize a group of citizens who were legally employed? How can you look into the faces of the loved ones of those who died - people who loved and cared for the victims as much as any spouse - and tell them that they don't count simply because of their sexual orientation? I think the obvious answer is that you decline to look at them at all. For that you should be ashamed, especially to wrap your discrimination in the cloak of warding off lawsuits, an incredibly specious arguement and one not worthy of consideration. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. Thursday, January 17, 2002 10:26 AM victims' compentsation fund My 31 year old husband was killed in the World Trade Center on September 11th and I am writing to express my extreme dissatisfaction and disappointment with the compensation fund's regulations as currently set forth. To begin with, there should at least be a minimum award given to every victim's family, regardless of what other collateral assets they have. It is absurd that a victim's life insurance is being deducted from the award for many reasons--if we were to sue in court, this would not happen, and this fund is supposed to be a viable alternative to suing; life insurance is an investment like many others, why is this one being singled out as one to "count" against the award; why are families being punished for being responsible? The families hit the hardest by this decision are those that have children, since these are the people that generally have life insurance, and these are the families that need the money most (though the fund was never intended to be need based--it was supposed to compensate families for economic loss). My husband didn't have life insurance and so this doesn't affect me personally, but I am very concerned about the many people I know who will be in a horrible situation if the current regulations aren't changed. However, it is clear that the deduction of life insurance is not likely to be taken out of the staute. So at the very least, a minimum award should be set forth so that every family receives some compensation. Secondly, it is bad enough that life insurance is going to be deducted from the award--but no other voluntary contributions should be deducted. My husband was an employee at &nbsp&nbsp&nbsp&nbsp . The surviving partners have decided to donate 25% of the company's profits out of concern for their former co-workers' families. It is absurd if this money is then deducted from the families' awards. Why should the &nbsp&nbsp&nbsp&nbsp partners be giving money to the government when they made a private decision to give it to the families? And lastly, the earnings chart as set forth by the currrent regulations are ludicrous. Why is Mr. Feinberg using national economic statistics rather than New York statisitics to cap the earning potential of our loved ones (though Mr. Feinberg told a room full of &nbsp&nbsp&nbsp&nbsp families that there would be no cap). It makes no sense that salaries are capped at the 98th percentile--to all of us it is very clear that the government is simply trying to give us as little money as possible. But if the 98th percentile is going to be selected, it should at least be the 98th percentile of salaries from New York City. Our loved ones were targeted because they were successful, high wage earners who worked in the World Trade Center. It is therefore completely unfair to talk about national averages. In response to this issue, we are told that once we sign up for the fund, we can "plead our case" as to why we deserve more money. But none of us should have to sign up for the fund and waive our right to sue without having a much clearer idea of the type of award we can expect to receive. Therefore, the earning chart should go well above $231,000. In the statute, it clearly says that families will be compensated for economic loss. There is one very straightforward to calculate this loss--to mulitply their projected earnings and the projected amount of years they would have worked until retirement. This statute was passed because the government failed to protect our loved ones while they were at work. Of course, it was also passed as a bail-out to the airline and insurance companies. At the present moment, the latter is all that this bill seems to focus on. Our right to sue has been crippled and we are being asked to accept these unfair regulations. Given everything we have gone through, are still going through, and will continue to go through for years to come, the least that can be done is to adjust these regulations so that we can be more adequately compensated for economic and non-economic loss. The latter of which we can never really be compensated for--our loved ones are dead and our lives are changed forever.
