Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, March 12, 2002 10:19 AM This past weekend I saw the epsiode of Meet The Press that informed the people of the United States the horrifying news that loyal taxpaying AMERICANS and their heirs will not receive benefits for their suffering in the September 11th disaster because they happen to be gay. I wonder what Vice President Cheney feels about this, if his daughter had been in harms way, and god forbid had died, after a life of putting into the system, the partner she chose to liver her life with would not be receiving the widows benefits. This is clear discrimination. What have we worked for in our society? Did anyone at the Justice Dept. listen to the words of Dr. Martin Luther King? Please take a moment to re-read the "I Have A Dream Speech" and take a good look at our society today; at many points one can easily replace the word Negro with Homosexual. Department of Justice Dear Mr. Zwick, I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. The Red Cross has worked closely with groups in New York City and have implemented a similar policy in compensating gay and lesbians and their families. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Monday, March 18, 2002 12:24 PM A distressed query I am distressed that, according to Kenneth Feinberg in his appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," illegal aliens will be compensated for their losses incurred during the violence on 911, but gay men and lesbians cannot be unless their domestic situation has been recognized by their state's laws. Illegal aliens have actively VIOLATED our laws, yet compensation will be granted to them --with promises moreover that once they come forward to claim it, there will be no recrimination or retribution of any kind. There is of course NO STATE LAW ANYWHERE that condones the violation of the immigration laws of the nation. Why are State laws being "honored" in one instance, and being considered unimportant in the other? Unless they have criminal records, the gay men and lesbians who died on September 11 were law-abiding citizens, and the same goes for their partners and family members. The absence of state laws santioning their life choices is simply a consequence of long-standing and indefensible prejudice. I am offended that the 911 Fund intends to compensate those who broke the law while penalizing those who abided by it. The prejudice inherent in this announced practice is un-American to say the least. It dishonors the fallen and does inexcusable harm to those they left behind. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. The framers did not give equal rights to all - women and slaves were considered second-class citizens at the time - but there was nothing to limit the rights of gay Americans. Wednesday, December 26, 2001 9:39 PM Comments on Interim Final Rule Just some quick thoughts on the compensation amounts as estimated in the tables. I think they are too high! These comments only pertain to compensation related to deceased victims - not disabled victims. I think the flat non-economic number is adequate ($250K per victim, plus extra $50K per spouse and each dependent). I assume all biological children will be considered as dependents (for example, if victim was single and had 2 biological children, filed taxes, but the kids weren't claimed as dependents, each of the kids would still get $50K). Economic: For single deceased victims, the default should be that there is zero economic loss. I am a 44 years old, single (widow), no kids, have worked for 20 years, and there would be no economic loss to my parents/sister/anyone if I dropped dead. They would inherit my estate (house, IRAs, personal property, etc.), and would no longer get presents at Christmas/etc., but would not "lose" anything because I was no longer around collecting a paycheck. This is also true for these deceased victims. The ONLY economic compensation pertaining to singles should be a) Child support the deceased was legally required to pay (as ordered by a court or other legally binding document). This payment would be made/adjusted/discontinued just as the child support payment would have been - no special considerations. There may be other situations other than child support that the deceased was legally required to pay, and they could follow their respective court orders/legal documents (like alimony, or if the deceased maimed someone, whatever). b) Dependents the deceased victim supported but was NOT legally obligated to support - for example, they might have been providing support for an elderly parent, a niece/nephew, an orphaned child. In this type of case I would use the tax filings (where the dependent was claimed) and supporting documentation to show how much the dependent was receiving. These should be considered on a case-by-case basis and a reasonable determination made (yes - we will continue to support the orphaned child or elderly parent; yes-and-no - we will continue to support your freeloader buddy only for 2 years). These economic losses should only be paid if they are not already taken care of in the deceased's will/estate (there may already be a trust or something set up). So the economic portion could potentially go back down to zero. The sum of any non-economic plus economic would still be subject to reduction based on 'other source compensation'. For married deceased victims, I would use the same non-economic numbers as above ($250K + $50K per spouse/dependent). Economic: For dependents, I would use the same approach as I outlined above, the difference being that instead of using a legally ordered child support amount you would use a consumption factor based on the salary. This would continue until a time similar to that for child support (graduates high school or college complete (if attending) or whatever). Other dependents could be handled as described above. This would be similar to that expected in a divorce settlement, which frankly a lot of marriages would probably hit anyway (lets be realistic here!). The economic portion for the surviving spouse SHOULD NOT assume they will never have to work or cannot be expected to support themselves. They will have access to the support provided for children/dependents, so it is only their support that is at issue. I would give them 4 years of the lost paycheck (no real need for projections or inflation adjustments, etc.). That gives them enough time to 'grieve' and figure out how they are going to support themselves. It also insures that kids are in or getting close to school age. These economic portions (dependents and spouse) would only be paid if not already taken care of by the deceased's will/estate. Same as above. And, like for singles, this non-economic plus economic sum would still be subject to reduction based on 'other source compensation'. If this seems like 'it is not enough', consider all of those surviving 'whatevers' who get NO SPECIAL CONSIDERATION! The survivors of these deceased victims should be grateful for anything they receive from the tax-payers resources. Lets not forget all of the charity money, also from fellow human beings, that they are already receiving. It is time for them to start breaking out of denial - they are not "special", they are just a group of survivors-in-common that are getting a lot of free press coverage! Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
