Sunday, March 17, 2002 11:14 AM Inequity To Whom it May Concern:   It is reassuring to know that as an American, our nation has assumed responsibility for its citizens during a time when such acts of responsibility are most needed.  The 9/11 Fund demonstrates great generosity to surviving family members of the September 11 attacks, and sends an equally resounding message to the world that the United States will not allow gutless terrorists tear the fabric of our nation.   Unfortunately, this is not the only resounding message the 9/11 Fund sends to both Americans and peoples all over the world.  It indicates to all of us that some citizens - gay and lesbian citizens - are valued less than everyone else.  The 9/11 Fund sanctions discrimination against an entire segment of American society.  It is now well known that the Attorney General has bent the law to allow undocumented aliens to receive compensation while his own countrymen - for no reason other than their sexual orientation - are denied equal treatment.   This position is abhorrent.  The message of the Fund is that Americans take care of their own.  Unless changes are made quickly, the lasting legacy will be that the Fund turned back the clock on progress, openness, and compassion - just the themes that Mohammed Atta and his band of terrorists aimed to derail.   I urge you to amend the guidelines of the 9/11 Fund to include surviving partners of same-sex marriage.  Thank you very much for your re-consideration of this important issue. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. We had loving relationship and were to be married October of 2001. Our plans with my son and our fianc were destroyed. We also bough a home together two years ago which I am in jeopardy of losing now. The victims compensation Fund, which has been set up with Federal funds, was to provide compensation to all the victims families. It is not clear how the fiancees and domestic partners of New Jersey should be treated. From what I have been told, we will get nothing. We should be treated equally as family members and spouse, sine the intent was to help all of us according to the senators and congress persons with whom I have spoken. I am struggling hard to find any hope in the future for my son and I. We had a beautiful life planned and we had already established ourselves as a family. monies were 70% of our income and although my son and I were the only ones he supported his parents will receive these funds. There are a couple of hundred fiancees and domestic partners that were directly effected not only economically, but also the loss of companionship and domestic services which was supposed to be the intent of the Congressional legislation. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The task was huge, and your attention and excellent work remarkable. While late in the game, I felt compelled to offer an expanded idea to further assist the victims of September 11th. It is attached. Pardon my presumption, but I feel so strongly about the fact that most lump sum recipients have no ability to manage their awards. The data suggests that over 90% dissipate their awards in five years or less. What happens is that they dissipate it, or squander it on dubious investments, or, worse yet, have it squandered by influence peddlers in or out of their families. This is especially true for dependant children. There is a better way, one based on sound thinking, spendthrift protection and expanded, extended benefits. By now, many of the needs mentioned in the attached paper, such as claimant input documents, already exist. While it may be too late to include this in a broader sense, I strongly suggest that claimants be given the option of structured settlements (periodic payments). Given the likely extended process, implementing structures as an option is feasible. Many are meditating on September 11 at the close of 2001, as I am. Therefore, I offer this modest proposal. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
