December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. It is very kind of the government to come up with the regulations to compensate the victims' family as a result of the September 11, 2001 terrorist attack. The regulations allow non-economic damages that are approximately one-tenth the level normally paid in other plane crash and terrorism cases. The non-economical award of $250,000 is an insult when one considers the economic support given to the airlines industry. The law also requires deduction of "collateral sources" including life insurance and pension plans. The awards allowed after these deductions will be unreasonable. We have already lost our loved ones and now we are only compensated with such limited funds from the federal specially after the life insurance offset. People thought the federal government is compensating so much money however the truth is, after taken away the life insurance which we paid the premium so to prepare for the unexpected incidence, not too much will be left for the victims' family. This is like to punish those who care about their family members and prepare for the unexpected incidence. The magnitude of the 9-11 terrorist attack was way beyond everybodys preparation. Please reconsider the rules about the collateral sources by excluding the life insurance and pension as well as the non-economic awards. I have been reading all of the regulalations and it seems to me that fiancees are not being recognized at all in this matter. In there are alone 38 fiancees. I feel that this is extremely unfair. We were the ones that these men chose to spend the rest of their lives with. In my particular situation, and I moved to a new apartment that is double the rent I was paying before we moved in. I must explain to you that I am not writing to you to ask that I become rich in this whole ordeal. I would like to pay my rent, perhaps go back to school and rebuild my future. I was the one that shared his dreams with. I met when I was 12 years old and I was the one he kissed good night every night and said "sweet dreams" to. Doesn't that account for anything? In the regulations it is stated that one person per family submit a claim form.However, for each family that had fiancess, you are really talking about two families, not one. had his mother and in no way would I ever want to take away from her. I love her. She has always been like a second mother to me. I will never go to court to fight her on this. That would be like taking name and spitting on it. I just don't understand how we are not being recognized in this. All of us young women need to rebuild our lives. Out entire future has been robbed from us. Please make this a just situation. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Wednesday, December 05, 2001 1:19 PM Victim Benefits for Sept 11 Tragedy Dear Mr. Zwick, I am writing in response to the Department of Justice's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non- biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved one. The following comments Reflect our dissatisfaction with the Fund as it stands in January, 2002 and the hope that our thoughts would be incorporated into the final proposal. a. Including pensions of the deceased victims as "collateral sources" against settlement offered would leave most civil servants' families with little or no wrongful death compensation. Civil servants are typically on lower wage scales than those in private industry, but take pride in fulfilling vital services to their communities. As part of their overall compensation packages, they work for their pensions during their active duty so that they can rest assured they and/or their families will be adequately provided for when their active duty ends. As families/friends of civil servants we view the inclusion of pension benefits as collateral sources as clear discrimination against blue-collar workers. b. Including life insurance policies as "collateral sources" discriminates against those who thoughtfully and responsively provided for their families. c. Valuing the lives of our loved ones on a demographic chart is an insult to the dead. All human lives are precious and none are worth more than others, no matter how long the deceased lived or what his/her arbitrary determined "earnings potential" was. d. Capping emotional pain and suffering at $250,000 is ridiculously low articularly in comparison to court-determined awards in similar cases. We are not seeking funds to replace the lives of our loved ones. We instead wish the federal government and the airlines to admit their careless roles in the wrongful death of Americans. We note that our U.S. constitution has been violated in numerous ways, most importantly by the fact that our Congress passed a law reducing the airlines' liabilities after (ex post facto) the events of September 11, 2001, thus limiting our potential to gain suitable settlements in traditional court proceedings. Further, we are discouraged to know that an unelected and unaccountable official will determine our compensation. We note that Mr. Feinberg has unsuitable historical record in similar proceedings such as the "Agent Orange" cases in which he neglected to fairly compensate Vietnam War Veterans. In this horrible time of grief and despair, our government has further victimized our families by infringing upon our civil rights. The government and media point to charity to compensate our families, yet fail to realize that such "awards" are often unequitable, poorly administered, and were not intended to take the place of negligent punitive damages. We understand the long, uphill battle involved in changing a law and do not shy away from it. However, such proceedings would cause additional and prolonged pain to our traumatized families. Tuesday, March 12, 2002 12:58 PM I am appalled! I am appalled to hear that gay people are being discriminated against in the sharing of the victim benefits of loved ones who died on September 11th. This is totally unacceptable. There were many gay heroes among those who died including and their partners deserve to be treated equally with everyone else. It is bad enough that the fund is not really distributing it equally even among other victims...and of course we know that some of the families of illegal aliens who died who cleaned the towers for those who worked there will probably get nothing. If there is going to be compensation... it should be fair and equitable. Stop playing games...it only proves to be divicive in the end! Tuesday, January 22, 2002 11:09 AM Victims Compensation Comments While I agree the nation and in particular the people in Manhattan suffered a great tragedy on September 11th: I do not feel the US Government needs to play insurance carrier in this or other incidents. By doing so, the Government seems to be claiming liability for the incident. The threashold for declaring any incident a federal emergency is getting pushed lower and lower: why should citizens buy insurance when in a great deal of cases FEMA or congress is going to come running in with a basket of cash. Congress, in a clear attempt to simply get re-elected and remain in their jobs, passed a law that sets a very terrible precident. This also seems to tell victims of previous incidents that they weren't quite as important and the people of Manhattan. And future victims will expect ever greater levels of compensation. These compensation levels, along with the money FEMA (and other non-government agencies) is throwing at the victims has gone way overboard. And what are the surviors doing: complaining that what the governement is offering is "a disgrace". Why should the government make ANY of the surviors millionaires? I have absolutly no FINACIAL sympathy for a person who was making $500,000 a year and didn't have proper insurance coverage to take care of his/her family. And yet that is what many of the surviors want: all their insurance money AND the millions the compensation fund can provide. I can only hope (and I really hold out LITTLE hope) that Congress and the President can learn from this MISTAKE and pull back from this cycle of declaring almost everything a national disaster and therefore being SO willing to throw tax payer money AT people.
