Monday, January 21, 2002 9:08 AM "I am writing on behalf of parents of a World Trade Center victim who are being grossly shortchanged on both the economic and the non-economic parts of the Victim?s Compensation Fund, as well as other aspects of the regulations. 1) The economic part is grossly unfair because the Fund is basing it on the victim's salary in the last three years. The victim had a low salary, but was young and was a college graduate. How can they know how much he was going to earn in the future based on what he made in the past? How can they decide that his life was worth less than that of other people? There should be equality in the awards. 2) The non-economic award is also grossly unfair because we know the victim suffered tremendous pain for a very long time. He was last seen on the Floor, Tower Two, going back to do work, and called his mother at home saying that he was okay and had to work. We know the victim was trapped for a long time, and Special Master Feinburg still insists that the pain and suffering award is fair, when what he wants to give is one-tenth the amount under similar circumstances of terrorist attacks. 3) It is also unfair that the fund categorizes ?dependents? as only spouse and children. The victim was his parents' only son and according to Asian tradition responsible for his parents even though he did not claim them as dependents on his tax return. As with many immigrant families, he lived with and supported his retired parents and was their primary caregiver and constant companion. When his mother fell down the stairs and broke her shoulder three years ago he even bathed her. Besides dealing with their grief and struggling to survive every day without him, his parents are faced with a system which does not recognize them. 4) In addition, there should be no collateral payment deductions of any kind from the award. That would make the fund highly unfair. 5) Also, it is absolutely wrong that the victim?s family must sign away their rights upon filing as claimants when they do not know what their award will be. There should be a fair hearing of each victim?s family, because individual circumstances are different. The victim was a true American who got up early on September 11 to vote in the primary election before going to work. He believed in his country and he died for his country. He deserves much better than what the Fund is offering. Thank you for taking this into consideration. This victim compensation is an attachment to the AIR TRANSPORTATION SAFETY AND SYSTEM STABILIZATION ACT." There is no indication that the action of terrorists were directly related to lax security or breech of any law or regulation. This is a generous perk to families who have suffered from their loved one being a victim of a tragic event. People are tragically killed every day whether it be in the workplace, public transportation or act of war or terrorism. That's life and the result of being in the wrong place at the wrong time. And how everyone reacted around me. I was in second grade, and even though I could not quit comprehend the enormousity of the situation, it was the first time I saw my mother cry. And like that horrible day, September 11, 2001, will be forever etched in my mind. As a nation, we are all victims. As an indivigual, I am a victim. I waited for hours for news of a relative, thankfully he was physically unhurt. I waited for days, for news of friends in New York, thankfully everyone I cared about was physically unhurt. I waited for hours to get through to my partner in Alexandria, who was only miles away from the Pentegon, thankfully, she was physically unhurt. I do, however, know of someone who lost someone, so as you can see, we are all victims. I am blessed that on such a horrific day, I did not lose anyone that I know. However, there are so many that did lose someone, that I write to you today, asking you to help remember ALL victims of September 11th. I am not speaking of the fathers or mothers or children who we all clearly send out our hearts to in recognition of their pain we clearly see. I am not speaking of the police, firemen, nor any of the rescue personnel who so gallently gave up their lives in the hope of saving just one person. I am speaking of the victim, who, because of society's "glare," may not step forward. I am speaking of the man or woman, whose partners did not return from work that day. The unmarried homosexual, who's lives were so profoundly affected that day. I am speaking of the child, who's mother or father's partner did not return home that day, as they did so happily just the day before. Everyone who was emotionally affected that day needs our help, EVERYONE. I am asking the Justice Department to include among relatives eligible for compensation those who lost their life partners as well as de facto parents or children, without regard to sexual orientation or marital status. I am asking the United States Government to follow the example already set by New York Governor Pataki in granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserves help in this time of need. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As far as pain and suffering go, I cannot expect you or anyone else not affected, to understand what we have been going through. I think we are all in agreement that the tragedy that occurred that day was unprecented for our country. Moreover, the individual grieving has been similarly unprecedented. How do I explain to my daughter why I am putting Daddy's toothbrush and unwashed underwear in a bag as she catches me doing it? What about the waiting and wondering to see if the body is ever recovered? Or having to endure seeing the death of your loved one happen time and again on TV and in print. To know that called and told me he was leaving the building (at 8:46am) and then found out from his sister that he was remaining because he was told not to evacuate is unbearable. I had to speak with someone related to the medical examiner's office regarding my reporting that he had scars from knee injuries. I was asked to find out from the physician what types of screws were used because "they had found some bones with screws attached". I realize the gentleman was only trying to help but this is what we are faced with. Need I say more about the tremendous pain and suffering we are all enduring. Please reconsider the number put on this..... I am also curious to know how the cost of health insurance will be calculated into the award. Right now I see no provision. As of April 1st, my girls and I will be on COBRA at the cost of $1,000/month! Initially there is a plan by Blue Cross to make these payments but the money will surely not last long at these rates. Since the WTC's victims are not considered a "group" for insurance purposes, the inclusion of lost health coverage should surely be added to the award. I don't believe this factor has been considered. Speaking specifically, my husband was making a good salary UNTIL 3 years ago when he changed careers. He worked hard, paid his dues and was back "on top" again. He had just recently signed a 2-yr contract for a substantial increase. The last 3 years represented a change-in-career decrease in income and I don't believe should affect his award. How will something like this be treated? I have to ask now since once I accept into the Fund, it's too late to ask. Lastly, please make it clear to the public that the numbers portrayed in the charts are just that. After calculating Social Security and Workmens' comp alone for the next decades, for most people these numbers are not representative of what people will actually receive. While I myself am grateful that there is a fund, I also believe the American people should not be told that the average award will be $1.6 billion when I know many people who expect to get virtually nothing. We are victims once, do not make us victims again by making us look like we want to be millionaires and "profit" from our loss. Tuesday, March 19, 2002 12:19 PM Equal benefits to all survivors I am in support of the distribution of benefits to ALL people who are survivors of the 9/11 tragedies. It has come to my attention that the partners of gays, including the rugby player &nbsp , who has been proclaimed as a national hero, will not receive compensation unless their state law requires it. That is deplorable! The partners of gays and lesbians have lost a loved one - no mattor how their sexuality may be portrayed or judged. In many cases, have lost half of their livelihood as well. I stand for equality for everyone involved. Don't make the mistake of judging others when it is by the judgment of our nation that this tragedy occurred in the first place! I know that Love prevails in every situation. I expect no less from our government. We are both living on our own. My question is why has our stepfather received all the benefits of every fund out there and my and sister and I have not received anything? We are her blood related daughters, isn't there any compensation for our pain and suffering? I myself work on Wall Street, and I was outside on Wall Street when my mothers tower (2 WTC) started to come down. I am now out on disability due the stress of that day. No one can put a price tag on the life of a loved one. You are charged with the difficult task of doing just that in your honorable work of trying to compensate the victims and families of the vicitms of the September 11, 2001 tragedy. I urge you to create a system that allows all victims to have compensation that is unrelated to their salary. The man or woman who was the sole support for a family and worked as custodian or dishwasher should be compensated equally with those who worked as stockbrokers. I know that this will be a difficult task, but I do suggest that you take at least 75% of the money and distribute it equally. The remaining 25% could be distributed based on prior income. I do realize that some people affected have higher bills to pay and a more expensive lifestyle to keep up. By doing the distribution in this way, you try to walk a fine line between equal distribution and distribution based on prior income. Thursday, March 14, 2002 3:46 PM I have just recently been made aware of the fact that monies donated to help the families of the 9-11 victims is being withheld from the gay partners of these victims, and heroes. I hope that I have heard wrong. I cannot believe that our United Country is going to divide itself in such a way.
