Since fetuses, under the law, have no clear status as human persons, this decision sends a message that gay people have even less status than fetuses. In other words, the United States government feels it can decide whose lives are not worth bothering with, i.e. "subhuman." The problem with this message is that it eventually backfires on a nation, leading to widespread and shameful crimes against certain groups of people. Today, it is we gay people who are being officially devalued and declared "subhuman" by the Justice Department. Tomorrow other groups will be declared "subhuman" as well. It's a slippery slope that the United States government ventures onto at its peril. As someone of native American descent, I must remind you that, just a century and a half ago, native American tribes were officially viewed as subhuman, not worth any human-rights consideration, by the U.S. government, who carried on a war of extermination against the tribes, even against native women and children, with the official policy that "nits make lice". This policy led to shocking atrocities and other types of crimes against native peoples during the 1800s and well into the 1900s. Ditto African-Americans, Chinese, Jews and other ethnic and religious groups, who were similarly denied all kinds of personhood rights under U.S. law. The historical "nonperson" list is long -- it included women, people who were mentally ill, and others. Spare us your excuses that you must consider the limits of state law. Any intelligent person can see that the U.S. government takes this position on the 9/11 fund because of political pressures from the religious right, who want gay people to be denied any legal status as persons. Paradoxically, it is also the religious right who demand that fetuses be given full status as persons, so they can push ahead with their agenda of denying reproductive choice to all U.S. women. I think it's pathetic and shameful that you, and the Justice Department, would toady to the religious right in this way. It's doubly pathetic and shameful because your department supposedly exists to protect "justice" in America. I hope you will have the courage to rethink your policy -- to resist these political pressures, and grant gay victims of 9/11 the personhood of benefits, equal to all others who receive them. The presumptive award as stated by the regulations narrows down to a concept of signing a contract without receiving adequate and accurate information beforehand it accounts to an uninformed consent. It seems to us that families of the victims of September 11, 2001 terrorist attacks were not only robbed of their love one's lives, but now your regulations are robbing our rights. Criminals, robbers and others belonging to obscure business have Miranda Rights, right to free counsel, and unrestricted right to sue when done wrong. Healthcare patients have Bill of Rights, informed consent, and other protections such as unrestricted right to sue when done wrong. Where are we cataloged 2. Your regulations lack consistency with the rule of law. You treat us different from anyone else. These regulations are clearly inconsistent and contrary to the statutes for compensating victims' families. 3. Our Government failed to protect its citizens at home. The responsibility for this massive failure not only includes the airline industry, but the FAA, FBI, CIA Port Authority of New York/Fire Department for failing to have adequate evacuation plans to rescue workers in the upper floors in extreme cases of emergency and/or fire. Many families received calls from their love ones (who worked at 1 WTC 101st floor and higher, or 2 WTC), these workers were alive and well after the first plane hit Tower One and were trying to find exits. The obstacle was that the stairs were blocked, and these unwilling victims were unable to safely reach their way out. Notwithstanding these facts, (that failed t protect our families in the first place) has placed restrictions/limitations on our ability to sue when done wrong. 4. Congress and President Bush intended to compensate families for the harm done to each family (economic and non-economic damages). The deceased's families are entitled to receive full and fair compensation for pain and suffering, loss of companionship, loss of benefit to have the victims live their life to the fullest. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Money can only serve to hopefully replace the income lost or provide some other non emotional needs for the material things. It seems that the notion that lots of money will soothe my pain and make someone else pay, is a popular thought, however it is erroneous! We can only look to our Maker and ask for healing direction for the new course set before us, and the strength to go on that way. I do not think we should provide money for the "victims" to sue. I don't think there should be double dipping into the government and the charities, unless there is not enough money to provide for the true needs. Many people gave very generously to the charity programs, and I for one want to know that that money was used, all of it, for its intended purpose. I would be most unhappy to find that my generosity was taken advantage of, or squandered on lawyers. I have seen enough greed.
