Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, January 13, 2002 1:59 PM September 11th Vicitims Compensation Fund To our elected officials: We support the position of Governor Pataki that charitable contributions should NOT decrease the amounts awarded to families of victims of September 11th, many of whom are friends and neighbors of ours in this Manhasset, New York community. We also support the position that (i) appropriate compensation be awarded to our friends and neighbors and all other families of the victims of September 11th for the future wages lost by the victims so as to support those families economically and (ii) appropriate compensation be awarded for the extraordinary pain and suffering that these families have and will continue to endure over many, many years. A number of my constituents lost family members in the attacks of September 11th. As we all know, no amount of money can truly compensate for these losses. However, the Federal Government, in Title IV of Public Law 107-42, has sought to establish a system by which reasonable payments can be made both to provide survivors with quick relief and to avoid lengthy, costly, and potentially unsuccessful litigation against the airlines, among others. However, the system proposed in the interim final rule, particularly when applied to victims who were both low-wage-earners and older than many of the World Trade Center victims, as is the case for constituents of mine, does not appear to adequately address the magnitude of their pain and suffering or their economic losses. I would urge amendments either to raise the "cap" on compensation for pain and suffering to a substantially higher dollar amount or to give the Special Master flexibility to fully consider the individual cases of claimants, and to adjust the formula for compensation for economic losses to increase the amounts for survivors of older and low-income victims, who are surely the most vulnerable of all the survivors of the catastrophe of September 11 th. The Federal Government, in Title IV of Public Law 107-42, has sought to establish a system by which reasonable payments can be made both to provide victims with quick relief and to avoid lengthy, costly, and potentially unsuccessful litigation against the airlines, among others. However, I am informed by affected individuals that the interim final rule defines "physical harm" in a way that effectively denies compensation to persons who were injured, sometimes severely, in the attacks but who were unable to seek medical treatment within 24 hours. A number of New Yorkers were seriously injured in the attacks on the World Trade Center but for various reasons, ranging from lack of care for very upset children, to lack of regular medical providers, to the severe emotional toll of experiencing the attacks in person, were unable to seek and receive treatment until the 24 hour period specified in the rule had passed. I would urge that the rule be amended to provide compensation for expenses of medical care without regard to when an injured victim sought treatment. At the very least, the Special Master should be given the flexibility to consider the individual circumstances of persons injured but not seeking treatment within 24 hours. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I strongly urge the Department to draft regulations that ensure compensation is available to ALL victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims or any victims. The idea is to provide relief to our citizens whose families (all families) have suffered with their lives for their country. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Saturday, March 16, 2002 5:49 PM September 11th I read with great dismay that the survivors of the gay and lesbian heroes from the Sept. 11th terrorist attacks will not necessarily be in line to receive compensation from the fund set up to help survivors of these infamous acts. I find it unacceptable that some survivors will receive benefits because of the state laws that pertain to those heroes but that others will not be acknowledged through this compensation because of the lack of non-discrimin- ation laws in other states. Further, I find it appalling that fetuses will be granted full and unquestionable compensation while living and breathing survivors of gay and lesbian hero victims will not. Since the taxpayers are not at fault, the logic of damages and tort law don't apply. This is compassion, not atonement for guilt. Furthermore, since Mr. Feinberg asserts that this fund provides only a floor to prevent hardship, why are victims' families provided varying compensation for economic damages? All deaths should be compensated equally. A janitor's family should get the same as a CEO. My compassion is becoming thin and maybe the whole program should be stopped.
