Monday, March 18, 2002 11:57 AM Victim compensation for 9/11 attack I recently read that the fund established to compensate those effected so terribly by the September 11 terror attack has decided not to honor the relationships of the victims who had same-sex spouses. I can't believe that the administrators of this fund are that cruel. Many of the victims and the heroes of that awful day were gay or lesbian. It is so sad that they would be victimized twice in this way. It is incomprehensible to me that the generous and loving people who have so lavishly endowed this fund would have intended it to be so meanly applied. But it is very disturbing to witness my government use MY TAX MONEY to compensate the families -- especially when these families just seem to want to argue about what they are entitled to. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The amount given should certainly have no relationship with whatever charity the family may receive. It is also not up to the federal govt to decide among victims' families who should receive relief nor is it the federal govt's role to figure out the impossibly shifting view of need. It is up to the family to come together. It is up to the federal govt to distribute the funds as quickly and as equitably as possible. By 2/15/02 (or 60 days), each victim's family should complete a form listing the victim's family members and stating through whom the funds should be distributed. The family should be limited to parents, spouse, children, grandchildren only. The federal govt will maintain a database to track giving. Money will be released after 2/15. If a family cannot decide and does not complete the form, they forfeit federal aid. If more than one form is completed, they will be given 30 days to resolve within the family. I propose an assistance plan of fixed sums to ensure fairness regardless of income level. Tuesday, December 04, 2001 1:34 AM Domistic partners I am dropping you this line to beg you to have some compassion to those gay partners who lost their loved one's in that tragic day 09/11/01. Myself and my partner of more than 22 years are Americans just like you. We both served our country during the Vietnam war and we consider ourselves as a couple. After all, how long do a couple have to live together to be recognized as a couple? The neighbors on our street all know the guys who take vacations together, decorate our home for the holidays and look out for one another. When we first moved in people might have been a little different towards us but after several years at our home we have been accepted just the same as the old eighborhood. The old neighborhood is mostly Polish Catholic. We too are catholic. Most of our old neighbors came over here after WW II and some were in concentration camps. They were the ones who were our closest friends. Our government needs to wake up and realize that we are not going away and you cannot ignore us because we are your neighbors,friends, brothers, sisters people you work with. Some of us are quiet and live a very secret life. But some of us are tired of hiding our true identities and we are coming out. If you don't accept us then there will be maybe another Dr. King only this time they might be gay and we will protest and write letters and do what ever we have to do to be recognized. I have seen a lot of my friends die of Aids and their families wouldn't even go to their funerals because they are afraid of catching "GAY" or Aids. Remember this when you are thinking of not giving aid to the surviving partners of lost ones. We (and I ) certainly did not choose this life it was determined before I was born. Why (ask yourself) would anyone CHOOSE this life? You think we like to be mistreated and discriminated against by the very country we love. Absolutely NOT. I am not a sadist. I am this way because I was born this way. Why won't the straight majority realize that we are a minority just like any other minority? Please help our Brothers and Sisters get the respect they deserve and treat them for what they are, surviving members of a horrible, horrible tragedy. In reality what you are doing is averaging down the earnings. Your tables show the increase in wages to be approx 5.5%. I think you are quite well aware that most people that was lost were getting more then 5.5% increases. I feel it would be fair to let us chose if we want to average the earnings over those years or let us chose the last tax year or even 2001 projected earnings. Thursday, November 15, 2001 10:16 AM Victim Compensation Fund Thanks for allowing this! I have often thought about this very subject and what the role of the American people should be in compensating the families and companies that have been affected by the occurrences on September 11. The following is just my opinion. I think that the US Government should distribute funds to help those families that have been investigated and found to actually be harmed by the 09/11 incidents. Those families should receive a modest tax break to allow for a rebuilding of their home life and to restructure themselves for the loss of income and to compensate for costs of medical, burial, or other expenses incurred as a direct result of the 09/11 incidents. The actual amount should be limited to a verifiable 2 years of wages lost by the family member whose lives were taken. This would include police, firefighters, passengers on the aircraft, aircrews, and those who have been identified as being in the WTC. This would be separate from the Governments policy in compensating the carriers for their loss. As to the carriers, the plan as outlined is sufficient. As to funds to allow for this compensation. I have a question to the DOJ. First, the DOJ has frozen international funds located in the United States that have been ear-marked as being a financial asset of the terrorist organization. Those funds have been frozen to deny any terrorist organization from being in a position to wage any type of terrorist campaign. What is being done with these funds? Admittedly, some of those funds are through a legitimate business source and some companies may not have been aware (either through a siphoning off or through a "middle man") that the money had been destined for a terrorist organization, but the bottom line is that the funds have been frozen. Why should the American people be made to pay the total amount? Introduce legislation or through Presidential edict that the money frozen would be used to compensate the American whose lives were lost by terrorist acts. This would alleviate the full financial burden on the US Government and yet, make the terrorists pay for the damage/harm they created. Thank you for allowing me to voice my opinion on this matter. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. This is a direct violation of our constitution and downright disgusting. This importantly should include the partners and children of same sex unions. Saturday, December 22, 2001 12:47 AM I am completely shocked by the treatment of Government employees My husband worked for The New York State Department of Taxation as well as 39 others. We are all receiving death pensions which are payable for life OR until remarried. If we remarry we lose our death benefit. This settlement basically eliminates hard working government employees from receiving ANY settlement under this law when taking into consideration our lifelong pension and other government benefits. This forces us into legal action because we have NO options. There are no minimums for us. OUR PENSIONS were our future wages that we sacrificed for in our low paying jobs knowing that one day we will be rewarded. Our pensions are BONUSES not collateral source income. HELP US. How can the Government hurt their employees so harshly. The government murdered our spouses and now they are punishing us again.
