As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. The presumptive award as stated by the regulations narrows down to a concept of signing a contract without receiving adequate and accurate information beforehand; it accounts to an uninformed consent. It seems to us that families of the victims of September 11, 2001 terrorist attacks were not only robbed of their love ones lives, but now your regulations are robbing our rights. Criminals, robbers and others belonging to obscure business have Miranda Rights, right to free counsel, and unrestricted right to sue when done wrong. Healthcare patients have Bill of Rights, informed consent, and other protections such as unrestricted right to sue when done wrong. Where are we cataloged? 2. Your regulations lack consistency with the rule of law. You treat us different from anyone else. These regulations are clearly inconsistent and contrary to the statues for compensating victims families. 3. Our government failed to protect its citizens at home. The responsibility for this massive failure not only includes the airline industry, but the FAA, FBI, CIA; Port Authority of New York and New Jersey, WTC leaseholder, and the City of New York/Fire Department for failing to have adequate evacuation plans to rescue workers in the upper floors in extreme cases of emergency and/or fire. Many families received calls from their loves (who worked at 1 WTC 101st floor and higher, or 2 WTC), these workers were alive and well after the first plane hit Tower One and were trying to find exits. The obstacle was that the stairs were blocked, and these unwilling victims were unable to safely reach their way out. Notwithstanding these facts, our government (that failed to protect our love ones in the first place) has placed restrictions/limitations on our ability to sue when done wrong. 4. Congress and President Bush intended to compensate families for the harm done to each family (economic and non-economic damages). The deceaseds families are entitled to receive full and fair compensation for pain and suffering, loss of companionship, loss of benefit to have the victim live his/her life to the fullest. Yet, your regulations arbitrarily limit the term relatives and minimize the financial aspect of economic losses. Its language limits the term relatives to wives and children. What about the victims who were single, yet responsible for other relatives? Many victims provided services and assistance to their families, and these families should be unrestricted in receiving the full value of these services. Regarding the financial aspect of your regulations, the growth path of earnings must accurately represent this group. Most victims were highly successful and financially independent. Their path of earnings and their rate of salary increases were well above the national average. But not only the Special Master does not considers this crucial point, he goes one step further and lowers the base of the financial award by computing a mean based on last 3 years earnings. Remember, Osama Bin Laden attacked the symbols of success and capitalism. 6. Furthermore, your regulations treat the victims as statistical budgetary burden by using economic tables that are flawed and low. Additionally, , Forensic Economist, stated that the calculation of your work-life tables uses old statistics from 1979 and 1980 and that these numbers are lower for women. The number of women and their rate of success and working years have greatly increased since then. 7. The presumptive award should not be reduced by the amount of contribution victims estates have received from pension plans, 401K, life insurance, voluntary contributions from employers, social security, etc. Our love ones earned these monies throughout their working years; it is rightfully theirs. 8. Our family has a question that we would like to be answered: Is the unconditional generosity of the people of this nation greater than the Federal Governments conditional liability/failure to protect its citizens in their own homeland whose only "fault" was to go to work the morning of September 11, 2001? 9. I think that the plan which has been worked out, while not perfect, is an excellent and fair system. It is easy to understand and for 98% of all people, extremely generous. No system is perfect including the present tort system. I completely endorse the proposed rules. One comment. I do not understand why anyone would choose track A in lieu of track B. Under A, you can ask for a hearing. Under B you immediately go to a hearing. Since you have NOTHING to lose by having a hearing (they will not reduce the award that you receive under track A), everyone will end up with a hearing anyway. My husband was killed on September 11 in the first tower that was hit. He was the father of two beautiful 7 and 8 year old boys that were everything to him. All he did that day was go to work to attend a meeting and provide for his family just like many others that day. Our lives have changed in the blink of an eye forever. No amount of money will ever bring him back and compensate us for our loss. That being said - much of our day to day lives can be impacted by this fund. As I sit here I realize that our day to day living expenses are much more than they used to be. A few examples include: Childcare - everytime I leave the house without the boys I need to pay a babysitter. My family does not live close by. It is not as if I can now leave them with any babysitter they are both troubled by these past events and good childcare costs lots of money. I also need help just managing on a day to day basis. There is no break and just simply getting dinner on the table or lunches made can be a nightmare. Right now I am lucky that my church and community are pitching in but eventually we need to let them get their lives back and we need to make a new life fwithout my husband. That will be near impossible. Insurance - Medical insurance rates are about to skyrocket for my family. My husband's employer will continue until next September and then the increases start. First with COBRA benefits for an additional 3 years (About 8 to 10 times what we pay now and that is a bargain) and then to private insurance when it will really go up. My children both have asthma and I have 2 chronic medical conditions and lets face it we will all be in therapy for the next million years. Who will want to insure us, at what rate and because of preexisting condition clauses we will have to carry double coverage for a short period of time. General repairs and maintaince to our home will now need to be paid for. What my husband used to do will now be farmed out to local professionals i.e. plumbers, lawn care plowing etc. My children have been through so much it is my priority to stay in my home. It is a nice house, not a castle but very comfortable and as with any house needs lots of work that we were doing together. My husband was a young man, as were most men and women in the building, our income was going up slightly every year as he worked his way up the corporate ladder. He worked long hard hours to provide for us and how and should this be taken into consideration? I don't know. If this fund is to help the victims we will need to have a clear idea of what we are signing up for, the impact it will have on our finances and exactly what we will be compensated for with the fund. We need a clear idea of what each person will get and what will be deducted from that amount. Will insurance be counted or gifts, grants or charity? It would be helpful to have an advisory board that included victims' family members to help figure out how to administer the funds. So much of this process has been a nightmare for us the paperwork is overwhelming and it seems as if much of the time it takes forever to get through. Most of the information about aid that is available I have received from other victims' families and the processes that are in place have not been easy especially if you do not live in New York. Here are two good examples I received my credentials to the Memorial Service in New York at Ground Zero two days after it took place. I called to RSVP as soon as I got the letter. Then I was told I had to pick up my urn of dirt from ground zero even though I live out of state and it would take the whole day to get there and back. If you can get out to the pier it is easier to get the paper work done to collect aid that is available but that is not possible for me. Thankfully in my state we now have a social worker to help us in this process. One of our senators has really done his job and tried to listen and respond to our needs. I just don't want this to end up as another fund where you fill out the same pages and pages of information and then it goes nowhere. I'm one of the lucky ones my husband's employer has been great and hopefully when this is all said and done my husband and I were able to afford and make the right benefit decisions. How about the restaurant workers? Will they be taken care of? How about the fact that we paid for all these benefits over the years and were able to plan ahead? How about the fact that some benefits were reduced because of the number of people lost in the company? These are lots of thoughts and questions and I thank you for the opportunity to respond to you request. Someday I hope to say we are going to be ok and that we are still a family. That will be difficult for my boys without Daddy. Sunday, January 27, 2002 12:36 PM (no subject) I live in Oyster Bay, New York- on Long Island. Our small community, like so many others, has lost several of its residents due to 9/11. My recommendations to you: 1) Do not cap the income level for the calculation of economic loss. While a trial on the merits would be an uncertainty, the absence of a cap provides for basic calculations that the families might otherwise be awarded. HOWEVER, it seems reasonable that, as is often done in litigation, life insurance, etc. (but NOT charitable monies) be deducted from the ECONOMIC award, but not the pain and suffering calculation (see below). In providing for no cap, it does not penalize a family of a high income earner. However, in deducting insurance, etc. (that in most instances would be held by such higher income families), the ultimate disparity with families of lower income earners is not as great. Perhaps the economic compensation to families cannot be equal, but it can be better. 2) Provide for greater payments for pain and suffering. I recently read in Newsday that, in 1994, a New York jury had awarded $1.4 million for pain and suffering to a New York family of a victim in the plane shot down in Korea in 1983. While I understand that the awards in litigation cannot precisely parallel, it seems that it should at least be similar under the circumstances, and particularly where the fund is expressly providing for a waiver of litigation rights. If only from a purely practical standpoint, these awards should, for the most part, be equal to all families. Measuring the pain and suffering for each and every family is just too much. Be more generous and realistic vis a vis prior similar awards, but it seems too much to dig into each particular circumstance and would in all likelihood lead to division among the families of the victims, something that they clearly should NOT be subject to. With the above, seems that, while not perfect, would at least balance the field a bit more between those of higher and lower income victims, while taking into account the across the board tragedy- unparalleled- for all involved. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I personally lost a gay friend, , who worked for the New York State Department of Taxation in 2 WTC. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other. Monday, March 18, 2002 4:16 PM Sept. 11 fund exclusion of gay families To Whom it May Concern: I am a Marriage and Family Therapist, and as both an individual and a professional, I believe that the way this fund is handling gay and lesbian partners and families is wrong. Our country has a vested interest in supporting and honoring those who survive the victims of this attack. Relying on existing state laws to determine qualifying relationships necessarily excludes nearly all same-sex partners and non-bioligical children of same-sex parents, because only one state in the US currently has any form of recognition for these relationships. First, using this standard is wrong because it ignores the many municipal and county ordinances which do provide recognition for same-sex partnerships. Second, it ignores the relationships created by those who did not live in areas which benefit from such ordinances. It is wrong that a fund so dedicated to the welfare of surviors that it provides for fetuses and illegal aliens would exclude this category of relationships, thereby harming those who both loved and depended on victims of the terrorist attacks. The emotional and financial devastation that they have suffered has alredy been great enough without adding insult to injury by ignoring them in the distribution of victim's compensation funds. Finally, it also dishonors those gay and lesbian people who died in the attacks. What could be more important to any of them, had their wishes been known, than to care for those whom they made lives with? It is an insult to the memory of the sacrifices these people made to exclude their loved ones from the fund. Stress does cause numerous health consequences. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. There were many gay heroes as well as victims of the 9/11 disaster and for their surviving partners to be expressly excluded in this way is as un-American as all the conspiracies that have taken place to hurt Americans.
