Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Saturday, March 16, 2002 5:26 PM 9/11 Releif Fund On September 11, Americans pulled together in a way that has not happened in my lifetime. I collected and donated money in order that those who directly lost a family member in the tragedy would be able to financially survive their loss. And I am outraged that the benefits that are being extended to illegal immigrants and unborn fetuses are being denied the families of gay and lesbian victims! It is about time that we as a country, and you as the disbursers of aid to the families, stop discriminating against the gay/lesbian/bi/trans community! A family is a family is a family; what you imagine as a family does not apply to all Americans. The loss of a gay or lesbian spouse hurts no less than the loss of a heterosexual one, and the support of family, friends and country is greatly needed. Wednesday, November 07, 2001 4:45 PM Opinion When my family and I contributed to funds to help victims of the September 11th attacks, we did so to help fellow Americans who were suffering great losses. Our intention was to help with basic necessities, to help needy families get by. We did not intend for our contributions to either enrich anyone, nor to pay for the expense of maintaining expensive lifestyles and possessions. I do not want my contributions to pay for monthly payments for expensive houses, cars, boats, private schools or country club memberships. Nothing wrong with those. I just do not intend to contribute my money to pay for them for someone else. Nor do I want my tax dollars spent towards those expenses. Those who wish to continue with the lifestyle they enjoyed previously need to have planned with life insurance or other private means. And certainly, someone who received charitable contributions to help them out should not be able to double dip, receiving a payment from the federal disaster fund for the expenditure already paid by a charitable contribution. My willingness to contribute in the future is dampened when I hear talk that the federal payment (my tax dollars) should not take into account payments already received by the families from charities (to which I might also have given). Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. She lost her life partner, , a firefighter who lost his life at the World Trade Center. was still legally married to . He left that home five years ago and spent $14,000.00 and went through four attorneys trying to obtain a divorce. The judge who presided over the divorce case, was the same judge who had presided when and adopted three children many years prior. tried to have his case handled by an impartial judge, but was also denied that. and went to his attorney, in Cornwall, New York on September 5, 2001. She told them that there was no way that this judge was going to grant a divorce and that their best bet was to save their money and move to a "no fault" state after retired in February. The option of moving to another state had been suggested by more than one attorney, but was unable to move out of the state of New York because of strict fire department regulations. Unfortunately, the dream of being married will never happen because ran out of time. You just never think that is going to happen. Throughout this time, and my sister moved forward with their own lives together. They shared a home together for over four years and said vows in front of their children. They even wore symbolic bands. They bought a home and a van together to start their new life together as a family and 2 1/2 years ago, was born to and . He paid child support to his wife for their adopted three children, 19, 18 and 12, faithfully, but my sisters home is the one suffering the major financial blow. Of course, she will not receive any pension benefits, his legal wife will. made his feelings and wishes made known to the fire department. He changed what little benefits he was able to by law to my sister. He listed , Domestic Partner, on all applications and fire department related paperwork. However, we have recently been informed that all benefits, including all distributions from the Firefighters Widows & Children's Benefit Fund, will be disbursed to , and that not even little has any claim to any benefits. had told us so many times not to worry, that until they were able to be legally married, that the fire department knew his wishes and that they would take care of her if anything ever happened to him in the line of duty.
