Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. We lived together, commuted together and most importantly cared for my 93 year old, very dependent father together. She was the best sister in every way and I was honored to have her for the years that we had together! I understand that there are Advocacy groups forming to help the families of victims. We are not looking to sue any organization, government or person. However, many are left with people to care for without the assistance, both financial and emotional, of the victims. On a personal note, my father has a very small pension and social security. Because he cannot be left alone, and I paid women to come during our hours at work and take care of my father. This is solely my responsibility now as well as our mortgage and other living expenses that and I shared. Yes, she had insurance but will it cover the long term needs of my father? I would like to think so except I know that means shorter life for Dad. I simply ask you to do the right thing for all the victims' families, especially those with young children! As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..."We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered. Wednesday, January 16, 2002 4:23 PM Victims Compensation Fund, Att: Mr Zwick Dear Mr. Zwick: On September 11th. my husband, woke up at 5:00 AM as he did every morning. He said his prayers, went out for his run then proceeded to drive to work. I am proud to say he was a successful man in his own right. At 41 years old and he was at in One World Trade Center. He did not return home to his family that evening and never had a chance to get a call out. He leaves behind a wife of 18 years, three children, parents, brothers, sisters, in-laws, friends...the ripple effect goes on. The pain we now must live with is indescribable. I am writing you today Sir simple to ask you not to forget these men and their families. As you know, in the immediate aftermath of this tragic attack, our Congress enacted unprecedented legislation to bail out the airlines by imposing a caps on their liability thus restricting, (and for all intense purposes eliminating), victim's constitutional right to pursue legal action against the airline who at this point they hold primarily responsible. Congress at the same time set up the Victim Compensation Fund in order for families to receive full and fair compensation for economic and non-economic damages. Of course that was after all families had to endure a "collateral source deduction" something completely unheard of in any state's civil court system. The DOJ has decided to further add insult to injury by imposing arbitrary "interim rules." These rules require families to blindly sign up, thereby giving up all their rights without knowing what their outcome will be. They are being forced to accept a hearing process lasting on average 2 hours and their only right to appeal would be under "extraordinary circumstances," which are not defined and left to open interpretation. Moreover, the DOJ has imposed arbitrary income limits which severely penalizes the very people who were victimize by this heinous attack, namely those who work with in the financial industry. I thought that I lived through it all after September 11th, but these interim rules have so hurt the very people they were designed to help, that they have left this American truly shocked and disheartened. As a leader of strenght through out these dark days, I ask of you Sir to please intervene on behalf of these families and insist that the income caps be removed and the final rules please live up to the full spirit of the legislation so that ALL who opt into the fund will be treated in a fair and equitable manner. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." In recent interviews, the head of September 11 Victim Compensation Fund, has made it quite clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. 2. Even fetuses and illegal aliens will be receiving benefits. They have even promised to overlook federal law and NOT arrest nor kick out the families of illegal aliens. Our patriotism and love of country transcend our differences and should unite us all. We were told that September 11 was the day that "hyphenated Americans" were no more, and rather than being Italian-Americans, African Americans, or Gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family has been divorced. 6. The hyphens do not seem to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid families of those heroes, the hyphens comeback with a vengeance, and it seems that some American heroes are now more equal than others. 7. Discrimination in any form is un-American and illegal. 8. I am outraged that gay and lesbian partners of those who died on September 11 are not automatically receiving the same benefits as heterosexual spouses. Her parents (legal heirs) are divorced and do not communicate. 1) 's mother was the sole beneficiary of her daughter's life insurance. Her father (my sister's ex-husband) who is an attorney/judge, has indicated that an offset in the amount of the life insurance will be deducted from the claim settlement value with Victim Compensation Fund. This we all understand BUT, he further states that the amount of the settlement will NOT be distributed equally to my niece's two parents. My ex-brother-in-law is looking to deduct from my sister's share of the settlement, the amount she received in life insurance. I believe that the beneficiary of life insurance is irrelevant and separate and apart from the a claim with the Victim Compensation Fund and certainly hope that when the regulations are available, the issues concerning distribution of funds are clearly addressed. 2) Information currently available indicates that the "personal representative" of a deceased victim will file a single claim to the Victim Compensation Fund. My adult niece, has 2 parents but they are divorced. Can parents jointly be their daughter's "personal representatives" (plural) filing one joint claim? I hope that every consideration will be given to these concerns for my family and for others in similarly awkward positions. December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
