Monday, November 26, 2001 2:38 PM INCLUDE gay and lesbian domestic partners in equal compensation I am not someone who will be impacted by how the Department of Justice defines "family" when dispensing funds for the victims of the attacks on the Pentagon and the World Trade Center. But these people were family to me regardless. It is beyond an outrage if everyone who suffered loss is not treated equally. People died in those attacks who had families, who had children, but who did not have "wives" or "husbands". When the government defines legal marriage as the only love that counts, hundreds of people who had equal love for their partners are excluded from benefits they rightfully and morally deserve. Particularly at the Pentagon, everyone who works there is a patriot. Everyone who died was a patriot. New York law allows domestic partnership benefits through an executive order from the New York governor. If a gay or lesbian victim worked at the Pentagon and lived in Virginia and then died as a result of the terrorist attacks, his or her partner is denied benefits because of Virginia's archaic and hurtful laws born out of religious dogma. Virginia is wrong, and the US government shouldn't compound this outrage. If you have any sense of decency or patriotism, then ALL survivors' life partners--straight, gay and lesbian--should get equal benefits. Gays and lesbians aren't ALLOWED to get married, and now the government is considering that they be punished for not being married. Do the right thing: Allow gay and lesbian domestic partners to be given EQUAL benefits. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Wednesday, December 05, 2001 3:18 PM September 11 Victim Compensation Fund Dear Mr. Zwick: I am responding to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. Since our inception in 1985, we have worked in partnership with thousands of service providers and criminal justice agencies throughout the country to help victims of crime rebuild their lives. In the wake of September 11, we have been working closely with victims and victim service providers to try to cope with this unprecedented tragedy. The Fund was intended to compensate September 11 victims for their economic and non-economic losses. Given the cap on the airline industry's liability and the decision to force victims to chose between civil litigation and the Fund, it was also hoped that the Fund would be an attractive alternative to civil litigation. The Interim Final Regulations do not achieve either of these goals. As a result, many victims are skeptical of the Fund, and intend to either pursue civil litigation, or at least wait to evaluate how other claimants fare before choosing their own path. There is still an opportunity to make the Fund the program Congress intended it to be. In the final regulations, we hope that you will address the following fundamental issues of fairness, due process, and Congressional intent: I. The Interim Rule Provides for Unacceptably Low Compensation Levels. In creating the Fund, Congress intended to provide full compensatory damages to all eligible victims who opt into the program. The Act defines economic loss as "any pecuniary loss resulting from harm"; the only limitation being "to the extent recovery for such loss is allowed under applicable State law." The definition for non-economic loss contains no restrictions or artificial caps of any kind. In fact, the Act sets forth a wide variety of elements which must be considered in determining non-economic damages. The limitations set forth in the interim regulations render these statutorily mandated elements meaningless. This "one-size-fits-all" approach violates the intent of Congress. Furthermore, the Interim Rule provides for unacceptably low payments. The figure for non-economic damages is a small fraction of what these victims could anticipate recovering in a civil lawsuit. Because claimants are required to waive their right to any civil recovery, the damages awarded should be more comparable to those that could be received in a civil lawsuit. II. The Collateral Source Rule Needs to be Modified in Ways That Are Fully Consistent With the Act. A. To the extent that collateral sources have to be deducted, this should happen before non-economic damages are added to the award. As the regulations are currently written, many potential claimants will get nothing because of the collateral source rule. Every eligible claimant should be guaranteed some minimum award. B. It is inconsistent with the Act to deduct pensions from awards. The Act creating the Fund explicitly states that a collateral payment can only be used to reduce an award if it was "compensation the claimant has received or is entitled to receive as a result of the terrorist-related aircraft crashes of September 11, 2001." Pensions are not compensation for a loss. Rather, a pension is a financial asset, much like a savings account or mutual fund investment. It is an asset of guaranteed retirement earnings. The only way it would be equitable to deduct pensions from an award is if future lost earnings are calculated to include retirement earnings. III. The Eligibility, Application for Advanced Benefits, and Other Claim Forms Need to Be Modified. A. The application forms for the Fund should clearly inform claimants that they are waiving important legal rights by participating in the compensation program. In a prominent place on the forms, it should be clearly stated that: 1) by participating in the Fund, claimants are waiving important legal rights, particularly the right to file a civil lawsuit; 2) claimants are encouraged to consult with an attorney; and 3) attorneys are available to represent them free of charge. B. The forms should be changed to be less intimidating for undocumented aliens and other foreign nationals. While the regulations seem to indicate that undocumented aliens and other foreign nationals will be able to file claims with the Fund, the forms themselves discourage such filings by asking for a social security number and a passport number. IV. The Regulations Should Make Sure That Certain Categories of Survivors Receive at Least Some Share of the Award. The regulations should treat payments from the Fund similar to recoveries in wrongful death lawsuits, rather than as assets of an estate. In many states (Virginia, for example), the wrongful death statutes sets forth certain classes of beneficiaries (e.g., surviving spouses and children) who are entitled to share in a recovery, regardless of what a decedent's will says. The Interim Regulations suggest, and the Special Master has confirmed this in various statements over the past month, that if a will says everything goes to "Uncle Harry" (and not to a surviving spouse or children), then Uncle Harry can take the entire award from the Fund. This is an unjust result. The category of beneficiaries that are guaranteed a share in the award should at least include spouses, children, and domestic partners. V. The Regulations Should Be Modified to Ensure That Claimants Receive Certain Due Process Guarantees. Due process is required for any governmental function to earn public confidence. In several ways, the due process elements of this program under the Interim Regulations fall short. A. A plaintiff should not have to demonstrate "extraordinary circumstances" to take his or her case outside of the "presumptive award methodology." This methodology defeats congressional intent, and to require such a high showing is a denial of due process. Congress intended awards to be based on individual determinations. There were more than 3,000 victims in this tragedy; more than 3,000 unique cases with circumstances which differ in important ways from the presumptive methodology. While the charts may be an apt starting point, any showing of unique circumstances (i.e., circumstances which differ in some way from the assumptions that went into the charts), should be enough to allow deviations from the presumption. B. ALL award determinations must be subject to some type of review. Under the current Rule, only awards determined on the basis of documentation (i.e., a Track A filing) may be reviewed. Track B filings (determinations following a hearing) are apparently not appealable or subject to review. This is not due process. Congress intended for claimants to have the ability to offer evidence, "including the presentation of witnesses," which necessarily entails a hearing. To deny claimants who opt for a hearing any opportunity to appeal determinations they believe to be unfair is a significant failure of due process. C. The presumption that hearings will not exceed two hours is rigid and arbitrary. This presumption will make it impossible for many claimants to present their full case. The damages portion of a wrongful death lawsuit can often take several days. There should be no presumed time limit for hearings, with the only qualification being that hearing officers can refuse to consider testimony or evidence which is deemed to be cumulative or irrelevant. The right to a hearing must be a meaningful right. VI. By Making a Claim, Victims Should Not Lose Their Right to Sue Terrorists, Terrorist Organizations, or Countries Sponsoring Terrorism. Although the Special Master has publicly stated that claimants will not give up their right to sue terrorists or supporters of terrorism, the regulations should be changed to reflect this. The Fund was created as part of the Air Transportation Safety and System Stabilization Act, which was intended, at least in part, to protect the financial stability of the domestic airline industry. The Act could not have been intended to protect the financial interests of terrorists or terrorist organizations. The regulations should leave no room to interpret the Act as prohibiting suits against terrorists, terrorist organizations, or countries who sponsor terrorism. VII. Victims Who Have Suffered Latent, But Not Evident Harm, Should be Allowed to Make Claims. There is no rational basis for distinguishing these victims from victims with more immediate, obvious injuries. Similarly, otherwise eligible victims who have suffered emotional and psychological harm that has resulted in physical manifestations should be eligible to make a claim. The regulation's requirement of medical treatment within twenty-fours is completely unreasonable. Many people were simply unable to get to their medical care providers or had more pressing concerns in the immediate aftermath of the attacks. VIII. The Regulations Should Make Clear That the Money Used to Pay Awards Under the Fund Should Not be Taken Out of Federal Victims of Crime Act (VOCA) Funds. While the National Center for Victims of Crime supports the concept of compensating victims through a fund like this one, such generosity should not be at the expense of millions of other crime victims served by the state compensation and crime victim assistance programs. The VOCA funds were intended to go to the states and should be used by the states. We hope that these comments will provide useful guidance as you create final regulations which more fully comport with the Act, and more importantly, fairly compensate all eligible claimants. The pain and suffering amount should have been raised. Children are dependent in most cases until they are 21 and out of college not 18 years old. People are being discriminated against because you will not use their real salary. People do make over $225,000 a year. That's how much they are losing, not the top amount you have capped salaries at. I am appalled and saddened that gay and lesbian partners of those who died on are not automatically going to receive the same benefits as heterosexual spouses. To act as if gay America has suffered less of a loss is unbelievable. Not only everyday people died in this horrible act of terrorism, there were gay heroes as well. To not include the families of gay and lesbian victims is yet another tragedy for America.
