Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Washington, D.C. 20530 Dear Special Master Feinberg and Mr. Zwick: I write on behalf of the City of New York to comment upon the Interim Final Rule ("the Rule") promulgated on December 21, 2001 to carry out the Air Transportation Safety and System Stabilization Act ("Act"). The City respectfully submits that the Interim Rule should be modified in a number of respects so that the regulatory scheme conforms more fully with the purposes and language of the legislation and to ensure that the victims of the September 11th attacks are fairly and adequately compensated. The City concurs in large part with the comments about the Rule made by New York Governor Pataki and New York State Attorney General Spitzer in their joint submission. Specifically, and without repeating their contentions at length, we fully agree that: - The Rule's treatment of economic and noneconomic losses is both unfair and inconsistent with the Act. There is no basis in the Act for limiting recovery of lost earnings. The Act requires that economic damages authorized by state law be awarded to a victim; New York law, which is applicable to most claims, provides for full recovery of economic loss, including lost earnings. Any effort to limit the recovery to something less than that amount simply finds no support in the Act or concepts of fundamental fairness. Similarly, while presumptive noneconomic awards will help ensure uniformity in the administration of claims, under the Act claimants who submit evidence of their actual damages should not have to demonstrate extraordinary circumstances in order to obtain a recovery in excess of the presumptive award. - The eligibility provisions of the Rule are also more restrictive than those set forth in the Act. Individuals who suffered physical harm as a result of the crashes should not be made ineligible simply because they did not seek medical attention within 24 hours of the attack or their rescue, or were not hospitalized or rendered disabled. Nor, if they were in fact physically harmed because of the crashes or ensuing collapse, should they be denied a recovery because they are unable to verify their injuries with contemporaneous medical records. These additional requirements in the Rule engraft conditions to recovery that are not found in the Act. The Rule should be modified so that, consistent with the Act, any persons who can show that they suffered physical harm because of the attacks are eligible for an award. - Upon sufficient proof of a relationship of economic dependence or interdependence, domestic partners and other family members lacking formal legal recognition should be considered eligible for an award. - The rule should prohibit disclosure of information or documents about an undocumented alien's immigration status to the Immigration and Naturalization Service. - Only those collateral sources provided as a matter of contractual or statutory right should be offset against an award, and, as under New York law, collateral sources should be offset against an award only to the extent that they correspond to the particular kind of loss that provides the basis for recovery. See Oden v. Chemung County Indus. Dev. Agency, 87 N.Y.2d 81 (1995). Finally, because the Act clearly provides that upon submission of a claim, the claimant waives the right to bring a lawsuit to recover damages resulting from the crashes (and because submission of a claim may jeopardize a claimant's eligibility for worker's compensation benefits of have other legal consequences), it is critical that the claim form devised by the Special Master clearly state the legal consequences, or possible legal consequences, of submitting a claim. This is the approach taken by Governor George E. Pataki here in New York State, where so many of the victims lived. Wednesday, January 16, 2002 10:50 AM Public Law 107-42 COMMENTS Dear Mr. Feinberg: As the widow of World Trade Center Victim , I would like to make my objections to the Airline Bailout Bill's Victim Compensation fund very clear. Because of the misrepresentations and media spin, both the purpose of the fund and its potential payout has been incorrectly stated in just about every source. The Airline Bailout Bill was not passed by Congress to provide for the families of the victims. It was created primarily to protect the airlines from litigation. The provision of the bill that includes the fund was included as an incentive for families to accept a settlement and not sue the airlines. Any award that is given to a family is money that the Airline would have had to pay. This is another gift to the Airlines. Nobody would benefit from bankrupt airlines, but to give all this support to the airlines at the expense of the victims' families would be inappropriate and unjust. In short, this money is from the government on behalf of the Airlines. Many have represented the fund as an act of charity to the families. The program should provide the incentive for which it was created. Congress had the right intention; the current formula ignores this intention. Further, these "awards" will not actually be the amount that is paid to the families. If the deceased victim made any sort of plans for his or her family, they will not receive much at all from this fund. If someone paid life insurance premiums for his entire life, He is essentially being penalized for planning. If, instead, someone decided to invest this money rather than buy life insurance, the investment will not be subtracted from any settlement award. The fund discriminates on the basis of their investment choices. If life insurance and pension benefits were not counted against the settlement, then the fund may actually provide an incentive to avoid the courtroom. The rules should be changed and changed quickly. Right now, those less fortunate may be forced into signing because of financial need. Protecting the transportation system is necessary, but not at the expense of the families of the victims. If this tragedy had involved three people instead of 300, then each family would be looking at large settlements from the airlines' insurance companies. Just because this event was of such a large scope, the loss of a loved one is not any easier. If the rules are not changed, then many people will be encouraged to take this matter to court. If you are trying to avoid lengthy court battles, then make the settlement more equitable. While there are exceptions it is clear once all the comments for the last day, at least, are looked at. The impression this gives exaggerates the prominence of the negative comments. Also, please note that many of the negative comments are based on misunderstanding what the law was intended to do and what rights were taken away from the victims in giving them access to the fund. Also, the fact that many of the victim's families complaining are doing so because despite losing their access to legal remedies all other US citizens have, they will end up with nothing from this fund. This is especially true for firefighters and policemen. Tuesday, December 04, 2001 8:19 PM Compensation for Victims families To whom it may concern: I am writing to express my concern over who will be included for compensation of victim's families after the tragedy of 9/11. My concern is for those surviving members of non-traditional families that may not have been bound by marriage certificates. Whether or not you support families that consist of either: 1)Gay or Lesbian couples, or 2) Heterosexual Life-Partners that aren't married, should not matter. Everyone who loved and depended on those who were lost in this horrible tragedy should be cared for, because that is what America stands for: diversity. Each person that was lost on that day was a unique individual with hopes and dreams, who loved their family very much, and you would negate them just as much as the terrorists if you chose to ignore any of them. I think it is sad and pathetic that we can even begin to consider this question, when we are not a religious state but a secular one. I myself am very religious, but I also know that Holy Books of many religions, particularly Christianity, state that we should not judge each other. Please do not erase these people and the feelings that they had for their loved ones, to do so would be just as much of an act of hate as the terrorist act that prematurely ended their lives. Thursday, January 17, 2002 12:25 PM WTC Fund Dear Sirs: I lost my 24 year old daughter ( ...employee of , & ) in the WTC , and don't seem to be on anyone's lists for notification about the federal fund, charities, or anything else. Perhaps this is because I have been divorced from mother for 20 years and all the data bases contain only her name. I learned of this meeting, by the way, this morning from mother, but only because I happened to send her an email wondering why I am never informed of anything by any charity, fund etc. I have heard from Gov. Pataki and from Lindsay's employer, but that is it. With respect to what I've heard of the federal fund parameters, the amount of support contemplated for those of us who "only" have "pain & suffering"....rather than loss of breadwinner as well...the contemplated amounts for families seems indescribably inadequate and unfair. My understanding is that the familielies of airline victims are to be paid $2 million each for " pain & suffering" vs. $200,000 for families who lost loved ones at the WTC itself ( less insurance, pensions, etc). This is inhuman. You might as well anoounce that the loss of a 24 year old daughter to her parents has no value. At a minimum, the "compensation" for airline victims and WTC victims...for pain and suffering...should be the same. December 18, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I lost my husband. My daughter lost her dad. My inlaws lost their son. My brother in law and sister in law lost their brother. My sister and brother in law lost their brother. My nephews lost their uncle. Each person who perished or got disabled effected the lives of so many. Charities paid for three months of expenses so in other words basically deferred the payment of a mortgage, rent etc. by three months. This is societies generosity. This generosity is so greatly appreciated. It is a greatfull gift that all of us wish we never had to accept BUT we lost our loved ones forever and forever is not three or six months. We have to raise our children forever. The expenses of a very lavish lifestyle granted a much higher charitible benefit and this should not be repeated by OUR government. EACH victim is EQUAL and should be compensated equal. Consider a salary of $300,000 earned by a 30 year old versus a $ 60,000 salary earned by a 60 year old. These payouts using present value of salary and expected life years would value these peoples lives so unfairly. The government is settling these issues on behalf of the airlines, building owners etc so these funds in fact will be reimbursed to the government by the parties at fault. AMERICANS are not losing the tax dollars they think they are losing if the parties at fault pay the government accordingly. HOPEFULLY the government will do the right thing. I have been a government worker for 21 years. My husband was a government worker for 21 years. My parents retired as government workers. If pensions offset the compensation then all firefighters and police will end up with no compensatory damages because their pensions alone will offset the entire amount.
