Wednesday, November 28, 2001 6:56 PM To whomever it may concern, I know that so many lives have been effected by the tragedy on September 11th. The whole nation was touched whether we knew a victim personally or not. I cannot imagine how much these families have suffered, having lost not only their love ones, but their feeling of security as well. And in addition, they must now suffer the financial struggles that accompany the loss of a partner. Tragedy is a time that pulls people together. We have seen the nation pull together, and I hope that we can look past our prejudices to recognize all the people that are effected, whatever race, nationality, religion, or sexual orientation they may be. I want to lend my full support to the equal compensation for those who suffered the loss of a partner, whether it be a heterosexual relationship or a homosexual one. This is a cowardly act of dispossession. I deplore it. State law aside, these people must receive full compensation from the Depart of Justice fund. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. In a country which is supposedly founded on the separation of church and state, this is a strange circumstance indeed. It appears that the government is taking the kind of stance that did in those days immediately following the tragedy....making it clear that fundamentalist prejudice is still very alive in the U.S., just as it is in many fundamentalist Islamic countries. The fact that it is Christians doing the discrimination is no comfort to those affected by this discrimination. Please realize that history will one day recognize the legitimate human rights of Gay, Lesbian and Bisexual people, who have always been a part of building this nation, and of defending it, as (a gay man on United flight 93) did on September 11th, 2001. How wonderful it would be if the manner in which the September 11th Compensation Fund is distributed could be a sign of a coming equitable and just future, rather than a remnant of a hypocritical and ignorant past. Why should they have a cap if the rest of us are looking at retirement now starting at age 70. b) There should be no deductions for any charity received by the victim's dependants. I am fine with the inclusion of illegal aliens as a compassionate measure to those who have no way to recover after such a devastating loss, but since when do illegal aliens take precedence over American citizens? Do not gay and lesbian victims and partners of those victims deserve the same compassion? Many of these persons would be legally married if they had the opportunity to do so. They have been BARRED from doing so by the same government which is now saying that they will be penalized because they are NOT legally married? What cruel irony is this? Besides the fact that the government should grant some form of civil recognition to people who wish to marry, or couple together legally and share the same benefits and responsibilities of a "married" couple, it should also grant the same services to those who for all intents and purposes are married in all but the civil piece of paper. \n If you have religious or other objections to the term marriage, fine. Call it a civil union if you like. But grant us the same pursuit of happiness you afford yourselves. Many GLBT unions last much longer than heterosexual unions. But that isnt the point. The point is people do bond together, whether considered legal or moral by others, because they love. And when they lose that love, they are as devastated as anyone else. And if they are financially dependent or interdependent on their partner, they are also just as harmed and made destitute as anyone else. We dont ask if people are gay when they collect unemployment, or food stamps, and we dont ask if they are gay if they contribute to our campaign or make large donations to charity. It is all immaterial. We are all humans, and we are all American citizens. Those are the things that should matter when disbursing American funds. If you are going to waive the need to be an American citizen to collect those funds, fine. That is a generous move and one based on compassionate motives, but if that is the case, how dare you deny an American citizen, just because they are gay? I dont buy your State's law argument. This is about federal obligation, not individual state's laws. The federal government has passed laws before which conflict with state legislation. If you have to pass a new federal law to give these victims their due, then go ahead and do it. Dont deny responsibility in such a shameful manner. Live up to the true American ideal. The events of September 11th affected all families equally. I am amazed that anyone would consider a time of grief an opportunity to get up on a soapbox and try to divide an already "hurting" community. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
