Tuesday, January 22, 2002 9:30 AM Disappointment with deduction of collateral resources from potential awards Dear Mr.Zwick: I am writing to express my disappointment with the rules outlined for the Federal Victims Compensation Fund, particularly the rules which would deduct collateral resources from any award amount. I was told that the purpose of this fund was to provide victims with an alternative to the long and costly litigation process. After reviewing the rules outlined by Mr. Feinberg, I determined that the fund would clearly not provide ANY financial assistance to my family. By deducting collateral resources from the calculated award, my family would receive NOTHING from the fund. This cannot have been the intention of the authors of the statute. Regarding these collateral deductions Mr. Feinberg stated: ??after we compute economic loss and non-economic loss, that gross number must then result in a deduction for collateral offsets. ?Why? The statute requires it. The statute states that certain -- certain awards, certain compensation, certain benefits to victims must be offset -- such as life insurance or other death-benefit programs.? Feinberg weasels out of this by stating that he is only doing what the statute requires. The answer to his dilemma is simple ? CHANGE THE STATUTE. Legislation like this has never been passed in our country before. It was written in a hurry and everyone agrees there are flaws. It is imperative that the statute be changed now, before great injustices are committed and terrible precedents are set. He refers to private life insurance as a ?death benefit program?, as if it is something sponsored by the federal government. Private life insurance is an individual choice and not something that the government should penalize some for having (while rewarding others for not having it). It is not as if the federal government would be paying these families twice. The amount the families have been compensated by private insurance companies should have no effect on the award from the Federal Victims Compensation Fund. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Saturday, February 02, 2002 10:24 AM Compensation I believe the compensation initiative is wrong because it sets a bad precedent for future acts and cheapens the value of lives lost in previous acts of terrorism and/or crime. It also cheapens the value of the lives of military personnel who's families receive lower compensation for loss of a spouse or parent while serving the nation. The terrorist acts on Sep 11th were a crime and the victims should be treated like the victims of any other crime. Consider the fact that the young wife of a service member who dies in Afghanistan will receive Serviceman's Group Life Insurance totaling up to $500,000 (but only IF her husband paid the monthly fee) and a modest survivors benefit payment monthly IF she does not remarry. Compare that with what the government plans to provide persons who simply were at the wrong place at the wrong time on September 11th. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This is a time to demonstrate our belief in true CIVIL equality and compassion, to demostrate how we follow the constitution above individual state laws, and not bend to religious views regarding biology or sin to encourage bigotry, discrimination and hate. First I want to say, even as a Democrat, that as far as any citizen is able to judge from the media, you have done an outstanding job as a leader during one the most difficult times ever for our country. I received a disturbing email (see below) and am appalled and angered that something like this could even be considered and was moved to correspond to ask for your leadership. The support and restoration intended by the Sept. 11th fund is a civil issue, and should not be influenced by different religious beliefs regarding biology. I am hopeful that you will continue your strong leadership and not allow bigotry and discrimination to taint the healing process or your excellent leadership thus far, by allowing denial of benefits to the partner of , hero of Flight 93, or any other domestic partners ~ straight or gay. I recently watched the film "The Laramie Project" and was moved to see that people in Laramie following the hate murder, like the silent majority of people in the U.S., are more tolerant than many would think. Most people in this country DO NOT begrudge gays and lesbians citizens, equal CIVIL rights and benefits. However, another lesson from that film is that the the preaching of different understandings and beliefs about biology, fear, hate, and the silence or inaction of others, does lead to discrimination and violence. Every time action is taken or not taken to stem the tide of equal CIVIL rights . . . . hatred and violence is encouraged. Please do not contribute to this through the misuse of a fund intended for healing. Please do not show more tolerance or understanding for non-citizens than you would for our own citizens who represent a strong 10% to 15% of the population. This country was founded on freedom of religion and different beliefs and equality for all citizens. Our constitution and bill of rights requires that our leaders see to it that there is a separation of church (differing views or morality, sin, biology) and state; that those with their own unique views of biology, religion or sin DO NOT prevent other citizens from sharing in ALL CIVIL benefits or to pursue life, liberty & happiness. I must admit that, unless your record and leadership on equal CIVIL rights regarding sexual orientation issues causes me to change my mind, for the first time in my voting life, at this time I anticipate I may be voting for Republican, George W. Bush in the next presidential election. But I cannot in good conscience vote for any leader who would, through action or inaction, encourage bigotry, blur the separation of church and state, or deny full CIVIL benefits to any of it's citizens.
