This troubles me deeply. The purpose of this fund is to provide assistance to those who have suffered financial losses as a result of losing a spouse in the attacks. Is it possible that anyone really believes that committed same-sex couples in long-term relationships do not contribute to each other's financial wellbeing, and that surviving same-sex partners of September 11 victims are not suffering the same financial difficulties as widowed heterosexuals? I sincerely hope that America's leaders -- the people we should be able to look up to -- are not suffering from such a profound lack of common sense. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Washington, DC 20530 Dear Attorney General Ashcroft: As a result of constituents who have lost family members in the events of September 11th having contacted me and shared with me their concerns regarding the interim final rule for September 11th Victim Compensation Fund of 2001, I have introduced a resolution in the House of Representatives, H.Con.Res. 302, which I would like to bring to your attention. H.Con.Res.302 urges the Department of Justice to seek subrogation, as authorized in section 409 of the Air Transportation Safety and System Stabilization Act, from Osama Bin Laden, other members of Al-Qaeda, and any other individual or organization determined to be responsible for the terrorist-related aircraft crashes of September 11, 2001, with respect to claims paid under the September 11th Victim Compensation Fund of 2001. Also, it calls upon the President to liquidate the assets of those responsible for the terrorist-related aircraft crashes of September 11, 2001, which have been blocked or confiscated by the United States, as authorized in section 106 of the USA PATRIOT ACT, and to use the amounts from liquidation to pay claims or reimburse the Government for claims paid under the September 11th Victim Compensation Fund. As I discussed in my written comment to Special Master Kenneth R. Feinberg regarding the interim final rule for the September 11th Victim Compensation Fund of 2001, the purpose of the September 11th Victim Compensation Fund of 2001 is to provide expedited, fair, financial relief for those most devastated by the events of September 11th, sparing these individuals from having to go to court to litigate for years at excessive cost and constantly having to relive the horrible events of that day. This financial relief, though, comes from the generosity of the American taxpayers, who were not the wrongdoers in the events of September 11th. I believe that it is, therefore, only appropriate that those who committed the evil act of September 11th forfeit their assets to pay the claims of the victims. Additionally, it is my hope that if Special Master Feinberg knew that ultimately, the funding for the September 11th Victim Compensation Fund would be coming from those who committed the evil acts of September 11th, then he would re-evaluate the amounts the interim final rule for the September 11th Victim compensation Fund of 2001 plans to award the victims' families. While no amount of money will ever compensate for the loss of a loved one, we must provide these families with the financial support that will help them as much as possible. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... Kenneth Feinberg made some pretty upsetting and ignorant comments on "Meet the Press" on March 10, 2002. He said that gay and lesbian family members and loved ones will not benefit from the fund. The US government is willing to break laws for illegal immigrants but is not willing to abide by laws and give money to rightful recipients. Tuesday, January 22, 2002 5:20 PM Please Consider My Concerns Re Victims' Fund Ladies and Gentlemen: I am writing to provide my opinion on the wrongful use of taxpayers' moneys to make $1.6 millionaires out of families of victims. Allow me to sum up as follows: 1. I am truly sorry for those families of victims. I am personally a generous contributor to the needy and destitute, and as a private citizen feel that it is a worth action to make appropriate donations. 2. It is, nevertheless, outrageous for our government to bestow upon these people an amount of money that will assure that they are guaranteed millionaires. Only a fraction of 1% of Americans will have come by such a significant net worth through their own efforts. How can you justify to the many, many millions of Americans who have worked their whole lives and have a minor fraction of the amount of their money you are gifting to these families. Tragedy strikes every moment of every day in this country, and the government does not try to take such ridiculous action. 3. What do you propose if a terrorist attack strikes again, and, say, a 4-million population city were destroyed? There is not enough money in the coffers to pay out a similar $1.6 million gift to that many families (without extraordinary inflation and redistribution of wealth). 4. Then, after making this well-intentioned, but senseless decision, you go on to essentially grossly reward those who have not provided well financially for their futures. If you were to still feel the necessity to go forward, why not give each one of them a more reasonable level of, say, $100,000. (Do not forget that private funds have also been provided in aggregate amounts that are similarly significant.) I would rather not call it penalizing the prepared victims (in terms of offsetting of life insurance, 401-K plans, pension funds, etc.), but rather, a gross enhancement to those undeserving victims. While I do not think those who have not provided well financially for their futures should have their pay-outs aggrandized in this way, because the number is so great at a $1.6 million potential, the offsets are probably correct (that is why I would urge a much lower pay-out to everyone without consideration of other assets, insurance, etc.). 5. There is no price you can put on life, so that is not a good argument for this wasteful and outrageously generous gifting arrangement, utilizing taxpayers' funds. 6. Why are you worried about lawsuits? -- What could the government have done to have caused this tragic event that would likely prevail in a wrongful death finding if brought to court? As an American, I would rather have us take that chance, especially as there are lots and lots of privately gifted funds (the right way) available. Also, on this flimsy ("economic-argument") basis, legislation could be passed to declare this an act beyond such litigation -- a far better way to deal with this concern. 7. What about all the spouses of victims that were contemplating or currently taking action regarding divorcing the deceased victim? Do you intend to reward them and include them in the new "millionaires' club" as well? 8. What about the illegal aliens that worked in the building? I guess they will join the exclusive ranks of the unintended and undeserved wealthy as well. Well, as you can see, as an American I am disgusted by the flagrant irresponsibility (despite national pain) in responding in this way. I urge you to go back to the drawing board and reverse this hideous, precedent-setting decision.
