I have been extremely disappointed in the way charitable organizations are giving in to their own transparent greed by trying to devise ways to cheat the Sept 11 victims out of the money collected on their behalf. I applaud our government for wanting to rise above that level and strive for fairness. I'll address the issues as outlined in the NY Times article today. 1. In order to define/verify eligibility for the fund, I believe producing acceptable forms of documentation for the person lost such as the expedited death certificates offered for the WTC victims families should be sufficient. To ensure that the right relative is applying for benefits of the fund, generally accepted standards like those used by life insurance companies to determine who gets the proceeds of any policy should be used. This would prevent a non-immediate relative from intercepting benefits that should rightfully go to someone more closely tied to the lost victim. Ie, an Uncle could not apply to receive the fund proceeds if it were found that there was a living wife, or child who would be deemed in first position to receive benefits. In the event that no spouse (legal or common-law) were evident, then children of the deceased should be next, followed by parents of the deceased, siblings, etc. Only one relative should be allowed to file on behalf of one victim. There should not be several people filing to receive benefits on the same victim. 2. Calculating economic and noneconomic losses should be based on a combination of what the lost victim was earning on an annualized basis and calculating what percentage that amount was in relation to the families overall income as a whole. If the person was only earning 25% of the total family income, then the economic benefit should not be greater than that. The non-economic benefits to all families should be one set dollar amount which would be equally dispersed to all families. 3. Disputes amoung relatives could easily be resolved by referring back to #1 above and using a standard life insurance companies rules for determining eligibility. In the case of disputes over which relatives in a family are entitled to benefits, the burden of proof should always rest on the relative with the greatest relational distance from the victim himself. For example: Between an ex-wife with children and an Uncle or Aunt, the burden of proof of entitlement to benefits would rest on the Uncle or Aunt and not on the ex-wife with children. In the case of homosexual couples or non-married couples, I believe using the standard common-law marriage rules to determine the validity of the relationship should apply. I am pleased to see our government rise to the challenge of providing for the victims of Sept 11. My support, and my prayers remain with all of you. Monday, January 21, 2002 1:59 PM Comments on Rules by Special Master Friday, January 18th, 2002 Gentleman and Ladies I am sure that I am not the first to state that the primary beneficiaries of the rules and the legislation are the airlines, the insurance industry and our government which failed in the protection of life, liberty and property of the thousands of fathers, mothers, husbands, wives, brothers, sisters, children, nieces nephews, friends and neighbors who were publicly incinerated and physically assaulted by two 40,000 ton jet airliners which were murderously conflagreated upon their persons on September 11th. This tragedy not less horrific then the gas chambers of Hitler's Germany wrecked devastation into the lives of the victims families no less catastrophic and apocalyptic and painful than the collapse of the two 110 story buildings. I have witnessed first hand the psychological and emotional damage to my best friend and her daughter by this public event and know first hand the monetary losses in support, and the emotional damage from watching the events which have been brought upon these unlucky individuals. To begrudge them some financial recompress is wrong. To their complaints when most now are only beginning to go beyond the shock and feeling of the first months is inappropriate. A victim compensation fund should compensate victims and the Special Master entrusted with that charge should do all in his power on behalf of those victims....not prove away to political differences and pressure not to pay. The caps at around 3 million dollars no where approximate the sums of money any of these victims would receive in normal litigation ...what of the millions awarded for a scratched BMW ...and no normal litigation would deduce insurance or charity from it's award. What became of the goal of dispensing with the costs and time of litigation. The capped amounts and the deductibles effectively relieve the United States and the elected officials from meaningful recompensing the victims families. This is an injustice and not within the original intent of the legislation. Most individuals employed at the World Trade Center probably had insurance for their families at their own expense. If they received it as part of compensation they paid the appropriate taxes on a benefit computed as income. The insurance and charity should not be deductible. It is my opinion that if a survey were taken of the 3000 individuals who died most would not be receiving anything more than a couple hundred thousand - not a meaningful sum- or expense to the taxpayers - under the current plan. Effectively the deductibles relieve the U.S. of responsibility to a majority of those who died. The Special Master should go to back to Congress forthwith in accordance with his charge and seek amendment of the underlying legislation. All elected personnel who believe as they should that there must be recompense to those who suffered for all Americans must promptly amend the legislation to leave insurance and charity undeductible from any amount awarded. This legislation was signed into law within days of September 11th. It's errors can just as easily be rectified. The Special Master should also make provisions more specific than turning over funds in some general way in accordance with the state law to award as is normally done by a formula for the years of dependency for spouses and children thereby apportioning rather than further causing disintergration and damage to these families by potential disputes. Tort Reform to prevent excessive monetary judgments and a plan to be used in cases of mass injury should not begin with the families of those individuals who suffered the worst physical, psychological and financial harm ever sustained by human beings. The legislation should permit these individuals to bring suit as well against these terrorist organization and individuals - whose funds have been frozen and any amounts ultimately awarded subrogated and allocated as to portions paid by the US through the victim compensation fund awards. For a country as rich as the United States and with the waste that we so wrongfully cause in spending unnecessary - we are morally obligated if we truly believe as we should - that those who died were Heroes and patriots to fairly compensate the Horrors their families have endured, and will continue to endure for their remaining lives. Some of these costs should be born by taxpayers. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. We have a special division to deal with the peaks in claims following catastrophes. We are also called upon frequently to assist in the administration of class action settlements. It's unclear to me exactly how you intend to approach the administration and disbursement of funds. Having led our Catastrophe Division for many years I know that whatever procedure is adopted, it should be one which is above reproach and simple for both the victims as well as the American people to understand. Not African-Americans, not Italian-Americans, not Gay-Americans, but simply Americans in one American family. However, I am outraged to learn that when it comes time to actually aid the families of those heroes, the hyphens come back to haunt and it appears that some American heroes will be deliberately discriminated against, that the 9/11 Victims Fund distributions apparently will not be received by particular victims (even though every kind of American contributed funds in the good faith that they would be distributed in good faith). I have learned that the gay and lesbian partners of those who died on September 11, 2001 are not automatically going to receive the same benefits as heterosexual spouses. Even fetuses and illegal aliens will receive benefits. I understand that illegal aliens have even been promised that the Fund and the federal authorities will overlook federal law and NOT report, arrest or deport the illegal alien families of illegal alien victims, nor will they punish the American companies that hired the illegals in violation of federal labor laws! Do not misunderstand my ire. I do not think any victims should be deported or further victimized. Like many others worked as a bond trader at on the floor. now has three small children ages 3, 5, and 7 to care for and support alone. I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." I have read the letter that Congressman Marty Meehan sent to you on behalf of the victims. I couldn't voice my concerns and objections any better than he did in his letter. I urge you to strongly consider his objections and recommendations. Specifically I believe it is important to establish a substantial meaningful minimum that all victims will receive. The figure of $250,000 per person for non-economic damages is completely unacceptable and sends a statement to the victims that their losses are not valued in either a legal or humane way. I also want to voice my concern and bewilderment regarding why you have capped the incomes to be used in the calculations at $231,000. I have read and re-read the original bill and I can't find anything in it that required this type of cap on economic losses. I can only assume that this limit was set to appease those who object to the "government supporting these people." Those who have this view need to be reminded that this bill was put in place primarily to protect the airlines and secondarily to address the fact that the victims would have no recourse to sue for just compensation. Please do not give into this pressure of public opinion. All of these families are entitled to be compensated for the full extent of their economic and non-economic losses since they really have no other recourse at this point. I realize that you have a tremendously difficult job to do in balancing everyone's needs and concerns. However, I urge you to do the very best that you can on behalf of all the victims. I have seen first hand how painful their situations are and how much they want to move on with their lives. However, they have a lifetime in front of them in which they must support their families that will need tremendous care and attention for years to come. By fairly and fully compensating them for non-economic and economic losses, they can move on with the rest of their lives.
