Based on the current format of the distribution of the funds to the survivors, they will be recieving minimal or no compensation from the federal government. It appears that the guidelines of the fund takes whatever possible measures to reduce the amount of compensation awarded to the victims' families. The fund designed to compensate the familes of the victims, fails to take an adequate account for non-economical losses. Many families of victims award's are offset by the collateral source reduction. If the total amount of collateral that victims recieve is greater than the toal award of the economic losses than the award for non-economic loss, which is understood to be 250,000 is deducted. This is where my great concern arises. I strongly urge you to increase the non-economic damages to 1 million for all families. This fund was designed to compensate families for economic losses as well as non-economic losses such as pain and suffering, money under the current format families will not see. Many families are not being compensated for pain and suffering and would rather turn to the courts to get a fair compensation for non-economic losses, such as the loss of the enjoyment of life. If the Bill pays awards next to nothing for the families, it is basically leaving them with no other choice, than to pursue in a long drawn out case against the Airlines to adequately compensate for pain and suffering. This would do exactly what the Bill was designed to prevent. If there was an increase in the award for non-economical losses to adequately compensate fro pain and suffering it would probably please many families and save them a long process of litigation in the courts. Additionally, I believe that it is only fair and equitable that families have the right to be fully informed of their compensation prior to officially waving their right to litigate. Anything else is simply unjust and beneficial to the Airlines and the Federal Government. I hope you can realize that the problems of the Bill that limits many families of their proper award and be able to make ammendments that benefit the victims as opposed to the airlines. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It has been brought to my attention that administrators of the September 11 Victim Compensation Fund have decided that not everyone in this country is equal. I am refering to the discrimination of gay and lesbian partners of those lost in our greatest national tradgedy. It is my understanding that compensation will either be lessened or outright denied these families of our heroes. I not only strongly disagree with this position but am sickened by the blatant effort to cheapen the lives of those who walked into hell to serve and protect us "all" ie. black, white, hispanic, short, tall, heterosexual, homosexual... As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. The devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Saturday, March 16, 2002 5:27 PM compensation for lesbian, gay, transgendered and bisexual partners of victims From what I understand, the long term domestic partners of lesbian, gay, transgendered and bisexual victims of the Sept. 11 attacks on the US, will not be compensated in any way by the federal victim's fund. I also understand that even though the fund will not be helping these deserving US citizens who's lives have been disrupted, the fund will be assisting illegal aliens and fetuses, neither of which are US taxpayers like the gay americans the fund is discriminating against.
