Monday, January 07, 2002 3:48 PM parents of My son was killed at the WTC. We keep hearing about how the wife's and their children are going to be looked after. I am a parent and not next of kin. Let me tell you about my grief. I can not stand in any line for more than a few minutes. If I try to do this I could have an anxiety attack. I can not shop for food and then wait on line. I have had problems at the dentist where I could not drive back home because of the attack. At the doctors office I warned them about what happens to me and they did not keep me waiting. I can not stand in line at the bank without having problems. Last Friday night we went out for a pizza with friends. The place was crowed and when we sat down my hands were shaking. I picked up a glass of soda and had to chance hand real quick because my right hand was shacking. This problem that I have developed starts in my right hand. That is the warning sign. I cry alot of the day. I have nightmares about my son. This problem was not there before 9/11. I have had to stay at the bank for almost two hours because of an attack. I had to sit down on the floor of a supermarket.when I have had the anxiety attack. I call pills and do take them when I feel this coming on. The problem is that sometimes I do not catch it in time. I have had the first aid people 4 times in the last few months. When I was driven to Liberty State Park by Marlboro's police dept, on our trip to ground zero, we had to stop at the first rest area because I was having one of my attacks. Some of the other parents have the same problem. The titnutis that I had started in mid march of last year has gotten much worst since 9/11. The ringing has gotten much worst because of the stress. There in no cure for this. I have to try not to be stressed but that is not possible. Our lives now and in the future have been ruined by the events of 9/11. We will require on going support to deal with this. We feel that the government has forgotten about us. This makes it worse. We feel that we should be part of the process. Our other sons and daughters should also be part of the process. Our sons and daughter were raised by us. They have been taken away by the acts of 9/11. Do not make it worse then it already is. Sunday, January 20, 2002 3:22 PM Objection to WTC death procedures I am writing on behalf of parents of a World Trade Center victim who are being grossly shortchanged on both the economic and the non-economic parts of the Victim?s Compensation Fund, as well as other aspects of the regulations. 1) The economic part is grossly unfair because the Fund is basing it on the victim's salary in the last three years. The victim had a low salary, but was young and was a college graduate. How can they know how much he was going to earn in the future based on what he made in the past? How can they decide that his life was worth less than that of other people? There should be equality in the awards. 2) The non-economic award is also grossly unfair because we know the victim suffered tremendous pain for a very long time. He was last seen on the 97th Floor, Tower Two, going back to do work, and called his mother at home saying that he was okay and had to work. We know the victim was trapped for a long time, and Special Master Feinburg still insists that the pain and suffering award is fair, when what he wants to give is one-tenth the amount under similar circumstances of terrorist attacks. 3) It is also unfair that the fund categorizes ?dependents? as only spouse and children. The victim was his parents' only son and according to Asian tradition responsible for his parents even though he did not claim them as dependents on his tax return. As with many immigrant families, he lived with and supported his retired parents and was their primary caregiver and constant companion. When his mother fell down the stairs and broke her shoulder three years ago he even bathed her. Besides dealing with their grief and struggling to survive every day without him, his parents are faced with a system which does not recognize them. 4) In addition, there should be no collateral payment deductions of any kind from the award. That would make the fund highly unfair. 5) Also, it is absolutely wrong that the victim?s family must sign away their rights upon filing as claimants when they do not know what their award will be. There should be a fair hearing of each victim?s family, because individual circumstances are different. The victim was a true American who got up early on September 11 to vote in the primary election before going to work. He believed in his country and he died for his country. He deserves much better than what the Fund is offering. Thank you for taking this into consideration. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. If you have created a fund with a law that says the victims' families are penalized in compensation because they have some other financial source then I am against this fund completely. This fund should compensate according to the deceased persons earning capacity. Period. I say sue the damn airlines and Argenbright. Who cares if they go bankrupt. If a deceased victim earned $100,000 a year then the fund should give the family a minimum of $50,000 for the 6 mo. relief. Peanut and bagel vendors, illegal aliens and homeless that can't work the block now should not get a nickel. Families' of a deceased illegal or over-stayed visa should not get a nickel. Put them on all those empty seats on a flight to their country of origin. Victims that were non-citizens or on visas should not get a nickel. This importantly should include the partners and children of same sex unions. Saturday, December 22, 2001 11:08 PM Give Support to Gay and Lesbian Partners December 22, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
