I would like surviving partners of gay and lesbian victims to be compensated as well as surviving joint children. I have two children of my own, and I know how difficult it would be for me emotionally and financially should my husband die. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Victims Compensation Fund Re: Dear Victims Compensation Fund: I am family friend of &nbsp&nbsp&nbsp&nbsp , one of the thousands that worked in the World Trade Center and was killed in the tragedy on the September 11, 2001. I am greatly concerned with the Interim Final Rules you have set for the Victim Compensation Fund at this time. I certainly understand the federal government's interest in protecting the airlines and the airline industry as a whole and thereby setting up this Victim Compensation Fund as an alternative to filing suit in this matter. However, the guidelines as they are presently configured do not, in my opinion, represent the concept of fairness, much less justice in the death of &nbsp&nbsp&nbsp&nbsp or any of the other thousands who died. First, review must be on a case by case basis working within some framework that you have set. In the case of &nbsp&nbsp&nbsp&nbsp , this was a young man, age 32, with a wife and 14 month old daughter. He had worked for &nbsp&nbsp&nbsp&nbsp for four years and in that time had shot up the ladder. His salary increased dramatically over those four years to a base salary of $105,000.00 (before bonus and benefits factored in ) in 2001. However, &nbsp&nbsp&nbsp&nbsp average pre-tax earnings for the three year period 1998-2000 were far less (as much as $25,000.00 less) than his 2001 total would have been. One can only assume based upon his last four years that was headed for much bigger salaries in the future. Your method of basing the economic loss calculation on the period between 1998-2000 does &nbsp&nbsp&nbsp&nbsp and other young risers like him a disservice and will result in a significantly lesser award from this Fund. Next, your non-economic loss numbers are simply too low. This is supposed to be as alternative to bringing suit and was intended to reflect what one might expect to recieve from a jury award. These numbers do not reflect that reality and these families, instead of feeling that the federal government has stepped in to ease their pain and made things easier in this time of tragedy, feel insulted by this non-economic loss calculation table. Third, reduction of any award by a "consumption factor" is a terrible idea. This point here is that these victims will not get to personally consume any of the income they would have realized throughout their life and therefore those benefits should accrue to the families Finally, reduction of the award by "collateral source income" is also a terrible idea. The federal government has decided to bear the responsibility in this matter for the airlines in order to protect the economy. No defendant gets to set the parameters of a potential jury award and therefore the federal government should not now be doing so. The fund should pay these families economic losses on a case by case basis to reflect the reality of their situation. In &nbsp&nbsp&nbsp&nbsp 's case, it should be based upon his expected 2001 pre-tax earnings (including benefits and bonus) with an inflation and wage increase factor calculated in. Non- economic loss should be based upon a number that more accurately reflects a jury award aiming toward just compensation. This personal tragedy was played out in front of the nation and world and the families will never be able to escape the images that haunt them. The event will continue to be on television and a part of our national history for ever. Your non-economic award simply is not right. Finally, there should be no reductions in the award for "consumption" or for "collateral source income." Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I writing to complain of the offer that Kenneth Feinberg as Special Master is making to families of the victims. was for , and as such, received a salary and bonuses commensurate with her difficult and demanding job. As responsible parents to our four year old daughter, , and to ourselves we had life insurance for . According to Feinberg's governement offer for the loss of income and related compensation, we as a family would receive essentially nothing. In addition, if part of the purpose of the government compensation is to prevent litigation, then this policy clearly forces families like ours to litigate for the pain and suffering that experienced as well as other families that I know who lost executives at . It is particular upsetting to make distinctions between victims with life insurance and those without since it penalizes responsible families who have been paying life insurance premiums for years. It is also terribly insulting to the victims who lost their lives in this attack to find that their own government is trying to nickel and dime their surviving families while huge bailouts are occuring for big business. I want to say that I am not the only member of a victim's family with this reaction to the present "offer". Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I was one of the first wave of responders to the attack against the World Trade Center. I was near the base of Tower Two when the second plane hit. I'm alive but for the grace of God. I could've died that day on a few occasions. For some reason I was kept out of harms way. I lived and my friends perished. When the South Tower came down I was standing near the base of Tower One. The cloud of dust knocked me to the floor and then it was total darkness. I wasn't aware of what was going on. My first thought was of my domestic partner of 18 years. I thought that I was dying and how distraught my partner was going to be when I was found dead there. As I took my first breath and felt the dust going down my nose and throat I realized that I was alive but then thought that I was going to suffocate. The rest is a long story but I'm telling you this because I want to illustrate a point. That day I didn't help only the gay people or the straight people. I helped all the people. I shudder to think that if I had perished there the man that has loved me all these years would have had to mourn me as he had to worry about where the next mortgage payment or the money for the funeral was going to come from. When you exclude lesbian and gay partners from participating from the benefits that will be distributed to family members you are discriminating. If I had died that day you would be calling me a hero and you would be treating my partner like a second class citizen. Is not too late to prevent this injustice from occurring. Friday, March 15, 2002 11:39 AM 9/11 decision To whom it may concern, I just read that illegal aliens will be compensated and not removed from this country by the governing board of the 911 fund. However that partners of gay citizens who died in the attack will get nothing if the state they reside in does not recognize same sex unions. So let me get this straight, someone who is allowed to be married and broke the law to be in this country will be compensated. But a natural born citizen can get nothing. We are being cast as being given, out of "taxpayers' generosity", first $1.65, now $1.8 million and yet some of us, if not all of us think that this is not good enough. Much of this plant can be traced to the administrators of the Fund while some of the extrapolation comes from suspicious e-mails to Victims Support web sites and in comments on the DOJ Fund website and news media fill ins. I wonder how many of the more than 100 airline lawyers and lobbyists sent to Washington September12 are still on retainer? Much is heard of the $1.65 figure but little is heard of the $15 billion given to the airlines in the same Airline Bailout Act. Curious? (That would reach $5.0 million per victim, by the way.) But which was the greater loss: the 4 aircraft and the lost business that eventually will be recouped or the extinction of 3,000 lives? I am almost afraid to ask this question on the DOJ site. The same act that gave the airlines your tax money, severely limited the victims' right to sue the airlines and another, related act, took away rights to sue everyone else except the hijackers and related terrorists. The ABA also gave the Fund first crack at the limited airlines' insurance money. It is estimated by some that the Fund will payout between $1.5 and $2.0 billion in total, thanks in large part to the deduction of pensions, life insurance and a deceased consumption factor (that's right, dead men don't eat.) The Fund net average payout will be closer to $650 000 than to $1 650 000 and all of it will recoverable from the insurance money the victims who sue would have collected! The victims are actually paying for the Victim Compensation Fund. Thirsty? Have some vinegar. Three groups are unfairly singled out to pay for the Fund. First, the uniformed emergency workers families who have low salaries but good death benefits. The low salaries are first discounted and used to calculate economic loss, then the generous death benefits are subtracted to net out to zero or less. The well-off experience the same treatment, but at a higher multiple. Good salaries that have been squeezed down by buying into generous future benefits are discounted and capped then reduced by the benefits which include life insurance and vested pension plans thus arriving at the same result, $0.00. The single victims' and the poor families get hit proportionally harder by the illegally calculated non-economic loss of a flat rate $250 000 take it or leave it proposition. Parents, brothers and sisters are a zero in the Master's calculus as are fiancés and same sex partners, which he leaves up to the states' laws and probate courts but provides no funding. The Master has said no plan can make every one happy but this one may set a record for its failure to make anyone but the airlines happy.
