In addition, illegal aliens are supported by the fund and will not be deported. Did I just wake up in the Twilight Zone? We can ignore one law for illegal, non- taxpaying aliens and follow the letter of the law when it comes to legal, tax paying gay and lesbian citizens? Does equal protection under the law mean anything in this country? Gay people died trying to save others and in the end our whole community is spat on by our own Government. Our government is saying "Thanks Gay people for saving our lives...but we have to follow your state laws and we will not protect your partners if your state doesn't recognize you as an equal citizen. But we will protect aliens and not deport them." I am asking you to reconsider this decision. There are gay families that are in desperate need of assistance and they deserve to be included and not excluded. This should be a time of inclusion. The pain of losing a partner is bad enough, but then to be told you will not receive any assistance but illegal aliens will is just adding salt to the wound. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Attorney General Ashcroft promised in his confirmation hearings that he would be fair to all Americans. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, January 18, 2002 11:01 AM comments on plan Mr. Feinberg, My mother, &nbsp&nbsp&nbsp&nbsp &nbsp&nbsp&nbsp&nbsp, was a passenger on American Airlines flight 11. She was a happy, healthy 72 year old woman with a brother, five grown children and ten grandchildren. She survived two bouts with breast cancer and also losing her husband at age 54 to cancer. She devoted most of her last 25 years to working with charitable organizations and volunteering. She was given a plaque by the Governor of Massachusetts upon her retirement as the&nbsp&nbsp&nbsp&nbsp of the &nbsp&nbsp&nbsp&nbsp, &nbsp&nbsp&nbsp&nbsp organization. When she died, she was looking forward to getting home to California where she had a new, active and fulfilling life - and where she was still volunteering to help the less fortunate. I believe that the airlines' failure to fortify the cockpit doors, even after ordered to by the federal government, enabled the highjackers to carry out their plan to take control of the aircraft. In my mind, this failure makes the airlines directly responsible for my mother's murder. I understand that the purpose of the compensation plan is to offer the victims' families an alternative to filing lawsuits against the airlines - in essence a settlement offer. Therefore, I object to families having to agree to a settlement offer and signing away the right to sue before the amount of the offer is determined. I object to life insurance payouts being deducted from any settlement award. Insurance was paid for and provided by the victims and should have no bearing on settlement amounts. I also believe all victims should be treated equally with all families who agree not to sue the airlines being given equal amounts. To attempt to predict the future lives of the victims, and thus assign different values to the lives of the victims is bound to be inaccurate. Let's assume all of those 3000 unfortunate people suffered equally and that all of their families are now suffering equally. To treat everyone equally regarding a settlement offer is much simpler and shows no disrespect to any of the victims by attaching different values to their lives. The compensation plan is not charity, it's the government's attempt to protect the airlines from the victims families by making a settlement offer that's more attractive than going to court. The fact that the compensation plan exists makes me think that the government knows the airlines are responsible and fears a catastrophe if the 3000 families all sued. Since the aim is to placate the families, I request that equal amounts be offered to all. Thank you for the opportunity to comment on the proposed plan.
