So many loved ones were torn from their families and partners. Some of the committed couples that were torn apart were not married. These include heterosexual and homosexual couples who were making a life together. It is not the place of the September 11th Fund to judge the victims of September 11th, nor to play favorites. You have shown great moral courage in offering compensation to illegal immigrants, the least you can do is show the same grace towards citizens who also lost their life partners, but happened not to be married to them. Your purpose should be to help those most in need. People whose life partners were killed on September 11th have been greatly traumatized and lost family income they depended on. Because of prejudicial laws they may even lose their homes or other assets and be even more financially devastated by the loss of their life partner than those who were married. Tell me, when Americans responded to September 11th with a flood of donations, did all those checks come in the charities with notes saying "restrict these funds to heterosexual and married victims"? No, because donors wanted to help those who needed help, regardless of their personal characteristics. Did the passengers on flight refuse his heroic efforts because he was homosexual? No, people should be judged on their actions, not on their life partners. Do we restrict the privileges and responsibilities of citizenship to heterosexual married people only? No, our nation is strong due to a rich, diverse society of contributers who are both single and married, heterosexual and homosexual. I have serious concern that the good intention of Congress in approving the Victim Compensation Fund of 2001 to assist the families of the victims and also cap the liabilities of the airlines may be of little financial help to my daughter and her family. In particular, I am asking your help to correct two inequities in the department of Justice's Interim Final Rule for the September 11th Victim Compensation Fund of 2001 that will result in many families receiving no compensation from the fund. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source". When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims' right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue. Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.I} "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims' families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economist at the National Association of Forensic Economist showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economist showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimates, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more that 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congress's goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependant is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harm's way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral source, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safely and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over on hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projection. The economic loss charts need to be increased and expanded depending upon the deceased's job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victims families to participate in the Fund. Without these changes, it will be better for many victim families to take a change at litigation rather that sign on in a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non- economic amounts at fair, balance and acceptable levels: do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally, please include the specific calculation formulas, statistics and assumptions within the rule of the explanatory materials. Thursday, January 17, 2002 2:39 PM Comments on the Interim Final Reprt A COMPROMISE POSITION ON COMPENSATION PAYMENTS TO VICTIMS OF THE SEPTEMBER 11TH TERRORIST ATTACK. It is time for the Special Master, Mr. Kenneth Feinberg, to realize that he seriously erred in presenting his first proposals for compensation to victims of the September 11th terrorist attacks. Both his methodology and the resultant payments from the Victims Compensation Fund have been severely criticized from a number of quarters. Mr. Feinberg, in a statement shortly after the release of the Interim Final Report recognized the depth of controversy and attempted to reverse several positions taken in the report. In any compromise both sides must be willing to enter into negotiations with the view of getting less that they would like. The main purpose of the law passed by Congress which created the September 11th Victim's Compensation Fund was to protect the airlines and other organizations from law suits which could seriously cripple them financially. Thus the law proposed what appeared on first reading to be a quick, fair and compassionate solution for the families of the victims. In return, the victims would avoid prolonged legal battles that might produce much greater financial rewards for them. It is abundantly clear that the families of victims do not view the Interim Final Report as either being fair or generous. For many, if not most, there is no compensation payable, and hence the lengthy legal battles through the court system is an obviously better solution. There is no benefit to being told in 120 days that you will receive nothing; better to try you luck in court and keep hope alive. It is therefore clear that the Rules on providing compensation must be immediately amended if Congress and the Administration expect families to sign on to its provisions. I therefore respectfully suggest the following amendments to the Interim Final Report as providing some likelihood that this might be accomplished. 1. The non-economic losses must be increased to $500,000 and be removed (as the law allows) from diminishment by offsets. This would guarantee all families this amount, and would give truth to Mr. Feinberg's statement that "families would receive between $500,000 and $3,000,000 from the Fund." Families of victims who feel that this amount is inadequate could still resort to the appeal process provided by the rules of the Fund. 2. The salary calculation used to establish lifetime earnings should reflect the BETTER of the salary earned at the time up death, or the AVERAGE of the victim's best three consecutive salary years. This would reflect the reality of the earning potential of many of the victims who were in very upwardly mobile positions. It would help address the criticism that the methodology used to determine lifetime earnings is seriously flawed. At the same time, the Special Master must address the question of salaries above the 98th percentile by determining what proportion of victims was actually in this category. Indeed, it might be necessary to consider a high percentile. 3. Insurance benefits received from policies PAID FOR by the employee should be removed from offset calculations. The same should apply to other employee paid benefits including pensions and retirement plans, for the Interim Report is penalizing victims who showed family responsibility in the conduct of their fiscal affairs. By contrast, it rewards those who followed a less prudent fiscal course, and this reward is made at government expense. Congress, and the Executive Branch, through the rules formulated by the Special Master, Kenneth Feinberg, must make every effort to make good on it promise to honor the victims of this cruel attack on America by showing compassion and generosity to the families of the victims. It is adamant that the rules proposed in the Interim Final Report of the Special Master be modified to allow this to happen. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
