Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sunday, March 17, 2002 5:23 PM Benefits of 9/11 survivors As a contributor to the 9/11 survivors fund, it disturbs me greatly to learn that Kenneth Feinberg, Head of the September 11th Victim Compensation Fund has determined that "gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones." I made my contribution with no strings attached and firmly believe that distribution of those funds should also be made without strings attached. To refuse to provide help to anyone because of sexual orientation is blatant discrimination. These people need help just as much as anyone else and I emphatically request that the response to requests for help be based on the civil rights of the persons involved and not on the sexual orientation of those persons. Monday, November 19, 2001 8:31 AM (no subject) Dear Mr. Zwik: As a close personal friend of more than one family that lost loved ones at the World Trade Center disaster on September 11th, I am writing in the hopes that a fair and equitable solution to this tragedy can be accomplished and include the following in this solution: 1. Do not reduce the award from any collateral source funds collected, including insurance, pension benefits, death benefits, and governmental payments (which we understand are being considered as offsets). Such offsets would penalize those victims who sacrificed and saved for their families' futures. In a nutshell, these assets have nothing to do with the damages that flowed from 9/11 and, therefore, there should be no offset to damages based on the net worth of the victims' families. It would also result in awarding more in damages to those who did not sacrifice and save for their families' futures, which would be an inequitable result. 2. Provide the victims' families with the right to appeal the award, as doing so would undoubtedly increase participation in the Fund. 3. Should the Department of Justice decline to offer victims' families the right to appeal, then at a minimum they should have input regarding the selection of the mediator who would decide the award. The government should provide a list of potential mediators with their background (e.g., educational, work experience, prior award history, etc.), which would allow victims' families to make an informed choice. 4. There should be set parameters for calculating damages (i.e., mathematical formula factoring lost future earnings, pension benefits, number of children, and other pecuniary benefits that would have been earned taking into consideration life expectancy tables), that would provide a floor for calculating damages and provide assurance to victims' families as to what they could expect to receive, at a minimum, if they elected to opt into the Fund. In short, the victims' families should be able to calculate, with some certainty, the minimum amount of money they could expect to be awarded prior to participating in the hearing. That should serve as a powerful inducement to opt into the Fund. 5. Determine pain and suffering at the hearing. 6. If the mediator deviates from the guidelines, the victims' families should be able to appeal the decision. 7. The amount awarded as damages should include all funeral, burial, and estate administration expenses incurred. Importantly, the amount should compensate the victims' family for contributions they would have received between the time of his/her death and the end of this life expectancy, such as future lost wages. His/her gross earnings, including all fringe benefits between the date of his/her death and his/her life expectancy, must be factored in. Additionally, all monies the victim would have spent for or given to his/her family for such items as shelter, food, clothing, medical, car, education, entertainment, gifts and recreation, taking into account his/her salary and age, must also be considered. The amount awarded should also consider the comfort and friendship that he/she would have given to his/her family had he/she lived and such other elements as work around the home and provision of society and comfort. 8. Since the amount awarded would be intended to restore the victim's family's loss, it should not be considered as "income." Therefore, it should not be taxable by the federal or state taxing authorities. In closing, I understand that the DOJ is suggesting that the victims' families surrender their right to sue without advising them what they can anticipate by way of award and without the ability to appeal such award. This is unacceptable. The above suggestions would encourage attorneys and families alike to opt into the Fund, thereby foregoing their right to sue. I am certain you will have much pressure placed on you regarding the "moral" tone you establish by either withholding such awards or face very vocal opposition should you decide that in all fairness couples deprived of the right to marry still had relationships worthy of financial recognition. One of the miracles of those dark days after the tragedy was that people only saw heroes among the police, firefighters and office workers that lost their lives in the World Trade Center. Few cared about the difference in color of skin, religion, job or sexual orientation. We were all Americans grieving the untimely murder of our fellow Americans. As you go about this great task of disbursing the "September 11 Victim Compensation Fund," I hope you will keep that generous spirit alive and treat surviving partners of gay and lesbian couples with the same dignity and respect as those who enjoyed the priviledge of legal marriage. Nothing will replace the love these people lost, nothing will restore the hope and optimism with which they faced the future. Of course there will need to be clear standards for proving the couples lived in committed long-term relationships -- but many of them will have wills, joint deeds to property, named in durable powers of attorney, were named as beneficiaries to pension funds, etc. The relationships of these couples were denied the basic recognition available to their heterosexual peers -- but still they went on loving and building lives together. Ultimately they created families -- households of people committed to the welfare of each other. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. The devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. To be eligible, you must have received medical treatment within 24 hours and you must have been hospitalized or suffered disability or disfigurement. By stating in your question that the hypothetic victim "did not suffer a bodily injury", you did not really pose a question, at least not a useful question. By definition, if the victim did not suffer bodily harm, s/he is not entitled to compensation under this Law. This hypothetic that you posed is useless. However, it manages to confuse the public as well. You go on this question to state that the hypothetic victim inhaled smoke and dust. By definition of the law, if the smoke and dust did not provoke bodily injury, the victim must receive no compensation. Yet, you must seriously guide and educate the victims. Members of our group, among other perhaps, had prior conditions including heart surgery and ailments, and respiratory diseases from asthma to asbestosis in different degrees. Properly cared, they lived useful normal lives. The inhalation of the dust (smoke is an euphemism under these circumstances as it was not produced solely by combustion) provoked medically diagnosed physical injury in some of these persons. Serious damage flowed. The dust produced by the air crashes and collapse of the buildings at the World Trade Center was composed of ground-up mortar, polyvynils, polychlorinates, PVCs, asbestos, incinerated bodies and human bones and other solid particles, toxic and poisonous inside the chest cavities of the victims. Scientists and doctors agree that-depending on the prior condition of the person-this dust produces the physical harm of which some members in our group suffer after 9-11. The statute under which you labor- Public Law 107-42- states, in relevant part, that a person is eligible for the compensation under the law if two conditions are met: that the person "(i) was present at the World Trade Center..." and "(ii) suffered physical harm or death as a result of such an air crash." Physical harm produced by this black dust is not excluded in this text. You saluted this law as "an unprecedented expression of compassion on the part of the American people to the victims and their families..." Your introduction to the interim final rule acknowledges receiving comments from many organizations. Notably, you do not mention any medical and scientific basis. Medical scientific and psychiatric associations are in agreement that "physical harm" can not be defined by what produced the physical injury. Each human being is different. The federal medical institutions- from Center for Diseases Control to NIOSH to the US Department of Health agree that respiratory and heart diseases are physical harm. Over 100 WTC victims and their families integrate the Hispanic Victims' Self-Help Group. Some of them suffered physical harm from ingesting dust(or as you seem to be calling it, inhaling smoke). Please make a question and answer that defines clearly your policy so that the victims are treated with dignity and compassion.
