Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I do believe that ALL--including "aliens"--should be helped through this tragedy. Yet Ashcroft's policy clearly discriminates against those whom he feels are less worthy. I am truly embarassed to consider myself an American when I was informed of the DOJ's ruling on the 9/11 Compensation Fund to exclude gays/lesbians/transgendered individuals. Even worse, the fund SUPPORTS ILLEGAL aliens. It is hypocrisy and a direct assalt on the very core of the Declaration of Independence and our American committment to true JUSTICE that families of loving, legally employed individuals would be excluded and that illegal residents be included. Were the Afghanistan government to do the same to some of the many minority tribes there would the US Government not be outraged? Are we not protecting the Kurds in Iraq from a similar fate with a no-fly zone? Have we not worked diligently to try to bring together Catholic and Protestant factions in Northern Ireland to avoid factionalization and violence? Aren't we attempting to reduce the conflict between Indian Hindus and Pakistani Muslims? Wasn't any lesson learned from the genocide in the former Yugoslavia republic? Doesn't this action just support the same strife in our own country? Truly, if this decision was based on fear of law suits, then the DOJ is becoming an instrument of evil by dismissing the protection of ALL American citizens to meet the desires of the majority in power. I guess the next logical step would be requiring individuals to register as a minority so you can REALLY know who you are dealing with. Sirs, I believe that by excluding gay and lesbian individuals from the same benefits as all other couples is inherently wrong. Please change your policy. I could serve as an example of a spouse in a committed 18-year relationship. If you'd like to learn about reality and discrimination, I could serve to educate you or your associates. Please let me know who I should speak with to address this wrong-headed, discriminatory policy. It is a catch 22 of fear-based individuals to justify discrimination on out-dated religious-based laws. If there is to be a separation of church and state, we must address it where it harms individuals. This policy harms persons. Fortunately, they were all able to make it out of the building, and my partner, through a stroke of good fortune, was not there. However, had she been there and had she been among those killed, I would right now be losing my home, and struggling to find a way to support our child on one salary because we are a lesbian couple. Your discrimination hiding behind the shortcomings of state laws goes against the equality the United States Constitution strives to bring all its citizens. Granting compensation to illegal aliens and their families who were victimized in the attacks is right and just. The fact that you are willing to overlook federal laws while helping aliens runs counter to your standing on state law to avoid paying a select group. I hope you will look at your current policy and correct the inequality that exists. Please make sure that ALL affected families and households receive the assistance they need to cope with this terrorist attack, whether the household was counting on the income of a brother or sister, an opposite-sex but unmarried partner, or a same-sex partner. Fair rules can be devised for assisting all families and households who were directly affected by this terrorist attack. Please don't use this as an opportunity to cut out or further marginalize people whose loss and grief is no less real because they are not heterosexual. I know how divisive issues of sexual orientation still are in this country; I am under no illusion that you aren't being besieged by calls from the Christian Right to prop up the "traditional family." But please, do the right thing and treat same-sex partners with the same care, concern, compassion, and fairness as all the other victims of the terrorist attacks. This is no time to further punish those who are already suffering so terribly.
