Tuesday, November 06, 2001 11:59 AM victims compensation If it is possible to find a way to limit the time/complications of keeping track of charitable contributions (perhaps by the major funds working with the government assistance), it seems reasonable to consider charity accepted in how much is given from federal funds. The families of the victims certainly deserve help and assistance to survive. It is not appropriate that they be made wealthy from this tragedy. The people who gave contributions did not expect "double dipping" any more than they expected "to help ... the government's balance sheet" (NY Times, 11-6-01). Should the cost of the assistance run so high as to seriously hamper the US government's ability to fund it's usual expenses, it will rapidly become everyone's problem. Wednesday, April 03, 2002 7:51 AM 9/11 fund I've recently read an article through the internet that said that the Sept. 11th fund would not support partners of homosexuals who lost their lives on this tragic day, although the families of illegal aliens would be supported. I think it's terrible that we live in a country with so many rights and freedoms, but condemn people simply because of their sexual preference. I think it's time we recognize homosexuals as equals in our society and give them rights as couples and stop treating them as freaks of nature. I am not homosexual but i do have friends who are and they are very decent and upstanding citizens of this country. It's very sad when I hear that someone who risked and then gave his life to save the lives of others ( ) cannot be rewarded through his life-mate just because of his sexual preference. I hope this country soon wakes up and listens to people and stops trying to put everyone into a certain mold. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. This Fund was enacted as a part of a comprehensive package which bailed out the airline industry and imposed restrictions on the rights of the victims relatives to recover damages from the court. We implore you to change the interim rules you previously issued. As it stands the rules fail to satisfy the letter or spirit of the legislation, which was enacted. Specifically, we request that you make the following changes to the interim rules: 1. Remove arbitrary income limits The arbitrary income limits you had imposed are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. they were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial Capital of the World, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American business and commerce, democracy and freedom. We ask that you lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic awards You have arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King:"Every death is tragic. But to have your loved one murdered in a burning building in full view of the world-in scene that will be repeated in the media for decades to come-is a horror these families will never escape from. You cannot take it upon yourself to restrict the rights of families. My compassion goes out to the victims, but I do not think it is the role of the U.S. government to assume liability. Is the death of someone in the Twin Towers any different from say the child killed in Oakland, California, last week when an illegal alien ploughed into a group of children in a crosswalk? To me both are acts of terrorism resulting from the U.S. government failing to enforce our borders. With regards to compensation for illegal immigrant victims of Sept. 11th I find it offensive to even consider it. Why should I as an American be rewarding - even in their death - lawbreakers? The Interim Final Rule provides little incentive to participate in the Fund because it seriously understates our losses and undervalues the compensation for those losses. Consequently, the Interim Final Rule will defeat the intent of Public Law 107-42. When Congress passed the Air Transportation Safety And System Stabilization Act on September 22, 2001, it severely restricted our right to sue the airlines, which bear responsibility for our loved one's deaths because of lax security procedures. In exchange for denying Family Members this right, they provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit. This includes economic losses, such as lost income, and non-economic losses. Non economic losses described in the law are very broad and inclusive. They are described as losses for: physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium, hedonic damages, injury to reputation, and all other nonpecuniary losses of any kind or nature. The Interim Rule/Regulation also describes the intention of the law: - The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. - The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule issued by the Department of Justice (DOJ) falls far short of these stated goals and does not comply with the statute passed by Congress: a) Under the Interim Final Rule, noneconomic losses are limited to $250,000 for my wife and $50,000 for my daughter and myself. My family would receive only one-tenth the amount of noneconomic losses recovered in other air crash and terrorism cases, which commonly result in awards well into the seven-figure range. b) The Interim Final Rule understates economic losses: It underestimates the lifetime earning potential of victims at all income levels. Independent economists have shown the interim final rule uses outdated and inapplicable work-life and life-cycle earnings data from tables including the 1979 to 1980 Department of Labor's Bulletin 2254. This seriously underestimates promotions, work-life and pay increases and consequently provides low estimates of my wife's future earnings. In addition, the Interim Final Rule does not allow for the recovery of lost household services, which for working women with children would range to $430,000. Finally, it caps the salaries of high-income victims. Because the initial award amounts are so low, many families will receive little compensation from the Fund after the collateral payment deductions have been subtracted. The law requires the subtraction of earned pension funds and personal life insurance payments before a payment from the Victim Compensation Fund can be made. The initial low award amounts combined with collateral payment deductions will create a situation where there is little reason to participate. To compound the unfairness, my family would have little real opportunity to appeal the determination of the Fund Master. A family's award may be increased above the "presumptive" award only by showing "extraordinary circumstances" beyond those suffered by other victims or victims' families. This makes the hearing or appeal to the Special Master extremely arbitrary, unclear and unfair. In addition the proposed compensation to the spouses, children and other innocent victims of the attacks is out of balance when compared to the generous compensation to the airlines. Not only did the law cap the airlines' liability at the limits of their insurance (which saves the airlines billions of dollars), but it also provides for direct cash payments and loan guarantees to the airlines totaling $15 billion. The underpayments to the spouses, children and other loved ones suffering from this attack will shift the cost of these airline subsidies and liability limits to the innocent victims of the attacks. Please correct the inequity. Please give us a reason to participate in the Fund. Zwick - Director, I am writing to express my deep disappointment in the government's decision to exclude certain American citizens from compensation and support following the attacks on our country. The 9/11 Fund, created by Congress, would do more to honor our lost countrymen and their families if the Fund were to include all Americans in its mission. I understand that our society's bigotry toward gay-Americans is rooted in deeply held religious beliefs. Religious beliefs which teach that homosexuality is somehow immoral in the eyes of God. However, our Constitution explicity states that government policy should not be determined by or contingent upon the establishment of a state religion. There is to be a separation of church and state. Christian Americans have every right to believe what they will about homosexuality and homosexual-Americans. They do not, however, have the right to steer government policy based on those beliefs. Especially not when time and time again, policy has been steered toward discrimination and hatred. I would remind you, Sir, that Christian beliefs and Scriptures were once used to defend the institution of slavery. Christians once pointed out passages from Scripture which were believed to mean that blacks were somehow divinely mandated to be slaves. Much as modern Christians point out passages that are believed to mean that homosexuality is immoral. I am quite sure you will agree with me that slavery was a deplorable institution. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
