Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. My son, , was murdered on September 11, 2001. He went to work and never returned. He was where he was supposed to be, on the floor of Two World Trade Center, doing what he was supposed to be doing. He was 28 years old, single, no children, engaged to be married on June 8, 2002. His life along with the thousands of other extraordinary, remarkable, tax paying people who were murdered with him are worth a great deal to those they left behind. Children will never know their parent, parents will never hold their children again, brothers and sisters will never laugh with their sibling again, and fiancés will not walk down the aisle with the one they choose to spend their life with. It is quite apparent when one reads the interim final rules set by you and others (Office of Management and Budget) that you did not lose anyone in this horrible terrorist attack on this country. Ive heard quoted that you do not want to play Solomon. Believe me, Solomon would have shown the proper respect for the victims and their families. This is insulting to all of the courageous men and women who made the ultimate sacrifice on September 11, 2001. Be assured that every family I know who lost a loved one would give back every cent they have received and more to have their loved one back again. Would you trade places with me, or any of the thousands of families who grieve for loved ones? Would you sacrifice a son or a daughter and accept the rules you have set? I know you would not. I am a parent living with this every day, and I am quite sure no sane person would choose to walk in my shoes, and then have the government they love cheapen the life of the victims of this horrendous tragedy by clinging to bureaucratic nonsensical statutes. The act originally passed by Congress insures full and fair compensation to victims and their families for actual economic and non-economic damages. The Department of Justice has ignored this mandate and arbitrarily altered regulations resulting in compensation levels far below the losses actual suffered, by victims and their families. The award for non-economic damages is one-tenth below the level paid in comparable cases. Congress was explicit with a broad range of non-economic damages for which victims and their families shall be compensated. DOJ ignored this basing presumed awards on bean counting, severely limiting awards with no basis in law. The non-economic award should be increased by an order of magnitude from 10% to 100% to reflect damages Congress has determined are compensable. For Economic Damages, DOJ relied on out of date and inapplicable data. A wide gap exists between DOJs flawed approach and a proper evaluation of economic loss. DOJ should correct methodological flaws in its calculation of economic damages and use up to date data in making these calculations. Consider the likely income-earning potential of the victim as is routinely done in wrongful death cases. DOJ should eliminate the statute, which deducts collateral source deductions (pensions, insurance payments, and charitable gifts). A familys award may be increased above the presumptive award only by showing "extraordinary circumstances" beyond those suffered by other victim or victims familys. This makes a charade of the right to a hearing provided by the statute. DOJ should fulfill its responsibility to carry out the wishes of Congress and the people of the Unites States of America. If the statutes are not significantly changed many families who had anticipated relief would be forced to sue. This was not the outcome Congress originally intended. The victims who were injured and the families of those murdered are reminded every day of the horror of September 11, 2001. Many of us continue to wait for the knock on our door, informing us that our loved one has been identified. Many of us may never receive that knock. The pain has little time to quietly heal as we are reminded every day via the media. We do not need the pain of fighting bureaucratic battles, which can be remedied by fair and just corrections. Re the Question of Whether Families Should Receive Government Assistance Based on What May Have Already Been Given by Charities: One should have no impact on the other. The families should receive fair and equitable assistance from the government regardless of what they may have already received from charities. What little is being doled out by charities was received directly from the public who wanted to give their own money to help. One should have no impact on the other. If you're taking comments through December, what the government may or may not give is far from "emergency" assistance. 2. Re the Red Cross 9/11 Fund: The only person I have witnessed to even be remotely interested in what appears to be the outright fraud being perpetuated by the Red Cross is the guy on the O'Reilley Factor on FoxNews. He said last night that the Red Cross had $546 Million in the 9/11 Fund, but were only distributing $100 Million to the families. The remainder is being converted solely to the benefit of the Red Cross, used for payroll and administrative expenses. This is a ratio of 20% to families, and a staggering 80% to administrative expenses of the Red Cross. If a member of the public, or a government official/agency did this, it would result in criminal charges. Why is the Justice Dept. allowing them to get away with this? The American public gave generously to the 9/11 Fund so that the full amount, not 20%, would be given to the families. School children in low income neighborhoods held penny drives. Many persons sacrificed and shared what little they had so that the 9/11 families would receive assistance. I read in the Washington Post that the 9/11 Fund had reached $1.6 Billion. Where did the remainder of this Fund go since the Red Cross is now claiming to have only $546 Million? Why has no government agency, the Justice Department, nor anyone on Capitol Hill pursued this problem? Wednesday, January 16, 2002 6:24 PM Interim Rules - Victims' Compensation Fund Dear Mr. Zwick: In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"every death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape from. The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die. Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families. There should be no compromise about that ever." We request that the interim rules be amended and that compensation for pain and suffering more accurately reflect that horror which was suffered. Justice demands no less. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Wednesday, November 07, 2001 2:53 PM VICTIMS FUND I do not think the govt.should be doing this when the public has already given so much to the different charities. Those who died on the job will have Workman's Comp coming in the picture and Social Security survivor benefits for surviving children and widows. In other words, there are already programs in effect to take care of these families. No such govt. program came into existence when the Oklahoma City Federal Bldg was bombed so I am unclear as to why it is felt that there should now be a program for this tragedy. With the govt programs already in place and with the extra over one billion sent in to the different charities, I do not see why another program should come into the picture. If it is present, then definitely the other program monies given out should be considered before anymore government money is paid. Taxpayers have paid enough into the different govt. funds and again in their charitable contributions. Thank you for giving the public the right to respond. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Kenneth Feinberg Department of Justice Washington, DC 205 March 13, 2002 Dear Mr. Feinberg, Your position on compensation of gay victims of the 9/11/02 tragedy is a travesty. You have implied that if state law discriminates against gay people, then so will you and the 911 Fund. The problem for gay Americans who lost loved ones on 9/11 is that most states do not legally recognize gay relationships, and the very few that do tend to do so only for state employees, not for citizens at large. And while a handful of cities do in fact recognize such relationships, under your formula, its's the state law that counts, not the city's. So in the end, pretty much everyone who died - including people who aren't American citizens and were living in the US illegally - will be honored by the 911 Fund as deserving of American's special recognition and thanks. The sole exception will be gay and lesbian Americans, because you and t he 911 Fund wouldn't want to do anything contrary to US law. On the six-month anniversary of the attacks on the World Trade Center and the Pentagon, you and the 911 Fund are telling the American people that regardless of whether a gay man was one of the four heroes on United Flight 93 who saved US Congress and the White House from utter annihilation, the 911 Fund plans to discriminate against an America hero ( ) because most of the country sanctioned such discrimination prior to September 11th. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. It would be ironic if the generosity of so many Americans in giving to the 911 Fund were used to further divide us as a people, and send the message to all that some American heroes are more equal than others. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Thursday, December 20, 2001 12:03 AM Equal Aid to ALL Families of terrorism victims December 20, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
