We were together for 10 years in which time we planned for a future that never came. We were to be married on May 18th of this year. Mr. Zwick, I have lost my life partner. Additionally, I have no legal entitlement to compensation that might at the very least provide me with some future financial security. The Victims Compensation Fund, which had been established, with Federal funds, was set up to financially compensate victim's family members. As I understand there is only one application per victim which presents a problem for fiancees and domestic partners. In all fairness if the fiancees/domestic partner are going to be denied the opportunity to apply for the Victims Compensation Fund on our own, it should be determined how the settlement should be divided when there is a fiancee/domestic partner involved. It is very difficult to discuss these financial matters with the family and it might be helpful if there are distribution regulations set to protect people in these situations. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. My compassion knows no bounds, but that stated, I feel (along with literally everyone I know) that the compensation package is extremely generous. The families left behind that will get 'little' from the fund did the right thing -- they planned for the future, and were not living beyond their means to begin with, like so many families seemed to be. The media states nightly the American public wants to 'take care of these families'. I'm baffled. 'We' never expected or want wheelbarrels of money dumped on their front lawn, at our expense. I am both sad and insulted at the same time. Private charities are still paying their bills, they will eventually get additional compensation from the charities, and all of this is tax free. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Minimum Payment - There should be a minimum payment that would go out to all victims' families, regardless of offsets, to encourage more people to participate in the fund. 2. Consistency - All victims families should be treated in a consistent manner. That includes high income victims, who are on the outer part of the chart (that does not include me,by the way). Awards for economic loss, according to your established formulas should be extended out to the victims beyond the $231,000 annual income level. 3. Rolling 3 year income average - As I understand it, the income chart is based on the 3 year average of 1998, 1999, and 2000. This is wrong. It should be for 1999, 2000, and annualized 2001. That is more current information to use. My daughter, who was in WTC tower #1, had just changed jobs in March and started at &nbsp&nbsp&nbsp&nbsp at a 1/3 higher base salary than her previous job. That must be included in consideration for economic loss. She lost her future income starting at that base, not on the smaller base that she earned the previous years. It would unfairly penalize us and ignore the true economic loss. 4. Partnership voluntary distributions - Programs such as &nbsp&nbsp&nbsp&nbsp commitment to voluntarily contribute 25% of profits to the families of the victims from their company, should not be used as offsets to the award. 5. Non-economic loss - The $250,000 figure used across-the-board, is laughably low. Remember, these awards were meant to be in line with tort awards, to encourage families to participate in the fund, rather than file lawsuits. In general, it seems as though the original intent to give victims families sufficient compensation and incentive participate in the plan and stay away from costly law suits to insurance companies, airlines and security companies, has been lost in a political morass. Keep your eyes on the original goal and intent of the fund. Economic loss is valid and should be calculated consistently, without regard to what the ultimate figure becomes for a family. Unfortunately, the concept of compensation of victims to avoid lawsuits, has given way to politically oriented "cost control". Thank you for your consideration. Saturday, January 26, 2002 8:47 PM Greedy!! I am so disappointed with the outlandish greed shown by every one of the WTC victims' families. I cannot believe that they seem to whine and cry,not about their loss; but EXPECT all to pour money into their coffers. This is outrageous! They do NOT deserve anything more than any number of us that face the loss of a loved one. It was a horrible, horrible thing that happened that day; but...sure did show the worst in the ones left behind. They can't have had time to grieve, as all their thoughts have been on the almighty $ signs. I lost my Police Officer husband in 1968, leaving me with 4 little ones. I never expected anyone to...bail us out. We had insurance, and though it was just what we could afford, we made it. Noone wanted to make sure that my children got a college education, (who knows how many would have if things would have been different?) house payments, etc. We survived with social security for each child, as they will receive, and just being strong and working to move forward, and we did. Where is the back bone of these people. I will tell you where...our President came forward and promised that all us other taxpayers would be happy to hand them money, and then....tax exemption for 2 years. This is abominable!!! These people need to be focusing on helping their children thru this loss, and not thru money. I just don't know how to say all I feel, but certainly hope you get the idea.
