I gather that the law will not be the determining factor in whether partners of illegal aliens receive compensation from the 9/11 fund, and that they will not be subject to prosecution or deportation if they make claims. I applaud that policy. At the same time, you have said that state law will determine whether or not gay partners receive compensation. Considering what those state laws tend to be, this double standard sends a powerful message. Are gay and lesbian individuals and their children unworthy of compassion or care? He worked for and was on the floor of WTC #1 when it was hit by the first jet. He leaves behind a wonderful wife, and a beautiful daughter. age 5, had just started kindergarten the week before the attack. was God-father to my daughter. He was a good and decent person. My whole family is still in shock and grieving. I think as a country we are all still in shock and grieving. I just wanted to make a few comments about the the Victims Compensation fund. I understand that the fund was set up pursuant to Federal Legislation and substantive changes to the rules must be authorized by Congress. I believe the US DOJ should ask Congress for the Following changes to the fund's rules. 1) There should not be a deduction on any award for the amount of life insurance a decedent had at the time of his or her death. Under New York law the amount of life insurance would not be credited against a judgment a plaintiff would receive in a civil wrongful death action. In the alternative, a deduction for life insurance should not apply for life insurance policies below a substantial Dollar amount. The rule the fund has set up to deduct life insurance payments for any possible award under the fund works to penalize those individuals who had the foresight to acquire life insurance. In my brother case he did have foresight and had life insurance in the amount of just under $1,000,000.00. Although this may seem like a lot of money, for and it will not be enough to stay in their house and provide for their needs for the rest of their lives. Further, if one of the major goals of the fund was to avoid private litigation in the SDNY then the rule which will deduct life insurance payments from awards under the fund makes no sense. It makes no sense because there is no incentive to choose the fund over litigation where the fund's rules will make life insurance payment deductions on awards and render any award under the fund financially meaningless. Given this scenario, the great majority of claimants will choose litigation(with all its pit falls and time) over the fund because they will have nothing to lose. I believe this is the major reason that only 70 or so claims have been filed under the fund to date. 2) Any possible award under the fund should not deduct social security payments. Social security payments would not be deducted from a civil money judgment in New York. The decedents paid into the social security system during their entire working careers and to deduct these payments out of a possible award given under the fund is not fair or equitable. 3) When determining loss wages and income the local New York standard of income should be used as opposed to the National average. It would simply be unfair and inequitable to use a standard that is well below the income levels these decedents in fact earned during their life times. As an American and as an attorney I understand the great responsibility of the numerous jobs and functions of the US DOJ. I can understand that the antitrust case against Microsoft was important as well as the residency status of an 8 year old Cuban boy in Florida. But after 9/11 can anyone doubt that the most important thing to do is to protect our citizens and our country. I request that The US DOJ take all necessary steps towards that end. It is not difficult to predict that some of these viewers will engage in identification theft, make harassing calls, or even break in the homes of the victims. Those families already are qualified for government payments in the form of Social Security and other such payments. Tragedies happen across this nation every day that leave families without breadwinners and money to pay their debts. That is just a part of life. The government does not rush in to help those in desperate need. Those associated with the WTC event are no different. The money you propose to give those select individuals belongs to the people of this country. We have worked and sacraficed to pay 'tribute' to a government with profligate spending habits. It already gives money to so-called artists and others who are deemed more worthy to have it than those who earned it. Why is the government liable? Was it negligent in causing the destruction of the buildings? Were the airlines negligent in being hijacked? Are the insurance companies lliable for a deliberate act of destruction? It seems the only ones who need to make restitution are the ones who deliberately caused the destruction. If any payments are made, make it from their funds -- not the money of the People. Donations of hundreds of millions of dollars have been given for this tragedy. Use that, and keep records so that the money is dispensed judiciously and equitably. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. The decision certainly isn't very American. In many ways I have been impressed with President Bush's and the country's response to the terrorist attack. However, this one act of fundamentalism and hate by our own government in blatant disregard for the lives of upstanding and even heroric American citizens overshadows anything good that the country as done since September 11. I am sad that our government has not risen to the occassion. While I have faith in most Americans, my faith in her leadership has been put to rest by this one act of callousness by the fundamentalist regime that was elected to uphold her ideals. There is no doubt that this rule determining who is eligible for compensation is motivated by hate. If the Executive branch truley were worried about upholding the law, it would not ignore all immigration laws or state laws that might apply. My only hope is that the country will recognize the value of all her citizens. If she does, then the current fundamentalist regime will be limited. We will be lucky if the division and damage done by the current leadership can be overcome by a more compassionate and just President in the future. Our widowed sister, , who lives in New Jersey, is survived by (2) sons, one of which is still in college. Under the current criteria there will be no compensation for our sister based on the current presumptive guidelines for the Victims of the Compensation Fund. We are asking you to please intervene by contacting the Special Master, Mr. Feinberg, who will be making a decision as to weather he will change the current guidelines, which we believe are very unjust and fair. It is our understanding that Mr. Feinberg's determination will be final. Please keep in mind that he is the person who presumably established the presumptive guidelines. The guidelines state that our sister has not suffered any loss. We are prtoesting the existing guidelines; especially the cap set on income of $231,000. Mr. Feinberg is scheduled to make his decision on January 21, 2002 in New York City. However, since Monday is a holiday, we are not certain if officals will be meeting.
