Wednesday, January 09, 2002 11:18 AM compassion has Limits I'm sorry but I find myself desperate to express what is certainly to be a very unpopular opinion but the idea of creating multi-millionaires because of the tragedy that befell people on 9/11 is outrageous to me. I certainly believe that these families should have some assistance to get their lives back together, to move on with their life and re-establish themselves but it doesn't require millions of dollars of taxpayer money in addition to corporate money from insurance companies and relief organizations. It perpetuates the growing assumption that Americans should be financially protected from any negative or catastrophic event in their lives. It's an entitlement that's unrealistic and unfair. Although I admire their compassion, I believe that government representatives are not acting responsibly or in the best interest of the society as a whole or providing a meaningful service to the victims by throwing money at their feet. Wednesday, November 07, 2001 8:50 PM Victim Fund 9-11 My hope is that the fund is used wisely for immediate needs rather than to create 'millionaires' from the fund paid for by taxpayers with much less. It appears at this point that private fund-raising efforts have unlimited resources for compensation to victims in need, and public funds should be used to fill any gaps that surface. I hope that needs will be considered when distributing the monies, as many have other resources, such as workers' compensation, life insurance, disability benefits, and social security (to name a few). Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I have been in a relationship for over four years, and I find it very difficult to take the announcement that you are not going to treat with the same guidelines, compassion and consideration as other AMERICANS, those gay and lesbians affected directly by 9/11. They are just as much AMERICAN as anyone else. You may not agree with personal decisions, but overcoming evil and hate has to start at home with letting go of what is obviously not right just because of being different. America is made up all of differences in people. To hold on to one set of differences (treating gay and lesbians as less human or American) is only adding fuel to the fire in favor of those that attacked us on September 11th because of differences. You really should be ashamed. Someday we will have the same rights as every other American. But, someone has to stand up and face this fact and take a stance in the right direction in order to for this to progress further. Most everyone has someone in their family or knows of someone (friend, colleague, etc.) whom is gay or lesbian. Do you want them to be treated like this? This importantly should include the partners and children of same sex unions. They were not American citizens and were visitors in US. As victims' family member, I have two suggestions on the interim regulation of the September 11th Victim Compensation Fund of 2001. First, I think that the compensation for non-economic damages, should be raised from $250,000 to the similar level of the pain and suffering compensation for casualty in other plane crashes in recent years. In that case, most of the victims's families will choose this program rather than sue in the court. Second, this interim regulation did not specify how to calculate the economic loss of those legal foreign victims. Given the living standard , as well as the income and benefit, is quite different in foreign countries from that in the US, it is not fair to compute the economic compensation based on the exact amount of their income. In my opinion it will be more reasonable to analyze the percentile of their income in their own country and calculate the economic loss in the light of the income of the similar percentile in US. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I strongly urge the Department to draft regulations that ensure compensation is available to ALL victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. Many Americans lost their lives on September 11, each of whom left behind loved ones. I urge the Department to honor these bonds by treating the families of gay and lesbian victims as you would any other. Many couples who would have been wed were not allowed because of laws stating "man-woman" marriages only, and it isnt right to deny compensation because they are not wed. Please compensate homosexual couples the SAME way you will compensate heterosexual couples. Its not a special right that these homosexual couples want, its EQUAL rights. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
