I will comment in a separate communication regarding the substantive changes that need to be made to the Regulations issued last Friday in order for them to be legally consistent with the Act. Please note that my mother-in-law, &nbsp&nbsp&nbsp&nbsp , is one of the survivors. My father-in-law, &nbsp&nbsp&nbsp&nbsp , was killed by the terrorist operated plane that crashed into Tower 2. I am the family spokesperson on legal issues. On Saturday December 22nd, I read certain comments attributed to &nbsp&nbsp&nbsp&nbsp with utter disgust and shock. Coming just days before Christmas, &nbsp&nbsp&nbsp&nbsp may have been misquoted. Perhaps his comments were taken out of context. If so, then he needs to explain that. If not, then he owes all of the survivors a sincere apology. People are grieving and they are scared. &nbsp&nbsp&nbsp&nbsp comments hurt people personally. His comments also hurt the cause of thousands of people who may have no choice but to file lawsuits - since the Fund virtually guarantees them a recovery of $0. I write in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." I can not tell you what this lost has meant to me and our family. He was the person in the family who kept the family together...he loved going to family reunions. We were married for 15 years. took an early out package from five years ago to buy investment property....he was buying properties and renovating them. Friday, January 18, 2002 12:06 PM Victim Compensation Fund - Plight of Fiances As an attorney assisting a fiance of a victim of the tragedy, it has been frustrating to see the degree to which our legal systems do not give sufficient recognition to the real emotional and financial losses suffered by fiances of the victims. I found it useful to review the comments to these rules submitted by fiances and while I did not do a separate search for the comments of domestic partners I am sure those comments would be similar. It is remarkable to see how the plight of the fiances is repeated in story after story. It is essential that the Special Master find a way to recognize the reality of the losses suffered -- the emotional and financial dependency of fiances is real. Narrow interpretations of the law should not frustrate the real needs of the living victims. Assuming there is room in the present regulations for a fiance to make a submission to the Special Master and to seek a share of benefits that is appropriate to her circumstances, I am concerned that the regulations do not sufficiently make that clear. If it is not clear, many of the fiances (especially the unrepresented ones) will simply not avail themselves of the opportunity to make their claim and tell their story. Under Section 104.21 (e), it appears that "any third party having an interest in a claim brought by a Personal Representative may provide written statements or information regarding the Personal Representative's claim." Further, The Special Master must approve the Personal Representative's distribution plan and may override the regulations and state law in order to ensure that the distribution plan is appropriate (Section 104.52). But the limitation that the Special Master may direct the Personal Representative to distribute the award properly among "the victim's spouse, children, or other relatives" is too restrictive. Accordingly, the regulations should be amended to make it clearer that fiances (and others suffering direct harm) may make a submission and be considered a part of an appropriate distribution plan. This will advance the objective of the Special Master, as set forth in the first paragraph of his Statement, that the Act and the regulations "are designed to bring some measure of financial relief to those most devastated by the events of September 11." As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." I have read the letter that Congressman Marty Meehan sent to you on behalf of the victims. I couldn't voice my concerns and objections any better than he did in his letter. I urge you to strongly consider his objections and recommendations. Specifically I believe it is important to establish a substantial meaningful minimum that all victims will receive. The figure of $250,000 per person for non-economic damages is completely unacceptable and sends a statement to the victims that their losses are not valued in either a legal or humane way. I also want to voice my concern and bewilderment regarding why you have capped the incomes to be used in the calculations at $231,000. I have read and re-read the original bill and I can't find anything in it that required this type of cap on economic losses. I can only assume that this limit was set to appease those who object to the "government supporting these people." Those who have this view need to be reminded that this bill was put in place primarily to protect the airlines and secondarily to address the fact that the victims would have no recourse to sue for just compensation. Please do not give into this pressure of public opinion. All of these families are entitled to be compensated for the full extent of their economic and non-economic losses since they really have no other recourse at this point. I realize that you have a tremendously difficult job to do in balancing everyone's needs and concerns. However, I urge you to do the very best that you can on behalf of all the victims. That's it. No complicated formula based on past income or current bills, no taking into account life insurance to reduce the amount. We are equal under the law and should be equal in government compensation resulting from an attack on the nation. Some people may have a minor reduction in their standard of living -- but those are the very people that have assets and life insurance. The amount of money that is being given should ensure that they never fall into poverty, or even the middle class . And if the children of a dish washer at the Windows on the World have their standard of living improved, that is a tiny comfort for the loss they suffered. There is no way to adequately determine which life was more valuable than another. Just because someone had a higher income on Sept. 11th doesn't mean that he wouldn't have bankrupted a company in 10 years and cost millions their life savings or that the firefighter wouldn't have raised a child that would cure cancer some day or pulled 100 people out of a burning building -- or the other way around. This issue should not be tearing us apart. It should not even be a source of the tiniest friction. Every single person in this country would give whatever they had to the families of the people who lost their lives -- not only out of love and gratitude and grief but also as a symbol of defiance against the beasts who perpatrated this terrible action.
