Tuesday, January 22, 2002 10:54 AM comments to proposed rule This is in reference to your request for comments on the proposed rules for compensation for victims of September 11, 2001. This comment is directed at the requirement for a victim to have sought medical treatment within 24 hours in order to be considered injured. For the reasons set forth I believe this requirement is unjust and unrealistic. Many people, especially those who live outside the 5 boroughs, had difficulty even making it home within 24 hours. Most were in a state of shock. I live in a suburb and although I arrived home on the 11th I was in a state of shock. Although I had difficulty walking, I assumed that it was simply muscle strain from the exertion of running for my life. I called a doctor but was unable to get an appointment until Thursday. The fact that I should be denied benefits because I was unable to get an appointment until the next day is grossly unfair. I believe many people were in a similar situation. Most were too shocked to realize what was happening to them. Many physicians were called to duty at emergency rooms and unavailable for patients. Many people, such as myself, did not immediately recognize the extent of their injuries and did not think to go to the emergency room. I believe some people who had injuries that were not life threatening thought, as I did, that they should not clog the emergency room with those type of injuries. I was in 6 World Trade at the time of the incident and injured as a result. I have economic loss for which I will not be compensated. I would like to file a claim but would be barred by your proposed rule. We have recently heard that survivors of gay domestic partnerships will not be compensated in the same manner as other survivors. We must admit that we had grave reservations about the entire subject when we first heard of it - after all, other than employment and/or private insurance benefits, members of the armed services, others killed in similar circumstances, etc. do not receive special benefits paid for by the taxpayers. However, because we realized that if compensation were left to the insurance companies, and/or the airlines, they'd be put out of business automatically, causing grave financial consequences - AND, when we realized that there would be many folks who'd been put into untenable financial situations by the loss of their breadwinner, we agreed that it was fair and proper to create a taxpayer fund for the survivors - NOT because money can replace a loved one, but because money can make their future lives easier. However, as gay persons (with 49 years of faithful committment under our belts,) we are outraged to hear that survivors of gay partnerships (people who ARE NOT PERMITTED TO MARRY,) would be thrown to the whim of state law - thereby not ensuring that they'd be equally compensated - or compensated AT ALL. We remind you that gay tax revenues are being used for the fund; that there are gay family units which have been equally disrupted by the 9/11 tragedy (1/2 of the mortgage payment gone, 1/2 of the rent payment gone, 1/2 of financial obligation payment gone, etc.,) and that as much as we approve of the scheme to indemnify the heterosexual survivors, we strongly protest anything other than equal treatment for homosexual survivors! I have never sent out a press release and I am not sure if there are any procedures to follow so I ask for a little patience on this. The attached analysis was origionally written a few weeks ago and submitted to the Justice Department as part of the comment taking procedure. It has since been revised in light of the press conference yesterday and the release of the interim rules. If you would like to contact me I can be reached at: Individual Comment Brooklyn, NY ________________________________________________________________________September 11 Victim Compensation Fund- Revised An analysis of the actual legislation and regulations from the point of view of a potential claimant. On September 22nd, President George W. Bush signed into law the Airline Stabilization Act, providing for a bailout and protection to the airline industry effected by the terrorist attacks of September 11th. As part of this act, Congress included a provision called Title IV: The September 11 Victim Compensation Fund. Shortly after the passage of the Airline Stabilization Act, some media outlets mentioned that Congress did include a provision for compensating those who were physically injured or lost loved ones in the attack, but few of these sources have provided details of this provision, partly because of all it does not say. Only the barest outline of the actual plan was spelled out by the legislation, the rest to be created as regulations by the Justice Department and the Special Master for this fund. The Special Master is Kenneth Feinberg, selected by the Attorney General, and the decisions regarding the final regulations rest solely with him. The interim regulations for the Victims Compensation Fund were released December 20th. As part of the overall legislation, both United and American Airlines were protected from any legal damages incurred above the amount of their liability insurance, assumed to be about $3 Billion each. Similar wording has been inserted in the form of an amendment to the recently signed airline security legislation that would give the same protection (liability only to the limit of insurance coverage) to every other potential lawsuit target except for the airline security companies and Osama Bin Ladin himself. Those who wish to file suit against the airlines for property damage losses, business interruption, or costs associated with relocation and clean up, must all be adjudicated from this amount. After the insurance money is distributed, any and all further claimants are out of luck, and due to the legislative language regarding the government?s right to subrogate claims arising from the fund, this will happen very quickly. In short, if some one does decide to file suit against the airlines or anyone else, they have a 2 year window to collect a judgment before the pool of insurance liability proceeds are taken by the Federal Government. The legislation also makes it impossible to sue for punitive damages in the event of a court proceeding because under New York State law, insurance monies may never be used to pay for punitive damages. So, no matter what should be discovered during the course of the investigation and trial, neither the airlines nor any other party are actually financially liable for anything at all. So while the legislation was touted as a choice of filing a lawsuit or entering into the fund, the choice is in fact only an illusion. There will be no money left to collect from insurance funds once the government takes its share as part of the subrogation clause. Victims and their families are expected under this scheme to receive monies from the fund quickly, as the law states that the office of The Special Master must give a ruling on any determination no later than 120 days after the claim is filed. Payment must be authorized in no more than an additional 20 days. Compared to a traditional lawsuit, the system is faster, potentially cheaper and does not force the claimant to proved proof of any wrongdoing on the part of anyone. But there may be a catch or two. And they may be huge. In order to make a claim, claimants must first waive all right to be involved in any suit anywhere against anyone regarding the attacks. And that leads to another problem. There are no appeals allowed in the claim process. If claimants file and do not like the decision, claimants are already locked in to the system, and have no further recourse. An addendum to the Aviation and Transportation Security Act clarifies this point and now does allow for a person to file lawsuit against any ?knowing participant? and still file a claim with the fund. One caveat is that the President may, at the request of the State Department, unilaterally quash any money judgments against foreign entities if they believe that it is in our national security interest. This is exactly what is happening right now regarding the judgments already entered against Iran for the terrorist kidnappings in the 1980?s. Collateral Sources. The law states that any amount that the victim or their family would receive from the fund would be offset by any collateral sources. Among the sources specifically listed in the law are life insurance, death benefits and pension funds. So for the families of victims who have passed away in the tragedy of September 11, this would result in the very clear possibility that if they did advanced planning for the future, they would receive less than those that did no planning at all. This begs a few questions: Why should those who did plan ahead be penalized for doing so? What about the money paid for the insurance? Would the premiums be allowed as an economic loss, and added to the award? Why would pension funds, which were monies saved over time by the victim, be a collateral source? Wasn?t this already the victims own money? What about payments made over time to the victims and their families? How will this be calculated? Will this be considered a collateral source? What about Social Security? Is it fair to deduct any amount from what is in effect the settlement of a lawsuit using an Alternative Dispute Resolution system? The regulations and laws governing New York State Workers Compensation state that any payments made by the insurance companies would also be offset by collateral sources, though in that case the law refers to medical payments made directly by insurance or litigation settlements. Will these companies expect to be able to reduce their awards based on the amount received from the fund? Will the Special Master consider that a death benefit? Will both parties, the insurance companies and the government attempt to reduce the amount provided for? While the regulations state that the monies received from the fund are not subject to subrogation from any other party, has the government received waivers from the insurance companies underwriting the workers compensation benefits for their right of subrogation under state law? If not this could lead to victims? families being sued for the amounts paid by the insurance companies or suits regarding the illegal taking of property rights. Please also note that due to the generous pension and death benefits provided by the government, the families of firefighters and police officers are effectively barred by the collateral source rule from filing for any economic damages. Due to the wording of the collateral source rule, unlike CPLR 4545, collateral sources can be used to offset non-economic damages as well. There is no provision regarding the concerns of domestic partners or undocumented aliens. This fact could reduce the number of potential claimants. The mechanism and procedures required for filing are now being finalized. The Justice Department is currently reviewing suggestions and comments. These comments can be reviewed on their web site. In the announcement of the release of the interim rules, many claims were made regarding the amount people would be awarded, but these numbers are gross amounts before collateral source are deducted which could lead to little or no money going to victims families from this system. Payouts from the fund will be far lower than was announced at the press conference. From here we can go in one of two directions. Steps can be taken before the final rules and regulations go into effect in January. The government can be generous and take into account the feelings and concerns of the families, and in the process make substantial monies available to the victims and their families. If this was done, the claimants would have positive and compelling reasons for not suing the airlines, the goal of the overall legislation and everyone would feel that they were dealt with fairly. On the other hand, it could become a morass where victims and their families may be left with no legal recourse or form of redress, a settlement that is at best inadequate and at worst no compensation at all for their loss. The image of the fund, its principals and sponsors would then be that this fund is nothing but a way for the government to protect the airlines, their shareholders and lobbyists, the port authorities, security firms, and airports at the expense of the innocent victims and their families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, March 11, 2002 9:48 PM To Whom It May Concern, I have just received an e-mail message stating that: "In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (a fund created by Congress and run by the Department of Justice), said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones." I haven't verified this, and I'm hoping that it is not accurate. It had been my impression that gay and lesbian partners (in permanent domestic relationships) of victims of Sept. 11 would be compensated as if they had been surviving spouses. Is this not correct? I'd appreciate any information you could give me about this. Thursday, March 21, 2002 11:40 AM Gay/Lesbian Rights Dear Government/Fund Relief Politicians/Law Makers and Breakers and to everyone that could be involved in any way: It is absolutely insane to NOT honor Gay/Lesbian families left behind from the 9/11 tragedy. Why would the funds, the same funds many gays and lesbians donated to, NOT be used to help the families left behind if they are Gay/Lesbian families? We were told that there were no more hyphenated-Americans, which included Gay-Americans but now they are being kept out of the fund? Should then all the money donated by Lesbians/Gays be returned to them? Should all Gay/Lesbian people that donated be asked where they want their money to go in the donations made by the fund? In fact, since everyone donated with the faith and foolishness of believing that the funds would go to every family left behind and now that it is known that certain families are being withheld from the fund shouldn't ALL the money be returned so the donators can decide who they want it to go to? I will send my share to Gay/Lesbian families left behind-as would many, many others. If we were given the constitutional right of being asked. I am ashamed of our government, this so-called fund and the treatment of our fellow Americans-look at other countries for help, we are trailing behind in taking care of our own. This is reminiscent of excluding Blacks (African-Americans, but no hyphens anymore, remember?) From drinking fountains, front bus seats, entrances with the whites on buildings, or sharing the same bathrooms. I have not seem signs on the buildings or buses saying "Gay/Lesbian" entrance or "Gays/Lesbians" to the rear of the bus-do we have to separate war memorials for Gay/Lesbians who fought for our country or are they on the same memorials as other fallen Americans? Instead I see our government and politician passing judgements, laws and decisions that insult, affect, hurt, penalize and dishonor our fellow Americans in withholding the constitutional rights that every other American is entitled to. Either take care of ALL the families left behind by our fallen heroes and fellow Americans lost in the 9/11 disaster or withhold it from them all, send it back to each and every donor so we can pass it out constitutionally. Be sure then to include a list of all people that died and left families behind and after each name you will have to include their race, religion, sexual preferences, etc so all small minded bigots can send only to those they want money to go to. I can guarantee there are enough good Americans out there that no Gay/Lesbian families left behind will suffer. I do wonder about the families of unfair law makers- would the country want to support bigots that are begetting bigot. Of course we would. It doesn't seem right since it will enforce unfairness in this country, but we would not intentionally withhold help from anyone, we are Americans. When I forwarded this call to help my friends. I sent it to everyone, my small minded friends, and my normal minded friends, I included in my message to them to urge for them to write today, plus I asked if a Gay or Lesbian pulled them from a burning car would they say "no thanks"? Give me a break, Americans are Americans, people are people, quit thinking as bigots and start thinking like Americans-include all our fellow AMERICANS in the fund or send it ALL back to the donors and we will disperse it fairly. I am thankful to each and every one of our people that helped at the disaster sites, either digging out bodies or passing out wash cloths, water and food to the workers, crashed planes to save others, risked their lives to save others, etc and I don't remember anyone asking at the time are you Gay, are you Lesbian? Well then if you are we don't want your help, go away. If we did not turn away their help in time of our need, then why are we turning them away now? Sunday, March 17, 2002 5:11 PM 9/11 Fund Dispersement Discrimination I have received information detailing the policies of the Victim's Compensation Fund that are discriminating against the families of gay victims. I contributed to this fund and I am gay. I find this policy completely offensive, more so since the Fund is so willing to overlook existing laws regarding illegal aliens, who are not U.S. citizens! Can you overlook the significant role that gay citizens played while acknowledging the value of other human lives that fateful day? As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Although most of these persons do not currently enjoy legal recognition of their relationships, their families are just as tightly woven (in the majority of cases) and just as important to them as are the family members of more traditional man/wife/children families to each other. We're talking about basic fairness here. While it may take decades to gain legal recognition of these non-traditional families, and while many of these families will continue to suffer from unfair discrimination in the meantime, you and the U.S. Dept. of Justice have the opportunity to see that ALL families affected by the September 11 tragedy have access to the funds set aside specifically for their compensation. Paraphrasing the words of the Rev. Troy Perry, the founder of the Metropolitan Community Churches, "their pain is no less, their loss is no less". I think there should be criteria in place for determining and assuring that people claiming compensation under this Fund did have an established, on-going interdependence of a familial nature with one or more of the September 11th victims. It would obviously be up to you to determine exactly what these criteria should be. I would suggest that while they do need to clearly establish the existence of a significant relationship, they should not be overly restrictive or burdensome. Friday, January 11, 2002 3:27 PM Inadequacies of compensation fund I am a recent widow as a result of the WTC tragedy. My husband was an employee of and was killed while at his job in Tower 2. He left behind two children (ages 18 and 12). I am deeply disappointed with the terms of the Victims' Compensation Fund. How in the world was the pain and suffering figure ever allowed to be just $250,000 for victim and $50,000 for surviving family members. Our loved ones encountered a savage way to die. Their last moments were filled with terror and panic. As I can attest to for I was on the phone with my husband in his final moments. The time of death had to be excruciating, but hopefully quick. My children and I are constantly reminded of this travesty every day of our lives. Nowhere can one go without seeing something about 9/11. We will live with these images for the rest of our lives. So not only is the pain and suffering settlement ridiculously too low, but then you have the nerve to deduct other compensation from it. My husband worked hard to provide for his family. In doing so he contributed to the company's life insurance plan. That life insurance payout is money we are entitled to and should not be taken into consideration when determining how much I receive from the Fund. Also your economic chart to determine lost wages does not take into account future salary increases and / or bonuses. I am willing to accept that detail, but I am not willing to accept your subtracting other compensation from that figure. We are been put in a horrific situation. All due to negligence on the Airline's part, on the Towers' architecture, on the inadequate fire-proofing and on the ineptitude of the Towers' management (advising my husband that Tower 2 was secure and he may return to his desk). We deserve a fair and just settlement or I will have no recourse but to sue. Zwick, Director Office of Management Programs Civil Division U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Avenue Washington, DC Re: Comments on the Interim Rule of the September 11th Victim Compensation Fund of 2001 Dear Esteemed Gentlemen: I am writing to ask for your help to correct two inequities in the Department of Justice's Interim Final Rule for the September 11th Victim Compensation Fund of 2001 that will result in many families receiving no compensation from the fund. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims' right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims' families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all income levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congress's goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and military personnel, they choose to go into harm's way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceased's job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally, please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
