Also the amount of suffering, though it may vary between each person who lost a loved one, cannot be assumed as such. Drawing a line in the sand and claiming that one person suffers more than another (and should get more money) is asinine. Defining "loved one" is also ridiculous. The only alternative you have is to divide the fund up equally among the immediate relatives and those who can prove mutual interdependence with the victim in the sense that they shared living expenses. The money should be tax free and all of the cost associated in collecting, holding, managing and distributing the money should be covered by acts of charity, our government and the citizens. In other words: every single cent donated should find its way into the hands of a person who lost a "loved one". Please do what is logically sound and right! But the victims, should not become rich over this. I lost my spouse with two small children to raise. I receive social security benefits and I feel very blessed. I know you can never have enough money. However, money cannot replace the people killed by the terrorist. The red cross has received millions if not billions and where is that money going? I guess what I am trying to say is: If these people get social security benefits and maybe some small lump settlement they should consider themselves blessed. Unfortunately, life is not fair. We need to spend tax payer money on beefing up the military and other projects that benefit the nation as a whole. Get this economy going! This may be a long battle. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist Michelangelo Signorile, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping Signorile accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Contact Persons: REPLY TO REQUEST FOR COMMENTS ON EXCLUDING CHARITABLE CONTRIBUTIONS FROM THE DEFINITION OF "COLLATERAL SOURCE" H.R. 2926, the Air Transportation Safety and System Stabilization Act (the "Act"), was signed into law by President George W. Bush on September 22, 2001. Title IV of the Act, entitled "September 11th Victim Compensation Fund of 2001," provides for the payment of compensation by the U.S. government to those individuals (or their relatives, in the case of deceased individuals) who were "physically injured or killed as a result of the terrorist-related aircraft crashes of September 11, 2001." The amount of compensation payable pursuant to Title IV of the Act, however, is reduced "by the amount of the collateral source compensation the claimant has received or is entitled to receive as a result of the terrorist-related aircraft crashes of September 11, 2001" (see Section 405(b)(6) of the Act). Section 402(4) of the Act provides that "the term 'collateral source' means all collateral sources, including life insurance, pension funds, death benefit programs, and payments by Federal, State or local governments related to the terrorist-related aircraft crashes of September 11, 2001." In its Proposed Rules dated November 5, 2001, at Topic #6, the Department of Justice (the "DOJ") requested comments on "whether the [H.R. 2926, the Air Transportation Safety and System Stabilization] Act indeed permits the Department to exclude [charitable] contributions from the definition [of collateral source]." For the reasons stated below, we believe that the Act permits the DOJ to do so, on the ground that the definition of collateral source does not extend to payments made by charities to injured victims and relatives of deceased victims of the September 11th terrorist attacks. As an initial matter, Section 402(4) of the Act provides that the "term 'collateral source' means all collateral sources, including life insurance, pension funds, death benefit programs and payments by Federal, State or local governments . . . ." The Act does not specifically list payments to victims from charities among the items included in the definition of "collateral source." Had Congress intended to include charitable contributions, it could have specified them. Since it did not, statutory-construction rules would argue for excluding charitable contributions unless they are clearly of the same kind as the enumerated payments. An examination of state laws and cases that address the treatment of collateral sources in connection with tort damage awards reveals no consensus on this point. Therefore, charitable contributions could be excluded on statutory-construction grounds. The "collateral source rule" generally refers to the legal principle that a plaintiff's recovery in tort may not be reduced by certain "collateral source" payments, such as payments made under plaintiff- or third party-maintained insurance, employment benefits, and pension benefits (see Restatement (Second) of Torts, § 920A, cmts. b and c (1977)). State law differs, however, as to the question of whether gratuitous payments and services (e.g., forgiveness of all or a portion of a hospital bill) offset tort damage awards. Few cases specifically discuss charitable contributions in this context. Therefore, state-law precedents do not require charitable contributions to be included. Finally, charitable contributions are arguably not items of the same kind as those specifically enumerated in the Act. First, charitable contributions cannot be purchased by a victim in the same way that life insurance can be purchased. Second, charitable contributions cannot be earned by a victim by virtue of an employment relationship in the same way that pension funds or death-benefit programs can be earned. Third, charitable contributions cannot be government entitlements in the same way that payments by Federal, State or local governments are entitlements. Stated differently, while the payments from the September 11th Victim Compensation Fund, as well as collateral source payments, fulfill a commitment made by statute or by contract to compensate for losses (e.g., to make victims "whole"), the charitable contributions to such persons are voluntary payments to relieve the distress that victims and their families suffer as a result of the disaster. Furthermore, under section 501(c)(3) of the Internal Revenue Code (the "Code"), the net earnings of a charity cannot inure to the benefit of any private individual. The Treasury Regulations promulgated pursuant to Code section 501(c)(3) further provide that a charity is not organized or operated exclusively for one of more exempt purposes unless "it serves a public rather than a private interest" (see Treas. Reg. § 1.501(c)(3)-1(d)(ii)). Thus, the charity must direct its assistance toward the members of a charitable class and not to specific individuals who have bargained to receive assistance under specified circumstances. Although a clear rationale exists for offsetting government payments with the payments the victims are entitled to receive for the same compensatory purpose, this rationale need not be extended to charitable contributions, as these contributions do not satisfy a private or public legal obligation and are made not for a compensatory purpose but instead to relieve distress. Therefore, the well-settled law of charity would appear to allow charitable contributions to be excluded from the definition of collateral source. His body has never been found. The decedent left $200,000 in life insurance benefits to the three children, $300,000 in life insurance benefits to his spouse (who is the childrens stepmother and does not live with or support the three children), and $340,000 in life insurance to the decedents sister. The policy paying benefits to the sister had a face amount of $170,000 and a double indemnity provision. These children will be receiving less than 25% of the life insurance benefits left by their father. The children live with their natural mother, and were over 50% dependant on their fathers support. A. THE COLLATERAL SOURCE PROVISION SHOULD BE REPEALED Benefits received from collateral sources should not affect the amount awarded to victims under this Act. Victims and their families have suffered and will continue to suffer due to these terrorist acts. Families should not be punished for victims having alternative measures in place, such as life insurance, which they are now entitled to after years of paying premiums. This Fund should be regulated according to the purpose for which it was created, as an unprecedented expression of compassion on the part of the American people to the victims and their families devastated by the horror and tragedy of September 11. Our countrys expression of compassion should not be limited by the compassion of others or various benefits available to families. B. ALTERNATIVELY, THE COLLATERAL SOURCE PROVISION OF THE SEPTEMBER 11TH VICTIM COMPENSATION FUND OF 2001 SHOULD BE AMENDED We are especially concerned to the extent that the Act arguably reduces the amount of compensation to be given to victims based on collateral sources, including life insurance, regardless of whether the victims received the benefit of the insurance that is causing the reduction. We ask that this offset not be applied as an across the board rule. In the situation of the three children, fundamental fairness should not allow their potential recovery to be reduced by $840,000, when $640,000 of that amount will never be available to them. The purpose of this fund was to provide monetary compensation for the loss so many families are suffering due to terrorist attacks. By applying this collateral source provision, it goes against the meaning for which this fund was intended. As it stands, these three children will have their award reduced by collateral compensation from which they will never benefit. This type of reduction was not intended by the drafters of Section 405 (b)(6). At very least, benefits should not be reduced based on the total amount of collateral compensation, but rather, reduced by compensation that the individual receives from outside sources. Thursday, March 21, 2002 5:06 PM Compensate survivors of ALL 9/11 Victims My life partner served the United States as an officer in the USAF in Saudi Arabia. She retired from the military and has been in graduate school getting a PhD in Public Health. She has always had a strong interest in bioterrorism. Since 9/11, she has been approached by several federal agencies, as well as state and local agencies, asking for her help in policy and prevention planning for bioterrorism attacks. She is a very patriotic American. Because of the events of 9/11, she has made it her life-long mission to work to protect American lives from any and all types of terrorist activities. She is also a lesbian. It is shocking that our government would be so callous as to provide compensation to the families of illegal aliens and FETUSES lost during the events of 9/11, and not provide compensation to the survivors/domestic partners of the many gays and lesbians lost that day. Some of those lost were heroes such as . Some of them were among the many rescue workers who rushed into the WTC towers to rescue civilians, and were then killed themselves. The events of 9/11 were unparalelled in history. Our contry has had to make changes in the way we operate on so many levels. Why not make a bold and brave step and compensate domestic partners of the gay and lesbian vicitims? It would not necessarily set a precedent. I pray that we NEVER would have to consider making compensation for a disaster of this kind again. These victims were loved, and lost. The sense of loss is no less painful, simply because the victims were gay. But the callous exemption of their survivors in this case is adding enormous insult to injury. It sets a precedent for treating gays and lesbians, even in the most horrendous circumstances, as second class citizens. In fact, in this case, even illegal aliens get preferential treatment. Please take a moment and remember how you felt on September 11th, about the enormous loss of life. Reach deep inside and use that feeling to do the RIGHT and HONORABLE thing. Saturday, March 16, 2002 4:02 PM Sexual descrimination Upon reading the information sent to me by a friend of mine in regard to the very high possibility that some of the heroes of September 11th, who are homosexual, will not recieve benefits, or at least will recieve less, it became clear to me that in the United States the separation of chuch and state is a farce idea. Clearly the only true reason for this obvious dissent toward people of a gay persuasion is based on the required religious beliefs of the upper managment of this country. It is my opinion that had these people's sexuality not been disclosed they would most certainly had been hearalded equally with everybody else involved in the heroism. As an American, I am disgusted and outraged. I would venture to say, without a doubt, that if any person in our beloved government was stuck in that building as it was falling to the ground, was being saved by the sheer physical and mental power of a gay firefighter, he or she would immediately suspend all social, political, philosophical and religious beliefs in regard to gays. Wake up! People are alive because of these people. What if these gay heroes stopped at the moment of action and asked the victim about his or her beliefs in regard to gays? Do you think that hero would change his or her mind about bringing that person to safety. I think everybody reading this knows the answer. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
