To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Discrimination?
John McCain, Senator from Arizona has spoken publicly regarding the John
Ashcroft statement that Gays and Lesbians do not qualify for assistance from
the 9/11 fund. That is outrageous and to even speak about our fellow
Americans, who have served this country well and volunteered time and money
to assist victims and survivors is a crime against American citizens. This
Bush administration is already taking away the rights of the average American
and the people think he is doing something good for them. If the Federal
Government is going to discriminate against Gays and Lesbians they should
impeach Dick Cheney as his daughter is a card carrying Lesbian, and has her
mothers complete support. Newt Gingrich has a Lesbian sister, and Bush
accepted campaign contribution form the Log Cabin Republicans, which is a Gay
male organization of professional businessmen. Ashcroft is a Pentecostal by
faith and I strongly object to his faith and his complete disregard for civil
rights. Its time to impeach Bush and his cabinet and start taking care of
America and not Bush and his friends.

Gay and Lesbian Families must be compensated!
To whom it may concern,
This is a moment when those proclaiming to believe in "compassionate
conservatism" can show what they mean by that.
Just as many heterosexual families were destroyed by the events on
9/11, so were many gay and lesbian families.
Let's show ourselves to be human and recognize that all families
that were affected should be treated equally: gay and lesbian families
(recognized by the fact that they are same-sex couples who live at the
same address, share financial responsibilities, and name each other as
beneficiaries in wills and other legal documents) deserve the same
compensation as others who were legally married and lost their spouse.
The gay and lesbian families would have established the bond of marriage
if it had been afforded them.
Certain religious judgments aside, isn't it just humane to care
equally about those who lost the person they cared for most in the
world?

Fetuses and ILLEGAL Immigrants get money, Domestic Partners

What's this about domestic partners getting screwed by the find while
FETUSES ad **ILLEGAL** Aliens are allowed?
Don't gave that ridiculous excuse about "State law"; it's quite apparent
that most state laws do not award domestic partners survivors' benefits
and that is simply a way of sidestepping the real issue, which is
discrimination. If you're so concerned about state law, please note that
most state laws would NOT allow ILLEGAL aliens to receive money. Try
again wtih your logic. And I also don't think any state gives fetuses
the same status as living people. You conveniently managed to ignore the
laws on these two classes, then claim that "State law" keeps you from
awarding survivors' beneftis to domestic partners.
Well, nobody is fooled by this ridiculous discrimination. I hope you
will stop to consider the hundreds of people who are just as hurt and
"up the creek" financially having lost a domestic partner (who in may
cases was the breadwinner) as a fetus who wasn't even born on 9/11 to a
parent they can't miss since they never knew them.
At least be consistent in your awards: if you're going to follow laws,
the ILLEGAL Aliens and fetuses are not eligible; if you can sidestep the
law for them, of course you can do so for domoestic partners. Those
folks pay the taxes that comprise this fund, too.

I am very concerened about your treatment of the victim's.....
Hello my name is , and I just read an email sent to me by a friend concerning your treatment of the partners of homosexual victims of the
world trade attacks. I think it is disgusting that in this "the new
millineum" our government remains as prejudiced towards homosexual as they
were in the past. A homosexual relationship is just as real and loving as a
heterosexual one. There is pain as well as sadness in the loss of a partner
in either relationship. SO why are homosexuals considered undeserving of
benefits for the loss of their partners. As our government you cannot allow
this to happen. You must treat all victims of the attacks equally, and
justly. If you do not then how can you ever say you serve the people, when
you deny a significant portion of your population. I am proud to be an
American; I am proud to live in one of the most beautiful, and caring
countries in the world. Please do not make me lose faith in this great
nation. I can never vote honestly in a country that treats some of it's
citizens as second-class. I love this country with all my heart and would
hate to see it become a hateful and unjust. Please if this email has done
anything to change your mind, then try and help. Please do something to
change our government's treatment of the homosexual partners of the victims
of the world trade attacks. Thank you for your time, and I hope you do

Victim's Compensation Fund
My husband,      was killed while working for      .
at the World Trade Center, South Tower, on September 11th. He leaves behind
myself, and our 12 year old daughter. He worked for for 14 years and the last 8 years he worked for them in their      Office. Because he had a lot of New York clients, my husband often used the      offices when he was in town visiting. Unfortunately, he was in NY on that day.
My husband was a hard working individual. A 12-13 hour work day was not
unusual for him. He earned a sizable salary but the two of us used that
salary to plan for our future and particularly, our daughter's. Because of
advanced planning, and forethought to unseen events, my husband purchased
life insurance above and beyond his company benefits so that in the event of
his death, my daughter and I would be able to live comfortably, without
worry.
Because of the nature of his death, along with thousands of others, we have
received charitable donations as well, to help us restart and get our lives
back in order.
As far as I can see, the Victim's Compensation Fund does not help people like
myself because of the proposed deductions of all collateral source amounts
which would include the life insurance I have received.
Not being a litigious person, if the Fund were attractive, I would opt for
that much more readily than I would for a lawsuit. However, if the Vicitim's
Compensation Fund does not change, I will be forced to file a lawsuit as will
many, many other victims. Believe me, we are angry enough and devastated
enough to pursue a lawsuit for as long as it takes and we will fight for as
much as we can get.
Because of negligence, lax attitudes towards airline security and immigration
laws, my husband is dead. He went to work on 9/11 like any other American
that day and because of our lack of governmental regulations and ineptitude,
he is dead. Now, all of a sudden, the government gets tough and imposes
regulations. However,the regulations you now decide to impose are on the
very people who have suffered the loss of a loved one because of your lack
of INITIAL regulations. It doesn't make sense. How dare you punish those
who have lost a loved one? Because my husband worked hard and made a very
good salary and had life insurance, I don't deserve to be compensated for his
loss? My loss is less because I have life insurance? My husband's life
didn't matter because he had life insurance of his own? Is my suffering any
less than someone who didn't have life insurance? What gives the government
the right to make that distinction?
How can you distinguish one life from another?
The Victim's Compensation Fund is an opportunity for the government to make
good on some really bad mistakes. If you would rather see a few thousand
lawsuits, keep the fund the way it is, if you would like to be fair and just
in the distribution of funds, consider my comments among the many others you
have received. You need to decide what a claimant would receive as a minimum
lump sum in lieu of lawsuit.
People have the right to know what they will receive if they opt for the fund.
You also need to reconsider the deduction of collateral source amounts from
this amount. If you don't, you will be inviting lawsuit and I believe, the
intention here is to avoid that at all costs. Be fair to the victims and
they will be fair to you.

The Victims of Sept. 11
The families of the victims and those who lost their jobs as a result of

Complaint re. treatment of gays in fund
Mr. Kenneth Zwick:
I'd like to lodge a complaint re. treatment of gays in the 9/11 Victim
Compensation Fund. I think we need to extend the compassion to everyone who
lost loved ones in this terrible event. If the fund covers heterosexual
partners then it should also include homosexual partners, under the same
guidelines.

Help all victims of terrorist attack
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.
This importantly should include the partners and children of same sex
unions. They suffer just as grievously for their deceased loved ones as do
other survivors, and their need for assistance is just as great.
Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions. They are interested in a political
victory, not humane assistance.
This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Homosexual discrimination protest
Please add my voice to the millions who are outraged that gay and lesbian
partners of those
who died on September 11 are not automatically going to receive the same
benefits from the September 11 Victim Compensation Fundas as heterosexual
spouses.
Please reconsider your position. This horrible act was committed against
all Americans, regardless of their sexual orientation, skin color or
religious background. Don't make lesbians and gays double victims--first of
the 9-11 terrorism, then of your discrimination.

Equal Access to Crisis Relief Benefits

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Director Zwick:
The Log Cabin Republicans (?LCR?) and The National Stonewall Democrats
(?NSD?) welcome the opportunity again to offer joint comment in response
to the request for public comment by the Department of Justice on
regulations and procedures relating to compensation of survivors of
persons killed in terrorist attacks on September 11, 2001. These
regulations pertain to provisions of the Air Transportation Safety and
System Stabilization Act that established the September 11th Victim
Compensation Fund of 2001.
LCR and NSD previously submitted a public comment on November 26, 2001
in response to the advance notice of proposed rulemaking. Thereafter,
on December 19, 2001, the DOJ issued an interim final rule with an
additional request for public comment.
In its preamble, the interim final rule claims to have two objectives:
?(1) to provide fair, predictable and consistent compensation to the
victims of September 11 and their families throughout the life of the
program; and (2) to do so in an expedited, efficient manner without
unnecessary bureaucracy and needless demands on the victims.?
(Preamble, p. 3). As we find the interim final rule to fall short of
ensuring ?fair, predictable and consistent compensation? to victims?
families, we submit this comment.
This comment focuses on two key points of the interim rule: the
practical exclusion of gay and lesbian partners as qualifying as
?personal representatives? of their deceased partners, and the lack of
explicit eligibility of gay and lesbian domestic partners as eligible
surviving beneficiaries of victims of the September 11 tragedy.
Personal representatives, for purposes of the interim rule, will not
include the same-sex partners of victims unless the victims? created
wills naming their partners as their personal representatives. Even in
those cases, family members often challenge such wills in state courts
and, because of prejudice, succeed in eliminating deceased gay and
lesbian people's testamentary intentions. And for the majority of
victims who did not have wills, the interim final rule specifically
leaves to state law the determination of a victim?s personal
representative. (Section 104.4(a)). State probate laws, nearly without
exception, fail to legally recognize relationships shared by same-sex
couples and, therefore, serve to exclude gay and lesbian partners from
qualifying as personal representatives, a categorization at the core of
the Fund's decisioning system. Accordingly, the interim final rule, as
a practical matter, serves to exclude the majority of gay and lesbian
partner survivors from being considered as personal representatives.
The functioning of the interim final rule highlights the need to enact
state and federal laws that treat same-sex partners equally with
legally-recognized couples.
Further, gay and lesbian partners of victims of September 11 are
needlessly excluded from the explicit list of eligible surviving
beneficiaries of victims. (Section 104.4(b)). The interim final rule
describes beneficiaries as
the immediate family of the decedent (including, but not limited to, the
decedent?s spouse, former spouses, children, other dependents, and
parents), to the executor, administrator, and beneficiaries of the
decedent?s will, and to any other persons who may reasonably be expected
to assert an interest in an award or to have a cause of action to
recover damages relating to the wrongful death of the decedent.
(Section 104.4(b)). In no provision of the interim final rule is there
any language to suggest or ensure the fair treatment of a decedent?s
lesbian or gay partner ? again unless the decedent?s will so states. In
the spirit of the objective of fairness set forth in the preamble, we
strongly suggest that the litany of examples of ?immediate family of the
decedent,? as described in Section 104.4(b), explicitly include the
phrase, ?same-sex partner,? or other language that clearly states that
gay and lesbian domestic partners will receive fair and equal treatment
in compensation. (See ?Claimant Eligibility & Compensation? section of
the LCR ? NSD Public Comment Letter dated November 26, 2001).
We realize that some of the lack of specificity in certain language of
Section 104.4 might provide the Special Master an opportunity to include
same-sex partners in a compensation award by the Special Master
exercising his discretion. However, for NSD, LCR, or any other
organization dedicated to equality and fairness under the law, to rely
on one person?s discretion in such an important federal program would be
a dereliction of responsibility. Thus, the final rule, when
promulgated, should make explicit that lesbian and gay partners will --
without doubt or need for the exercise of the Special Master?s
discretion -- be treated fairly and equally.
We submit this comment and respectfully ask for full consideration of

Dear Mr. Zwick:
I am a retired age 58 citizen/taxpayer and have thefollowing comments
(due January 21, 2002) concerning the December 21, 2001 final interim rule
and proposed policy stated below relating to the distribution of monies to
victims of the September 11th tragedy.
It is our view that, absent extraordinary circumstances, awards in excess of
$3 million,tax-free, will rarely be appropriate in light of individual needs
and resources.At the same time, we want to ensure that victims' families are
receiving atleast a minimum level of resources to help meet their needs and
rebuild their lives. Thus, we have concluded that the families of deceased
victims should receive a combined total of at least $500,000 from this
program, other state and federal programs, life insurance policies and other
sources ofcompensation. Similarly, the baseline for single decedents should
be $300,000.This ensures that every needy claimant's total compensation from
this program and other sources will be at least equal to these threshold
amounts.
Forthose victims who died as a result of the September 11 aircraft crashes,
the presumed noneconomic losses will be $250,000, plus an additional $50,000
for the spouse and each dependent of the deceased victim. That $250,000
figure is roughly equivalent to the amounts received under existing federal
programs by public safety officers who are killed while on duty, or members
of our militarywho are killed in the line of duty while serving our nation.
See 38U.S.C. § 1967 (military personnel); 42 U.S.C. § 3796 (Public Safety
OfficersBenefit Program). The latter figures -- $50,000 for the spouse and
each dependent -- include a noneconomic component of & quot; replacement
services loss."
Since the government is planning to step in and assume legal liability for
victim damages due to the September 11th, terrorist attack why not limit
award settlement amounts to more reasonable $ 500,000 (families) and$ 300,000
(individuals) amounts to better utilize taxpayer monies. A settlement of this
nature appears to be more than comparable to a customary Term life Insurance
benefit available to the average
U S Citizen. Also, to that of a member of our armed forces who would
receive a maximum term benefit of $ 250,000.
A maximum award for families of $ 500,000 and individuals of$ 300,000 would
appear to be more fair and equal and would not consider a victims past
employments and future earning potential. Why should any family receive an
excessive benefit of $ 3 million at taxpayers expense? An award based upon an
individuals future income potential appears excessive and arbitrary and
discriminatory in favor of current and temporary high wage individuals.
The governments liability should also be funded as much aspossible by
terrorist frozen bank account funds.
Maximum awards to Sept 11th victims not only should be reasonable and fair to
all victims but also be comparable to customary private and public awards and
benefits available to the average United States Citizen or military enlisted
men.
The Average U S Citizen would be more than happy to be covered with a Term
Life Insurance benefit of $ 500,000 or $ 300,000. Also, the customary Social
Security Death Benefit of $ 255 appears much too low in comparison.
Again, my main comment is that victim awards should be limited to a maximum
of $ 300, 000 for individuals and $ 500.000 for families in the name of
fiscal responsibility and fairness to all U S Citizens.
Government funds are considered limited and available funds can be more
prudently spent on social and health care programs benefiting needy and
uninsured U.S. Citizens. Also, the customary Social Security death benefit of
$ 255 for all citizens should be increased to at least $ 1000 to cover burial
costs for all Americans.

Help same sex partners of terrorist victims
Dear Mr. Zwick:
The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.
This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.
Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions. They are interested in a political victory,
not humane assistance.
This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.
