Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. I know personally, because I lost my MOM in the tragedy. People see a figure of $1 billion donated and think....OK 1 billion divided by 5000 equals 200k per family. Seems like we have been taken care of.....right??? WRONG!!!! I would like to let the pubic and the DOJ know that I have received a total of 9,000 from the Red Cross to help pay ALL of my Mother's expenses. So PLEASE don't think we are walking away millionaires. These charities need to be investigated to see what they really do with the extremely generous donations made by warm and caring individuals. And let me also mention that to ask the opinion of people who have no idea what our family and the thousands of families like us, have personally gone through, is irresponsible. They do not have the slightest idea what this has done to us. My sister had to be hospitalized for several weeks due to this tragedy. She lost 25 lbs and was vomiting and passing blood. My other sister left a 125k and year job because she cannot even function anymore. These people who are making these opinions on MY life and what I am entitled to, should try for one millisecond to live a day in my life since September 11th. Maybe they can try and think of their own precious mothers, who nurtured and cared and raised them, being maliciously cut into pieces and left amid the wreckage that once was the WTC. Monday, April 01, 2002 2:52 PM gay and lesbian victims dear mr. feinberg, i am trying to appreciate the incredibly sensitive position you hold regarding making such critical decisions as to how and to whom compensation for the victims of september 11 is granted. i know you must be deluged with requests for specific kinds of considerations, formulae to use, etc. it is never easy being in the decision-making position, but particularly so when the decision involves both emotional and financial considerations. it is with these understandings that i strongly urge you to reconsider your stance on inclusion (or, lack thereof) of compensation to survivors of gays and lesbians killed on 9/11. you have stated that you will be guided by state laws, which we all know are inadequate at best in acknowledging gay and lesbian relationships, let alone legal protections and liberties (which are automatically accorded non-gay relationships). the Attorney General himself has indicated that illegal aliens who step forward as survivors of victims will not be pursued as a result of making such a claim. i applaud this position, but drawn out to its logical conclusions, the inherent message seems to be NOT to selectively apply the law (in this example, federal law) to only SOME of the survivors of victims of 9/11. in reality, what do you think the likelihood is that you will be sued by a particular state for providing benefits to one of its citizens who happens to be gay or lesbian? i find this rationale an extremely weak base for such a significant decision. as director of the benefit fund, it appears as though you have great discretion in making determinations about benefits distribution. i am confused by the limitation state laws regarding gays and lesbians, apparently presents you. the Attorney General's role modeling of expansive rather than limiting qualifications would seem a good one to follow. can you tell me why this is apparently not the case in relation to gay and lesbian survivors? has there been pressure from other constituents to make this so? if so, i urge you to take the high ground and make your determinations based on factual and individual information not political, religious or subjective 'moral' grounds. death is death, grief is grief, survival is survival...regardless of the legal sanctions, definitions, protections or lack thereof. what should be guiding you is the 'right' thing to do, which as we know, is not always synonomous with the 'legal' thing to do. unknowlingly and indiscriminately, American citizens were drawn into an event that did not distinguish gender, race, age, nationality, sexual orientation...the benefit funds should not now be making such distinctions, and in fact, is not on all but one of those characteristics. you have an opportunity first of all not only to provide equitable benefits to deserving survivors, but to send the message that i thought resonanted across this land on 9/11: the common values that bind and connect us are ultimately more powerful than those that divide us. let's make that so with these benefits as well. respectfully yours, Individual Comment September 11 Email: Date The local time and date when the message was written. 2002-04-01 Dublin Core The Dublin Core metadata element set is common to all Omeka records, including items, files, and collections. Wednesday, March 27, 2002 10:09 PM Exclusion of Gays and Lesbians As someone born and raised in New York City, I watched in horror as the towers I watched being built from Xaverian High School in Brooklyn crumbled. As an American I was angered at the senselessness of the destruction and the extinguishing of countless thousands of innocent lives. Like many, my sense of helplessness, my inability to embrace those who lost a loved one was somewhat mitigated by contributing to the 9/11 Fund. As a gay man, I am ashamed to have contributed to a Fund that has so blatantly and with such transparently flimsy justification chosen to exclude gay men and lesbians from receiving compensation from the Fund solely because they are gay men and lesbians who as partners have lost a loved one. While I certainly do not begrudge those who will benefit from the fund, I will certainly never again contribute to any such "general relief" fund administered by a governmental agency like the DOJ. The actions of the special master have taken one tragedy and added another to it. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Many lesbian and gay people were killed in the September 11th attacks. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Dear Kenneth Feinberg or whomever this concerns; How terribly horrific and malicious a man Mr. Ashcroft is to not only denie victim compensation to gay partners who died in the 911 attacks. , a gay man is a national hero - if it weren't for his actions - the congress or the White House would most likely be nothing but dust. Because of this horrible decision on Ashcroft's part, I seriously regret having given any money at all to any of the groups that took donations on it's behalf - and most assuredly will not contribute any further. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, January 26, 2002 1:12 PM Compensation The criticism is going to continue as long as the families of the victims think they "deserve" this money. This money is because we want to help families in need. My husband was killed by a drunk behind the wheel of a car. There are millions of widows and widowers like myself that know EXACTLY how hard it is to on and to raise our children in these circumstances. I contributed what I could because I wanted to help other families in their time of need. I did not give this money to set up all these peoples finances for life! Furthermore, I do not agree that my taxes should take care of these people for life. The difference between their loss and my loss is what? The woman complaining about how little she will get because she has 1.4 million in insurance should thank her lucky stars she has that and not take money from the fund set up for the people that are in need of help.
