First I must tell you how deeply grieved my heart has been and still is for your loss and now the struggles to move on. It seems that the act of terroism that led to this is beyond human comprehension. I pray for all of you, though I do not know your names. God does. Secondly, I can't believe that you should have the difficulties you are encountering while trying to get money to survive this loss. My husband and I sent money to the Red Cross, thinking it would be immediately distributed to you. How shocked and disappointed we were to find that they were holding it and had not given as we felt they should. We contacted them to let them know how we felt but needless to say, have never received a reply. The money is yours and should be given with no strings attached. Whatever you get over and above that does not bring back your loved one or ease your pain but it is yours. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, January 07, 2002 8:04 PM victim compansation fund I would like to begin by stating that all though I have not directly been affected (in terms of family loss) by the 9/11 tragedy, I along with every other rational human being have been affected emotionally. I have followed the development day by day on CNN. I must take this opportunity though to express my disblief in what I am hearing, and what I have seen on an interview that was aired on today's show (1/7/02). I believe that their is no monatary dollar value that can be placed on the lives of all of those innocent people. In such turbulant times, I also can not fathum the thought that the familis of the victims are angered and worried about not receiving their "fair share" of the Victim Compansation Fund. I feel that if the vicitims were financially savy, and were able to plan for their futures and the futures of their family members, then the funds should be distributed to those who really do need it. i.e. the family's of the waiters, porters, kitchen help etc. No family or person should be coming out of this tragedy with excess money. Yes, I do understand that the children of the victims will be re-living the tragedy for the rest of their lives, but how will being a millionare in the process help elevate the pain? Especially while there are other family members who truly have nothing? If the victim's had life insurance, 401k's etc. then they should be reliying on those assets for financial security and leave the fund money for those less fortunate and who really nead it. I believe that none of the family's should strugle to make ends meat, and at the same time no one should benifit either. I feel that the formula that was created for the distribution of funds is fair, and as long as there is room for adjustment, all should be thankfull for such a wonderfull government that enables them to receive anything at all! Many people in this area have given money or supported projects where the money was sent to this fund, thinking we were helping those who lost a loved one. I have many concerns and reservations as to how the Compensation Act is written to date. My overall main concern is - no amount of money could ever compensate for the loss of my son, but do not insult his memory and all his heroic deeds by offering such low token amounts for his lifetime's worth and then collaterally subtract out all the things that he worked for and paid into such as insurance and pensions. Why should he now be penalized for wanting to provide for his surviving loved ones? And second of all, do not fool the public into thinking we're all going to become millionaires over this, when in fact, after all of the required collateral items are subtracted out most people would be left with nothing. Lastly, If our government can send over billions of dollars to Afghanistan, a country that caused us all this pain and suffering to begin with, do not make us (United States citizens) quibble with our government over a few dollars one way or the other. The September 11th Victim Compensation Fund of 2001 is an appropriate measure to provide compensation for individuals who were killed or physically injured as a result of the September 11th terrorist attacks on America. The scope of the legislation, however, should be broadened to include the handful of other Americans who have been directly harmed by similar strikes by the same foreign terrorists on what is commonly understood to be American soil. Just three years before the September 11th attacks, the U.S. Embassies in Kenya and Tanzania were the targets of other terrorist bombings - this time by truck instead of aircraft. The attacks killed 22 Americans and seriously injured 26 more. was left blind, and has endured seven surgeries and remains permanently disabled. The survivors, as well as the families of the deceased, continue to grieve and to seek ways to deal with their losses. These Americans were employees of the U.S. Department of State and were doing America's work - building peace, supporting justice, and promoting America's interests and foreign policy. However, because of the United States' role in promoting democracy worldwide, and because of the symbolic value of their office buildings, the embassies were targeted by those who oppose our principles. As President George W. Bush confirmed in his address to Congress on September 20, 2001, the same terrorist organization is responsible for the bombings of the World Trade Center in New York, the Pentagon in Washington D.C., and the U.S. Embassies in Kenya and Tanzania. There is no rational basis for treating the victims of these attacks differently. Our government must provide equal treatment to all Americans who have been killed or injured by these same foreign terrorists. The Bush Administration should seek an expansion of the September 11th Victim Compensation Fund of 2001 to include the American victims of the August 7, 1998, terrorist attacks on the U.S. Embassies in Kenya and Tanzania. In an effort to assist my friends wife, I have been trying to decipher the interim rule for almost a month and still have many questions. I have contacted the hot-line, that has been provided, and have been able to get some questions answered, but in most cases they have to get back to me. I understand that this is a very sensitive and complex arrangement, and there are a number of people from all income levels and personal situations involved, but I feel if you make certain changes to the plan, it may put a lot of minds at ease and allow people to make clear, intelligent and informed decisions. Below are my comments: 1) Clearly define what is included/excluded from collateral sources 2) Though difficult, and time consuming, it would be helpful if the families had a clear understanding of what their actual award will be and how it was calculated. The 'presumed' award is a ball park but the actual amount can swing by tens of thousands of dollars (even after deducting Life Insurance). For instance, if I look at the presumed award that is closest to my friends category, I come up with X, but his children were not ages newborn and 9, but they were ages 18 and 13 and there was a third child age 20 and all the children are still in school and considered a dependent. Furthermore I know we have to deduct 'payments by federal, state or local governments'. It is stated that Social Security is included, but still unclear whether it includes Workman's Comp. However, we have to present value such amounts and then deduct them from the award but it is unclear what formula you will use to perform this calculation and what that amount will be. There are also deductions for Pension funds and death benefit programs which are also unclear. Is the 25% partnership stake in constitute an collateral source? ( I would think not). Do the premiums on medical benefits constitute a collateral source? (again I would think not). As you can see there are a number of open issues that have not been answered. In order for any family to make a clear, intelligent decision, the Special Master should look at each family and each case individually and come up with the actual award. Lets call this the floor. Before we are asked to sign away any rights, treat us an individuals and not just a group. The algorithms should be run for each family and disseminated accordingly. Once that is complete, offer an actual 'award' to the victims family rather than a presumed award (that is open to interpretation). At that point the families have to make a decision, a) do I accept the award as is, b) do I request a hearing to challenge the award c) I reject the award completely. Without the knowledge of what the award will be, I find it very difficult to make any decision. Again, I would like to see the actual award replace the presumed award before we are requested to accept or reject. The plan is currently structured whereby, other than the presumed award, the family will NOT know the actual award until they pass the eligibility criteria and agree to waive their right to sue. Be open and clear about how and award will be calculated and the only way to do this is on an individual basis. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
