Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am writing to express my profound distress at the apparent perverse outcome which arises from application of the Interim Final Rule and related regulations in the case of a victim who has died intestate (without a will), such as my sister. Specifically, to the extent any award is considered to be comprised of "pain and suffering monies" (apart from monies defined as compensation for lost wages) in the case of my sister it appears that ALL of those monies will be going to only one person (husband of 2 years) in a rather arbitrary fashion due to the fact that she had not left a will, though her close family actually consisted of 5 persons total, i.e. her newly wed husband as well as parents and my brother and I. Expressed simply: it is certainly not the case that ONLY her husband of 2 years has experienced "pain and suffering" of a magnitude meriting compensation, yet as my sister had not the opportunity to specify who else might merit such care he alone will be the one to receive it, as if the others did not exist. It is a cruel phenomenon of the law and what is proposed that in the absence of my sister having left a will (she had not foreseen the need for one as she as yet had little) the REALITY of her life will be ignored, with her dear ones apart from her husband being ignored entirely, as if the anguish and sorrow we feel does not exist. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. I refer you to this URL: http://uspolitics.about.com/library/weekly/aa031102a.htm. summarized the appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press" of Kenneth Feinberg, the head of the September 11th Victim Compensation Fund. Feinberg said that domestic partners of gay people who died in the September 11th attacks will not be eligible for the same compensation as heterosexual family members who lost their loved ones. This is bad enough, but then he said that the Attorney General has promised undocumented aliens that if they come forward to claim a benefit, they will get a check as compensation for their lost family member. Relatives of people who were in violation of federal law will be compensated by the same government whose laws their loved one broke. When it comes to gay people who died, and their survivors, however, Feinberg conveniently falls back on a states' rights argument to exclude the survivors from being compensated. Feinberg claims that this policy is meant to avoid lawsuits. I hope and expect that he'll get lawsuits anyway from those everyway-but-legal family members of gay people who died that day. Does Feinberg forget that , a gay man, was one of those who prevented United Flight 93 from crashing into government buildings in Washington, D.C.? That the of American Airlines flight 77 was a gay may who may have left behind a grieving partner? That , a gay priest, died while giving aid to a wounded fireman? And these are just a few of the gay victims whose deaths have been publicized. This policy is a slap in the face to ordinary Americans who did extraordinary things on September 11th. To place illegal aliens ahead of United States citizens when awarding this compenstation is ludicrous and insulting. The federal government spends my gay tax dollars just as freely as anyone else's, and I expect to see those dollars distributed to all victims equally. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
