The statute provides for the Special Master to determine economic loss suffered by victims of the September 11, 2001 tragedy. Any such economic loss would reasonably be based upon the victim's earning capacity. Clearly, that earning capacity is best evidenced by the compensatioin the victim was receiving in the year of his or her death and within some reasonable period before that time. Nevertheless, the regulations choose to ignore the compensation being received by the victim in the year of his death and, instead, to look only to the three years preceding death. If the crisis had occurred early in the year, it might be reasonable to ignore the compensation in the year of death. However, the victims had worked almost three-quarters of the year at the time of the tragedy. Under the circumstances, it is unreasonable and unfair to ignore the compensation for the year 2001. The regulations can be changed to include the 2001 compensation within your discretion. The statute does not mandate that only the three previous years' earnings be considered in your equation. The current regulations unfairly prejudice the families of the young victims who received substantial pay increases and promotions for 2001. I hope that you will seriously consider making a change to include 2001 earnings in your formula equation for economic loss. We as his parents will live with this terrible nightmare the rest of our lives. The pain & suffering that we feel will live with us forever - he can never be replaced. A Parents' Pain & Suffering should be part of the non-economic fund's regulation. Our Pain & Suffering should be completely separate and apart from the compensation that his spouse and children are going to receive. Dear Mr. Feinberg: The following comments are in response to the interim guidelines established for the September 11th Victim Compensation Fund of 2001. On September 11, 2001, my 21 year-old son, was brutally murdered at the World Trade Center. As a result, my life and the lives of my husband and other children will never be the same. In our society, it is the right of individuals to be compensated for pain inflicted upon them by culpable parties. In its effort to protect the airline industry, Congress essentially took away that right from me by limiting the amount of any award to insurance coverage. In return, Congress enacted legislation to compensate me for 's murder. The interim guidelines, however, do not permit appropriate compensation. While I agree that all families deserve the same amount of compensation for pain and suffering the amount recommended is absolutely inappropriate and hurtful. The amount of $250,000 minimizes the pain and suffering my son, and each of the other murdered victims, endured. I urge you to increase the amount for pain and suffering to $2,000,000 per claim. While no amount will fully compensate us for 's death, a significant award will acknowledge our degree of grief and loss. Additionally, although the interim guidelines provide for compensation to victims' children, there is no mention of compensation to siblings. My son lived at home with his parents and two sisters. My daughters are devastated. They are suffering as though they have lost a parent. I urge you to acknowledge their pain by allowing additional compensation for siblings who lived in the same household with single victims. Finally, I urge you to make the final guidelines clear and unambiguous. Since the act of applying to the fund includes waiving one's right to pursue litigation, one must know absolutely the amount of compensation to expect in return. The interim guidelines appear to indicate the claimant's award may be determined by the claimant's financial need. If this is the case, it is another travesty. My level of financial security should have absolutely no bearing on compensation for my son's murder. Thank you for providing this opportunity to comment on the interim guidelines. Please consider the above recommendations in order to make this the compassionate, healing measure Congress intended. Feinberg Dear Mr. Feinberg; I saw you on Meet The Press on 3-10-02 discussing compensation for the 9-11 victims. During the discussion the issue of just compensation for the self-insured was briefly talked about. Basically, beneficiaries of victims who were privately insured are having the proceeds of those private life insurance policies offset from any benefits they are entitled to under the federal compensation fund, you are administering. In some cases, the proceeds of the private policies will even prevent some surviving families from receiving any benefits at all from the federal fund. Since these survivors are receiving monetary compensation through private insurance equal to or greater than the upper limitations of the federal compensation fund, this initially seems equitable. However, since this insurance "windfall" to the Federal Fund was generated through the payment (and sacrifice) of private premiums/monies, I believe to be really equitable in these cases, the Fund should reimburse the survivors for all the premiums paid out (up to the Fund's upper cap) that secured the private insurance benefits being offset. Of course this will cost the Federal Fund more money than it would otherwise pay out, but it will cost the Fund far less than if those individuals had not had the foresight and made the economic sacrifices to privately insure themselves. After all, if these individuals had taken their premium money and spent it on vacations, expensive cars, Rolex watches, diamond jewelry or just blow it, the Federal Fund would be paying them without any offsets. Even if these individuals had taken the premium money, invested it wisely, and were now enriched, there would not be any offsets to compensation by the Federal Fund. The catch here seems to be these individuals bought life insurance with the money. They should not be penalized for using those dollars to buy life insurance, while those who spent their dollars in other ways are compensated by the Federal Fund without offsets for not spending their dollars for life insurance benefits. I believe that failure to reimburse these individuals for the premiums they paid (with reasonable interest on their premium payments from policy inception) would in effect be punishing them for their economic responsibility and foresight. For the Federal Fund to do less would not be equitable, especially in light of the circumstances and sacrifices involved. I appreciate the work you have done in the difficult process of trying to draft rules to apply the Airline Stabilization Act (the "Act") that are within the Act's meaning and fair to all the parties involved. However, I feel that the presumptive award calculations enunciated in the interim rules, particularly in the case of non-economic losses, misses the mark. Please keep in mind that the Act took away very significant rights of the victims by capping the liability of the airlines at the same time as setting up the victim compensation fund (the "Fund"). It also requires the victim's representative to forgo his rights in pursuing a remedy in a court of law as a condition applying for benefits from the Fund (without knowing the amount of the settlement that they are accepting into). I also believe that the public is being misled into thinking that payouts from the fund is much more generous (making "instant millionaires" out of victim's families) than they will actually turn out to be ("1.6 million dollars on average" fails to account for the various collateral source deductions). I have read many comments suggesting that payments from the fund should be thought of as "a helping hand" rather than "compensation." However, compensation is clearly what the Act requires. The Act has significantly curtailed the rights of victim's families to seek damages in court and, at the same time, set up the fund so that the burden for protecting the airlines and other parts of the economy would not be shouldered by the very same people who have already suffered the ultimate loss (i.e. the victims and their families). The fund, therefore, is an attempt to provide for fair and just compensation outside of lawsuits. The amount of "presumed non-economic loss" of $250,000 plus $50,000 for each of the victim's spouse and dependants is not in concert with the Act and has no relationship whatsoever with amounts of non-economic losses awarded in wrongful death lawsuits. Instead, the amount is tied to some arbitrary amount of life insurance that the federal government offers to members of the military and public safety officers? This makes no sense, and is directly contrary to the requirements of the Act. The Act passed by Congress and signed by the President defined "non-economic losses" in twelve categories, including losses for physical and emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium (other than loss of domestic service), hedonic damages, injury to reputation, and all other non-pecuniary losses of any kind or nature. The interim rules do not even make an attempt to comply with the very plain language of the Act. Congress decided that it would be in the best interest of the nation to prevent the collapse of the airline industry by limiting lawsuits brought by victims, and these victims are entitled to receive compensation in line with what Congress spelled out in the Act. It is not for the Department of Justice to substitute its judgment for that of Congress and the President by arbitrarily discounting non-economic losses. The amount of life insurance, upon which the interim rules bases the non-economic loss "calculation", is totally unrelated to pain and suffering, mental anguish and other non-economic losses and was not arrived at by weighing all of the factors that the Act lists. It should also be noted that life insurance payout to public safety officers and members of the military (i) is made whenever a public safety officer is killed while on duty regardless of the cause of death, regardless of how much suffering was involved, and regardless of who was at fault (ii) is not reduced by collateral sources including the amounts of any additional life insurance that such public safety officers or members of the military may have purchased on their own behalf, (iii) is not contingent upon the deceased or his family giving up his right to sue for wrongful death, and (iv) is not made in consideration of significant liability caps being placed on a potential defendants. Consider the situation of a member of the US military who died in the terrorist attacks on the Pentagon. Under the interim rules his family would be entitled to presumed non-economic damages of $250,000. The Act then requires them to deduct the $250,000 government life insurance amount. Thus, the Act not only leaves him with ZERO for non-economic damages, should he choose to accept it, it also severely limits his alternative rights by capping the amount of liability by the airlines. I do not believe that Congress intended such a result. While a fair amount of compensation is admittedly difficult to arrive at, there is plenty of precedent. Judges and juries do this all the time in wrongful death cases, and, depending on the state law being applied, often arrive at an amount considering many or all of the very same factors required by the Act. The rules would do better to calculate the presumptive economic loss by applying the Act rather than substituting an arbitrary life insurance amount. Thank you for considering my views on this.
