Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Thursday, January 17, 2002 9:37 PM offsets To the Office of Management Programs: As a basis for my comments: I did not personally know any the victims or decedants in the 9-11 disaster (or have any as clients). I was for 15 years a third generation banker to individuals and small business's. Have a BS in economics and an MBA in finance (University of Chicago) I was a corporate CFO responsible for starting or revamping two company 401-k programs and educating employees to the need to save for their future. I am now a financial advisor in the NYC area selling financial planning, insurance, 401-k plans, insurance, retirement products at a major NYC (suburban) investment house. I donated a fair amount of money to the 9-11 disaster in the days immediately following the attack and I hope it is used wisely. With that as a background, my thoughts are as follows: I am basically comfortable with the concept of allocating money from your fund based on age and family life cycle. The problem I have is concerns the "offsets" of sound financial planning to reduce the settlements being offered. As a secondary issue, although I agree with the family life cycle you have chosen (age, income, children, etc), getting a settlement of over $4 million is far too much. All my life, I have had an exceptional exposure to people and how they manage thier money, from the youngest of days. Today, I make my living selling those services in the most competitive world in and around NYC. The people in and around NYC, at all income levels, are probably more exposed to the financial bombardment of advertising, cold calling, exposure to investment products than anywhere else in the US. From the diversity of my background, I have more exposrue than most to the difference in investment attitudes at all levels of income and backfround. I have clients who earn less than $50k annually be very concerned about putting money aside for thier future and accumulate over $1 million while having met others (especially in my lender/banking background) earning 5 times as much have to borrow money to meet monthly living expenses. The program as currently laid out rewards those who bought Mercedes and BMW's rather than the Ford Escort. It rewards those who bought expensive houses, and it rewards those who, because of all these payments, couldn't "afford" yet to save money in their 401-k or buy insurance. It penalizes those who did without, to have a house that was paid for, have money in their 401-k or thought it a good idea to purchase additional life insurance coverage in case they were run over by a bus. Even around NYC, an untaxed $2million settlement (max) can go a long way. It can buy (or payoff) a half million dollar mortgage. It can purchase a $1million worth of 7% Freddie Mac bonds that will throw off $70k of income. And it can purchase $500k of reasonably blue chip equities that can generate another $10k of income that could grow each year. If any individual needed more than $2 million to support their lifestyle, then they should have met with someone like myself to purchase insurance, start saving in an IRA or 401-k, bought the Ford Escort or Chevy instead of the Porsche or Mercedes or BMW. Basically, I sincerely think you should consider lowering the cap on what you pay as a settlement but not adjust it lower for other forms of offset that prudent savers got because they were wise and reward those who got themselves so much in hock that they need the $4 million. I am not trying to understate the value of ones life. There is no easy way to put a value on it. The concept of helping those in need is nobel, and---with incomes below $50-75k---- go for it. But to accept that one person earning $175,000 should get $4,451,060 if s/he had no collateral offsets because s/he was not prudent in buying some life insurance or saving money, while his/her compatriot in the next cubicle earning the same amount and in the same situation, deserves less because they bought a cheaper house, cheaper car and bought insurance "just in case" is just plain wrong. I would prefer that you not use my name if you publish my comments, but I would be happy to discuss with anyone some of the ideas I have here, should anyone actually read this memo and think my comments worthwhile. Saturday, January 12, 2002 11:00 PM Victim's Comp Fund Dear Mr. Feinberg, I will make this brief. Under the current table I will receive little or no compensation. I will be receiving very limited funds as a result of the offsets. To be penalized by deducting Life Insurance from the Fund is an outrage. My husband paid for his Life Insurance on his own in an effort to help his family in case of death. By deducting all the 'Death Benefits' I would have no choice but to seek a third party litigation. I would rather NOT go down that road but I want to provide a life for our now 6-month old son that my husband would have wanted. No amount of compensation will make up for the loss of my husband but by penalizing us for his Life Insurance just adds to all the heartache we already feel. I ask that you please reconsider this or ADJUST the tables so there is some sort of compenstion to help us deal and go on with our 'new life.' Wednesday, December 19, 2001 9:38 AM Repect human rights December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. The value of loved ones lost by these folks is no more than those lost by other terrorist acts, such as Oklahoma City bombing (even though this was related to a "home grown" terrorist.) The fund should only help defray some lost income (to a certain point) that would help fund college education, for example. It should not be intended to enrich nor to assure that "Johnny" or "Jane" get a free education at Harvard. It should help assure that people are not suddenly thrown out of homes and that basic needs are met. For those living very expensive life styles, that may have to change. Do not expect us, the taxpayers, to maintain that standard of living. I want to see exactly what costs this money is supposed to reimburse. It disgusts me to hear that some are complaining that $1.6 million is not enough. Sorry, but no amount can replace the person lost, and the taxpayer should not have to try to pay for that replacement at $1.6 million per family. Period. It isn't fair to the taxpayer and to other victims of other tragic circumstances. This program should not allow people to take advantage of the sympathy that we all feel for the victims and their families. Most of the people I have spoken to in my office and at various meetings feel essentially the same way I do. If it were me, I would be devastated by the loss of my family member. Absolutely. I expect I would like some assistance to help me over the initial rough adjustment period (a few months). But I would not expect a huge gift of money from the government, on top of what the Red Cross and others have collected to provide for those affected in this tragedy. So, do I understand that some of these "victims" are whining even though they can expect to recieve money from the taxpayers and from the numerous 9/11 Victims Funds? Sorry, but I think that is lousy. I hope all the money that our family sent to the Red Cross is spent to provide basic food and clothing and other basic assistance for those who need help and appreciate it. We don't mind helping out those in need, but we don't like feeling like we are paying for lotto jackpots for people. Friday, December 28, 2001 10:34 PM Equal Rights for All December 28, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Additionally, it should be noted that gays & lesbians were equally devastated by this disaster, with one of the killed pilots being a gay pilot, &nbsp&nbsp&nbsp ; one of the heroes of Flight 93 who subverted the terrorists attack by forcing the plane down in a field in Pennsylvania, was Gay Business Owner and Rugby player, ; also tragically killed were a gay couple and their adopted son who were aboard Flight 175; and The openly gay NYFD chaplain who died while reading last rites to a victim at the site of the WTC; and the list continues and continues. Just as gays & lesbians are represented in those who morn and are contributing to relief and recovery efforts and who put their lives on the line everyday as fire fighters, paramedics and police officers SO is our tremendous loss and grief. Please treat all the survivors of the victims' of this terrible tragedy equally with the greatest amount of respect and honor and financial support as possible--regardless of financial status, sexual orientation, race, gender, social standing, religious affiliation.
