THis is mind boggling and I strongly disapprove of your policy. I am also deeply disturbed that my donation turns out to be discriminatory toward a significant group of Americans. I find your reasoning faulty, and wonder if this is a homophobic bias on the part of your department. Surely, if exceptions can be made for the families of undocumented aliens (a move that I approve of heartily), you can find a way to face the potential individual lawsuits you fear? Shouldn't the one person/one vote reasoning apply to government compensation? 2. Why should I, a taxpayer, compensate German, Japanese, etc. expatriates that happened to be killed in the terrorist act? Why not their governments? 3. Why should a well-paid dead-beat who didn't buy insurance and lived high-on-the-hog get more government compensation than well-paid disciplined individuals that used some of their earnings to buy insurance to provide for their families. 4. What constitutes the victim's families? Mother and father - I hope not. Wife and kids - I hope so. 5. The program seem a little rich with the average family receiving $1 million from tax exempt charities and another $1.6 million from you folks. 6. Why is the compensation tax exempt? Maybe to compete with court awards? Why not just limit the 'tort' awards to something like the compensatory award - and make our lawyers cry? 7. What makes our airlines liable at all? Their passenger screening just followed government rules, didn't it? 8. You didn't compensate at Oklahoma City. Sunday, January 27, 2002 3:42 PM Compensation After reading many articles and comments about the Victim's Compensation Fund distributions, I have come to the conclusion that the victim's families are full of greed and will continue to expect more and more if you are held hostage to their requests. If their family member would have been killed in an auto accident on the way to work that day, they would not be receiving the many benefits being offered to them, and I am sure the pain of their loss would be no less. I knew from the beginning this would end in a big mess. I am not a cold-hearted person and have shed many tears over this tragedy; however, I request that you stand firm in your plan and not offer any more money or benefits to the survivors. I support the war on terror completely, and the taxes that need to go to cover it. That said, the victims' compensation fund is a travesty! Other people in public service are killed all the time. Are we going to give $1.5 million the the families of all the servicemen who are killed fighting this war? No! And the way these families are trying to "get rich" at the expense of other people is ridiculous. Human nature is disgustingly selfish, and the government better realize that we need to spend our tax dollars on fighting terror, not paying off the victims. There will be more terrorists attacks. Anyone with an ounce of common sense knows that. What are we going to do? Go broke paying of victims' families, or spend our limited resources on winning the fight. Many of the benefits that need to be deducted like business travelers insurance and company life insurance and AD&D were free benefits, readers!! In many instances these total $2,000,000. They were an executive/employee benefit. The higher one's salary, the higher these numbers are! Further, many writers fail to realize that widow(ers) have received the above, whereas parents/ the first family of divorce - did not get this benefit. So, widows(ers) walk into the fund with $1,000,000 to $2,000,000 of company benefits and the divorced and children walk into the fund with 0. I think the writers are failing to see the inequity. Not everyone divorced wanted to be in that situation either. Writers are complaining that victims should not be penalized for being savvy in financial planning, but in many instances if was all gift from employer as part of their benefits package. Thank you. Monday, January 14, 2002 1:22 PM (no subject) The proposed rules concerning reduction of payments on account of life insurance pensions etc. should be modified.Rather than a single national rule, the effect thereof for each victim should be determined based on his domicile or else his primary place of employment, and the law of collateral benefits for that situs should apply. Most victims let the state of their domicile or employment control their daily personal and financial actions, and it can be presumed that if, for example, a victim bought a life insurance policy, he expected that the situs of employment/domicile would apply its collateral benefits rule in the event of a tort causing death. It would be inequitable for a single rule to apply. The result would be that for most victims in the airplanes, the collateral benefits rule for their home state or state of employment would apply. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. Sunday, January 27, 2002 10:29 AM Comments re: Public Law 107-42 Sirs, I do not concur with the passage of Public Law 107-42 authorizing the disbursement of tax dollars to the families of victims of Sept 11, 2001, and my comments are cited, below. The creation of this fund concurrently creates a separate "class" of Americans who without precedent, derive a federal subsidy for a personal, family tragedy. Clearly, the families of those killed or injured on Sept 11th are suffering their losses yet these families are not isolated either in America or the world when it comes to family tragedy and the subsequent consequences. Millions of people annually including millions of Americans suffer tragedies either as a result of a natural disaster or at the hands of terrorists, be they international or domestic. Yet the US Government does not create a fund to "pay" for life obligations incurred by the families of those who died or were hurt. Individually, all people are responsible for their own lives and by extension, for the welfare of their families. That is why such things as life insurance, disability insurance and countless other existing programs are available. When a police officer dies in the line of duty, the family of this hero is awarded $250,000 based upon federal law. This already exists. An active duty military military member is automatically covered by the Serviceman's Group Life Insurance, in addition to any other personal coverage the member may have. There are numerous other ways in which individuals who are responsible and forward thinking, prepare to care for their families in the event they are killed in an accident or other violent event. In the case of Sept 11th, hundreds of millions of dollars were also donated for those families and numerous employers of deceased victims are also helping family members with long term medical, education and other expenses for children and spouses. Thus, the families of victims of Sept 11th can expect to receive hundreds of thousands of dollars worth of assistance without the existence of a federal fund. This fund was created secretly and without the knowledge of the American public at large. Mr. Feinberg has been quoted as stating it is a "gift of the American people." He is mistaken. It is perhaps his gift as well as a gift of the US Congress but not of the public at large. We had no say in this matter. I strongly disagree with the disbursement of these excessive funds and I am particularly chagrined that Mr Feinberg has even gone out of his way to offer these funds to "families of illegal aliens." It is not the US taxpayer's responsibility to subsidize these families. Illegal aliens have no legal right to be in the USA and by extension, their families have no legal right to any US tax dollars for any reason. Low interest loans, grants or other conventional systems should be followed in this case as they are in all other cases. As a matter of fact, my familiy and I were once victims of a natural disaster that took lives. Neither my family nor anyone else received such grandoise handouts as are now being disbursed. We are just one of millions of families who expect everyone be treated fairly and equally......We didn't expect the US Government to give us anything and we didn't ask for any handouts! I too feel empathy for those lost or hurt in NY, DC and PA but I strongly oppose these fund that will be making instant millionaires out of families who are themselves responsible for their lives. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
