Gay and Lesbian citizens of the United States are just that: citizens of the United States. Wasn't the fund was set up to aid survivors of people lost in those attacks? If a person can show financial dependence on another person who was lost and therefore request aid, WHO ARE YOU TO SAY THAT RELATIONSHIP WAS NOT VALID? To deny same sex partners aid based on law and break the law by extending aid to illegal aliens is hypocrisy. Taking the side of state law on this issue is the coward's way out. Fight, stand up and do the right thing. Same sex couples can not get married, they can not stand up and say "I do" in the government's eyes, so people who met and were married 1 hour have exponentially more legal protections when they lose that loved one. Is that right? Would it not be more fair to ask people to show there is now more financial hardship since their loss? This would cover anyone, gay or straight who really needs financial help. I'll leave you with this thought. Gay and Lesbian people are numerous in this country, they tend to be civic minded and they tend to support social justice. Wednesday, March 20, 2002 3:34 PM Victim Compensation Fund should not discriminate All of those who died September 11, 2001, deserve to be remembered, and their families, "traditional" or not, deserve to be given equally fair compensation by our government of ALL the people. To deny families of gays and lesbians the same benefits of the Victim Compensation Fund would be to say that their children are less deserving of support by our society and that their partners in life were not just as loved, caring and supportive as the children and life partners of other families. To make such assertions would not be fitting of America and it would be against American values of fairness to deny them the same benefits as other families. February 25, 2002 Mr. Kenneth Feinberg Special Master Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue Washington, DC 20530 Dear Ken: As a follow up to our earlier memo on undocumented immigrants and their access to the Victim's Compensation Fund, we wanted to elaborate on specific steps relating to employers. As you know, employers will provide critical support to Fund applicants, both in terms of (i) proving presence at the WTC site and (ii) documenting economic loss. For that reason, it is important that employers are encouraged to come forward in support of undocumented victims, and you might consider the following measures aimed at addressing their concerns about potential liability. Advocates have confirmed that many workers in the WTC area were undocumented immigrants and that often these workers were using falsified documents. Employers, particularly the larger ones, were more likely to have dealt with these workers above board, which is to say providing formal pay stubs and filing W-2s with the IRS. In those cases, employers face little risk (though they may still be reluctant) in coming forward and much of the relevant information should already be accessible. The tougher cases involve employers paying their undocumented employees under the table. These employers face potential liabilities on various fronts (INS, IRS, DOL) and to the extent that no formal documents exist proving the employment or earnings, the employer's support is that much more critical to the undocumented victim. In both cases, employers are likely to be more forthcoming if they can be assured that: (i) their name will not be connected to any compromising information; (ii) none of the information will be used (or distributed) outside of the Fund application process, or (iii) they will not suffer any liability stemming from the information they provide. 1. Anonymity. Providing some degree of anonymity may be the most effective and easiest way to ensure protection. This could be achieved by pooling employee victims (and their respective earnings) without identifying employers. The process would have to be organized in such a fashion (perhaps administered by a non-governmental body) as to assure employers that their anonymity would be protected. Such a list would offer near complete protection for the employer and would be relatively easy to implement (requiring no additional agency approvals and minimal resources). The list wouldn't be complete and would be less authoritative than the formal documentation requested by the Fund, but it might provide the critical proof for some applicants. 2. Confidentiality. A promise of confidentiality would provide some comfort to employers if it were really possible to restrict the flow of information provided through the benefits process. However, there may be limits on your ability to avoid sharing information with other government agencies and employers may still be wary of leaks. 3. Immunity. Federal and local bodies commonly offer immunity from prosecution in exchange for important information and, given the importance of the issue, there ought to be some way to carve out protections in this case. Presumably, employers would only gain immunity from prosecutions arising from the information provided, but that should help encourage them to come forward. These are only partial remedies. Each presents its own set of complications. We offer them as possible parts of a package you are preparing aimed at ensuring compensation to those most in need of help. This is information worth struggling to obtain not only for purposes of the Fund, but in helping those simply seeking some confirmation about the fate of family members and/or seeking benefits from other sources. But this is a unique situation, and lawsuits would clog the courts for a very long time. At any rate, with all of the monies that have been collected, deducting many already available benefits (social security, etc) brings everyone to a more level playing field. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, January 11, 2002 12:51 PM REALITY CHECK I am very bothered by what I perceive as greedy people when it comes to distribution of funds to the victims of Sep 11th. The U.S. Government had to bail out the airlines to keep them from all going bankrupt. This was a necessary action as the transportation industry touches all of us either directly or indirectly. Their collapse would have been catastrophic for all of us economically. Why did the Government set up a fund for the victims of 9/11? From what I understand, it is to prevent individuals from filing separate lawsuits against the either the Government or the airlines. I believe that was a prudent move by the President and Congress. The unprecedented outpouring of generosity by all Americans, the efforts of charity organizations, and this Government fund more than adequately provide for the families of the victims. I realize that this is a terrible period for those who lost loved ones, but I believe that this type of quibbling about money can only have a negative impact on everyone. Is there anyone who really believes that any American or American organization/business wished this on anyone, or that they were deliberately negligent, and that their actions led to these attacks? I don't think so. So what's the purpose in pursuing individual lawsuits against anyone; it will only force the airlines to go under and the victims won't get their money then anyway. We will then be in worse economic shape than we are now. Everyone will suffer. There is no way for distribution of these funds to be totally fair in the eyes of everyone. That's just the way it is. I am a U.S. Marine. If I were killed in ground combat in Afghanistan, my wife and three children would receive $250,000.00 in life insurance that I paid for, and a couple thousand for burial expenses . If they happened to live on a military base at the time of my death, they would have 30 days to move out. There is no private fund set up for my family, no automatic college fund for my kids. Does that seem fair - not to me, but that's just the way it is. Let's no let the lawyers drive the train on this. We all need to take a step back, and GET REAL. Tuesday, March 12, 2002 7:41 PM Compensation for gay partners I read a shocking article today which implied that gay partners of September 11 victims will not receive the same benefits as their hetereosexual counterparts. If this is true, I am very saddened. I am a female who happens to be hetereosexual, but I have many friends who happen to be be gay. I admire them tremendously and would hope that their partners would receive their due had my friends been victims of terrorism. Apparently the administrator of the Sept. 11 fund spoke on Meet the Press this weekend and made it clear that if homosexual unions were not recognized by states, he would not recognize them either. That is the most ridiculous statement I've heard. I doubt there are many citizens of the United States who would not want gay partners to receive compensation for their loss. Get with it! The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
