Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. While I am grateful that I did not personally know anyone that died in the tragic events of September 11th, I not only saw my father reduced to tears at the loss of many of his close friends, but watched the tragedy unfold from my window. The realization that the view from my college was better than most footage being played on the television behind me forever altered my perceptions of human life. On the one hand, I was torn apart by the thought that any human, terrorist or no, could be capable of such a devastating blow to our world. On the other, I was angry that I was so insignificant, and that there was literally nothing I could have done at the time to prevent the day's events. Even now, more than six months after the tragedy, my friends and I have sat down and cried about our personal experiences in dealing with the aftermath; the loss of loved ones, our inability to cry, and our feelings of anger and futility at the thought that giving blood and supplies to the Red Cross was the limit of our power. One thought that we all agreed on, however, was that the tragedy united our nation on a level we never thought possible. I feel that unity every time I walk down the street and make eye contact with my fellow New Yorkers. What a shame that this eye contact, or these kind words and deeds between strangers must all come as a result of such a blow to human life. One would think that, as a result, we would want to embrace that unity, hold to it as a reminder that we must grow strong as a nation and put our differences aside. Yet now I hear that this strength is once again being threatened, not by the simplicity of a physical evil, but by the complexity of oppression. By using the "law" selectively, we have given illegal aliens compensation for their loses. We have even surpassed the age old argument of where life begins by compensating families for pregnant mothers and unborn children. Why then, do we dare to split the unity by alienating the gay community? Are not gays, lesbians, and bisexuals people too? Do they not breathe the same air as blacks, whites, men, women, legal and illegal immigrants alike? Or are they something else, something inferior, because they choose to live their lives differently? I am nauseated by the mere thought that this could be true, and I consider the deliberate denial of funds to the loved ones of homosexuals as great an evil as the act of 9/11 itself. By hiding behind the double standards we call laws, we are showing that we are not stronger as a result of September's devastation, we are weaker. The word unity is not fit for a nation that can join together in mourning only to tear itself apart again. Therefore, I beseech you: think not with your mind, but with your hearts. It was not human calculation that brought us together in the aftermath, but human compassion, and it is our duty to keep that compassion alive. The loved ones of gay and lesbian heroes of September 11th deserve our support as much as any, and denying them this is as great an act of terrorism as any. Unfortunately these two noble objectives are on a collision course. Your distribution formula is badly flawed because your assumed rates of compensation growth are much too high. The effect of this mistake is twofold. First, of the funds available for distribution, too much is allocated to economic loss and too little to non-economic loss. Second, although the faulty formula proportionately "overcompensates" everyone for economic loss, more of the actual dollar amount is allocated to the highly compensated, at the expense of the less highly compensated. Both of these consequences tend to favor the rich expense of the poor. This is true despite your passionately and eloquently stated reluctance to play the role of Kind Solomon by deciding that some lives are worth more than others. The appended spreadsheet documents my argument using one hypothetical worker, age 25, who earns $18,000 a year, and a counterpart earning ten times that amount. The excessive compensation growth assumptions in this admittedly extreme case result om a misallocation to the more highly paid individual of $1,538,723. At the very least, I urge you to revise your growth assumptions so that they are in better accord with economic reality, and with customery courtroom practice. In today's environment, a generalized growth rate of 3.5% is probably appropriate, rather than the rates of up to 6.6% in your current formula. It would be better still, I think, to de-emphasize compensation for economic loss, and to correspondingly increase your allocation for "pain and suffering," hewing to your established principle of compensating everyone, rich or poor alike, by an equal but now presumably much higher amount. I note that you are performing this service to your country without compensation, and if I can be helpful to you, I will gladly contribute my services as well. As the largest legal services organization in New York, the Legal Aid Society has extensive, hands-on experience providing direct legal assistance for low income New Yorkers, including low income immigrants. Annually, the Society provides civil legal services in more than 23,000 cases for low income New Yorkers through a network of neighborhood-based offices and city-wide special units, including an Immigration Unit. Substantial numbers of our clients with civil legal problems are immigrants. As part of our work, we provide comprehensive direct legal services to New York City*s immigrant community in a variety of legal forums, and work in coordination with other organizations to make civil legal assistance available for immigrants. We have testified before City, State, and federal legislative bodies at the request of public officials; worked cooperatively with all levels of government; and represented groups of similarly situated clients, including immigrant families and children, to address systemic problems. In the aftermath of September 11th, the Legal Aid Society has provided direct legal services to hundreds of New Yorkers directly and indirectly affected by the September 11th attack. The Society staffs a *Legal Services* table at the Federal Emergency Management Agency (FEMA) Disaster Assistance Center at 141 Worth Street, and helps staff Immigrant Affairs tables at both the FEMA Center and the Family Assistance Center, first at Pier 94 and now at 51 Chambers Street. We have published and distributed a comprehensive and regularly updated Guide to WTC Disaster-Related Assistance (available on our web site at www.legal-aid.org), established a toll-free disaster hotline, and provided legal and technical assistance to community organizations throughout the City. Based on our experience and on behalf of our clients, we are submitting these comments to ensure that low income New Yorkers, including immigrants who were injured or who lost family members in any of the three federal disaster areas, are able to obtain access to the Fund. Eligibility (Section 405(b)) As stated in the Supplementary Information: Statement by the Special Master, the purpose of the Fund is to *provide fair, predictable and appropriate compensation to the victims of September 11 and their families . . . .* Eligible persons are defined as *individuals [aboard the planes or those] who were present* at the World Trade Center, Pentagon, or Shanksville, Pennsylvania sites or their *personal representatives.* As written, the Act does not consider the immigration status of the deceased or injured victim or his or her personal representative. Accordingly, claimants must be compensated without regard for immigration status. This approach correctly advances the Fund*s goal of providing just and fair compensation to those who lost their lives or became injured as a result of the September 11th attacks. Perhaps more than any other claimants, undocumented persons are likely to rely on an award from the Fund as a primary source of compensation and income, since undocumented persons typically earn less, have fewer employment prospects, and are entitled to fewer social services, than are citizens or other immigrant groups. To ensure that all statutory beneficiaries can come forward to make a claim to the Fund, regardless of immigration status, certain confidentiality guarantees will need to be incorporated in the regulations. First, it would be appropriate to ensure and make publicly known that information regarding undocumented persons who come forward to be compensated will remain strictly confidential. Without such a provision, many undocumented or Permanently Residing Under Color Of Law (PRUCOL) immigrants may be too fearful of deportation or removal to seek access to the Fund. This would interfere with the Fund*s purpose of compensating the victims. Thus, the Special Master should adopt and enforce a policy that information regarding the immigration status of a claimant will not be provided to the Immigration and Naturalization Service or any other agency or office. Likewise, the Special Master should obtain from the INS a formal agreement that: 1) the agency will not seek immigration status information about claimants to the Fund; and 2) if the INS learns of immigration status problems brought to light as a result of seeking access to the Fund, the agency will not act on that information. Similarly, the Interim Rule describes the use of numerous forms in the course of a Fund application (an*Eligibility Form,* a *Personal Injury Compensation Form,*and a *Death Compensation Form*). To the extent these forms seek immigration status information, Social Security Numbers, or other information which could be used as evidence of an immigration status problem, they could effectively act as an *immigrant screen* on the Fund, deterring needy persons from coming forward if they fear immigration consequences. We suggest that the forms used to access the Fund not request Social Security Numbers or immigration status, or at least make optional the answers to questions about Social Security Numbers, immigration status, and other information that could potentially reveal immigration status. Filing for Compensation (Section 104.21) Section (b)(3)(iv) proof of physical harm: We note that the Eligibility Form may require claimants to file proof of physical harm, including *contemporaneous medical records . . . and records of all continuing medical treatment.* Because many low income families and individuals, especially immigrants, lack access to health insurance, they are more likely to forego medical treatment in the event of an emergency. Under these circumstances, we suggest allowing uninsured persons to use non-contemporaneous medical records, including records for medical treatment sought now and in the future, for injuries suffered at the time of the disaster, provided that the treating physician affirms it can be ascertained that the injuries were suffered because of the disaster. Section (c)(1): We note that the requirement for tax returns and employment information may exclude otherwise eligible claimants from maximizing their recovery. As a preliminary matter, most employers of undocumented persons refuse to provide information about themselves for fear of INS reprisal. Thus, as we have observed since September 11th, uncooperative employers can thwart employees* efforts to access assistance. The Special Master should resolve this conflict by providing in the regulations and making it publicly known that information regarding the employment of undocumented persons who come forward to be compensated will remain strictly confidential and will not be disclosed to any other agency or office. Likewise, the Special Master should obtain assurances from the INS that information regarding the employment of undocumented persons gathered in the course of a Fund application will not be the basis for any adverse action by the INS against an employer or employee, and that the United States will not seek to prosecute employers who come forward to verify employment of undocumented persons. Conclusion We appreciate this opportunity to comment on the Special Master*s regulations relating to the needs if immigrants. Zwick, Director Office of Management Programs, Civil Division U.S. Department of Justice Dear Mr. Zwick, As someone who believes in equality and the American way, I urge the Department of Justice to adopt rules that are inclusive of lesbian, gay, bisexual, and transgender people and their families who suffered from the attacks on Sept. 11, 2001. Please include among relatives eligible for compensation those who lost their life partners or de facto parents or children, regardless of sexual orientation/gender identity or marital status. This is the only fair way to proceed after such a horrific act of violence. Studies show that approximately 10% of the population is gay, lesbian or bisexual. With approximately 4,000 lives lost as a result of the terrorist attacks on Sept. 11, one could estimate that 400 people who were lesbian, gay or bisexual lost their lives. Their families should be treated with the same dignity and respect as other families who lost their loved ones during this tragedy. We can not believe that any serious consideration would be given to a plan that would make these people victims of a home grown bigotry against gay men and women. However, we also believe it could be true -- astonishing but possible. All victims of September 11 should be treated equally without regard to race, sex, age, financial condition, national origin -- or sexual preference. According to Feinberg, lots and lots of people will receive compensation under the plan, including children, babies, and even fetuses. And as an indication of how generous the fund will be, even illegal aliens, who aren't American citizens and who are in the US in violation of federal law, will receive benefits. Feinberg even says that the Attorney General has promised that if undocumented aliens come forward, they won't be kicked out of the country, and their employers won't be penalized. "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," Feinberg told "Meet the Press." Yep, the Attorney General is himself willing to overlook US law so that the victims of September 11 can be compensated. But when it comes to gay Americans who lost a loved one to Mohammad Atta and his band of thieves, that's when Feinberg and the Department of Justice suddenly do an about face: "[Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. Saturday, March 16, 2002 1:44 PM To whom it may concern and to the general public, I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Apparently, that family just got a divorce. The hyphens seem not to matter when our government wants to use our heroism to inspire others, but when it comes time to actually aid the families of those heroes, the hyphens come back with a vengeance, and it seems that some American heroes are now more equal than others. Even fetuses and illegal aliens will be receiving benefits under this problem - heck, they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. Wednesday, January 16, 2002 12:45 PM comments regarding interim ruling The events of Sept 11, are unparalleled in US history. The scale of destruction and grief while seemingly unimaginable are profoundly real for many Americans. My brother was killed at WTC on 9/11. I closely followed how events unfolded on every front as our country responded to the attack. The actions of leaders from the President and his officers, the Mayor of NYC and others has been tremendous. The American people have become proud again of each other and their country. A glaring exception to the rule has been the handling of the Victims Compensation Fund. As I waited for the ruling to be published my gut feeling was that the DOJ would handle the ruling with the dignity this unparalleled event merits. I had the feeling that because the attack was an extraordinary symbolic attack on the spirit of America the response in support of those affected would be reciprocative in scale. I was deeply disappointed. I purposely waited these few weeks before responding to the ruling because the special masters ruling angered me to the point of distraction. I found the tone and language callous and dangerously out of touch with the context of the event. The ruling felt like another blow, more fallout from the attack. I share the interpretation of many regarding the priorities of special master as spelled out in the interim ruling. Specifically: The airline bailout act gave the airlines $15 billion of taxpayers' money and capped the airlines' liability for the 9/11 crashes at the limits of their insurance coverage. It set up the Fund so the airlinesâ?? bailout would not come at the expense of the victimsâ?? families. DOJ has ignored the fundamental mandate of the act to provide full and fair compensation to victims and their families, and instead created a formulaic federal program based on irrelevant concepts more familiar to the bureaucracy. The DOJ's proposed awards for non-economic damages ($250,000 per victim plus $50,000 for a spouse and each dependent) are only one-tenth the level paid in comparable cases. For example, a spouse was awarded $5 million in non-economic damages in a lawsuit arising out of Lockerbie. Congress explicitly enumerated a broad range of non-economic damages for which victims and their families shall be compensated. DOJ ignored this, and based its presumed awards on a military group life insurance program (SGLI) with a maximum policy of $250,000, and a federal statute providing $250,000 to families of fallen public safety officersâ??on top of other amounts they may receive. DOJ's approach assumes that Congress intended the non-economic damages to be illusory, because a $250,000 SGLI payment for a serviceman killed at the Pentagon would wipe out those damages under the collateral offset requirement. DOJâ??s proposed awards for economic damages grossly underestimate actual losses, because DOJ relied on outdated, inapplicable work-life and life-cycle earnings data. Forensic economists have discovered other serious flaws in DOJâ??s methodology. DOJ underestimates promotions and other increases in earnings for victims. It relied on federal civil service and military retirement system boards that track federal worker incomes and pension requirements, not the higher-paying private sector career paths. DOJâ??s reliance on past 3 years of income (which the Special Master â??may averageâ??) looks suspiciously like a federal pension approach, rather than considering the likely income-earning potential of the decedent, as is routinely done in wrongful death cases. The regulations arbitrarily cap a victimâ??s income at $225,000 a year, cutting some familiesâ?? compensation by over 50%. As a result, many widows will have to sell their homes, deplete their childrenâ??s college funds, and give up their plans of being full-time parents while their children are young. A familyâ??s award may be increased above the â??presumptiveâ?? award only by a showing of â??extraordinary circumstancesâ??â??beyond those suffered by other victims or victimsâ?? families. This makes the hearing or appeal to the Special Master a mere charade. The low levels of the presumptive awards will result in many family members receiving little or nothing from the Fund, once the collateral source deductions (which are not required in a court case) are made. DOJ should fulfill, rather than flout, the actâ??s intent by revising its rules to compensate victims and their families for the types of damages specified by Congress, at levels comparable to those provided in the tort system the Fund was designed to replace. I am thinking that perhaps the special master is unaware of the level of achievement and the personal characteristics of so many of the victims. It seems that this ignorance and lack of empathy resulted in the sadly unacceptable version of the ruling that is currently on the table. As Representative King said: "They were the symbols of American capitalism, the symbols of American business, and they were murdered because of what they were,"... "Now they shouldn't be deprived of what they're entitled to." The interim ruling is grievously flawed in my opinion. My family and I are wondering about the thinking. To us it communicates cluelessness about the value of a human life. The rhetoric of the special master rings hollow, the response given to those whose loved ones were murdered is painfully inadequate. In the context of responses from the President and the Mayor, Senator Clinton, etc., the special master's ruling comes across as a lame, ill conceived trap that forces victims to suffer further. It is not at all a dignified attempt to respond to the murder of 3000 Americans working at the symbolic heart of America. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions.
